Resolução da Assembleia da República n.º 284/2021
Sumário: Aprova, para ratificação, o Protocolo Adicional à Convenção do Conselho da Europa
sobre a Transferência de Pessoas Condenadas, aberto à assinatura em Estrasburgo,
em 18 de dezembro de 1997.
Aprova, para ratificação, o Protocolo Adicional à Convenção do Conselho da Europa
sobre a Transferência de Pessoas Condenadas,
aberto à assinatura em Estrasburgo, em 18 de dezembro de 1997
A Assembleia da República resolve, nos termos da alínea i) do artigo 161.º e do n.º 5 do ar-
tigo 166.º da Constituição, o seguinte:
Artigo 1.º
Aprovação
Aprovar, para ratificação, o Protocolo Adicional à Convenção do Conselho da Europa sobre a
Transferência de Pessoas Condenadas, aberto à assinatura em Estrasburgo, em 18 de dezembro
de 1997, cuja versão autenticada em língua inglesa, e respetiva tradução para língua portuguesa,
se publica em anexo.
Artigo 2.º
Reservas e declarações
Ao aprovar o presente Protocolo Adicional à Convenção do Conselho da Europa sobre a
Transferência de Pessoas Condenadas, a República Portuguesa formula as seguintes reservas e
declarações:
a) Permanecem válidas as declarações apresentadas pela República Portuguesa aquando do
depósito do instrumento de ratificação da Convenção do Conselho da Europa sobre a Transferência
de Pessoas Condenadas, feito em 28 de junho de 1993;
b) Relativamente a estrangeiros ou apátridas com residência habitual no Estado requerido,
a República Portuguesa reserva-se o direito de, enquanto Estado da condenação, optar entre a
aplicação do artigo 2.º ou a apresentação de pedido de extradição;
c) A República Portuguesa aplicará a medida de privação de liberdade prevista no n.º 2 do
artigo 2.º nos termos estabelecidos na sua Constituição e legislação ordinária para detenção e
prisão preventiva;
d) Se a idade ou o estado físico ou mental da pessoa condenada o justificar, a República
Portuguesa entende que a opinião, relativa à transferência, mencionada no artigo 3.º, deve ser
emitida pelo respetivo representante;
e) A vinculação da República Portuguesa não afasta os compromissos assumidos no âmbito
da União Europeia e que determinem a aplicação entre os respetivos Estados-Membros de nor-
mas que, embora especiais, não são incompatíveis com a Convenção relativa à Transferência de
Pessoas Condenadas nem com o Protocolo Adicional.

ADDITIONAL PROTOCOL TO THE CONVENTION ON THE TRANSFER OF SENTENCED PERSONS
Strasbourg, 18.XII.1997
Preamble
The member States of the Council of Europe, and the other States signatory to this Protocol:
Desirous of facilitating the application of the Convention on the Transfer of Sentenced Persons
opened for signature at Strasbourg on 21 March 1983 (hereinafter referred to as “the Convention”)
and, in particular, pursuing its acknowledged aims of furthering the ends of justice and the social
rehabilitation of sentenced persons;
Aware that many States cannot extradite their own nationals;
Considering it desirable to supplement the Convention in certain respects;
have agreed as follows:
Article 1
General provisions
1 — The words and expressions used in this Protocol shall be interpreted within the meaning
of the Convention.
2 — The provisions of the Convention shall apply to the extent that they are compatible with
the provisions of this Protocol.
Article 2
Persons having fled from the sentencing State
1 — Where a national of a Party who is the subject of a sentence imposed in the territory of
another Party as a part of a final judgment, seeks to avoid the execution or further execution of the
sentence in the sentencing State by fleeing to the territory of the former Party before having served the
sentence, the sentencing State may request the other Party to take over the execution of the sentence.
2 — At the request of the sentencing State, the administering State may, prior to the arrival of
the documents supporting the request, or prior to the decision on that request, arrest the senten-
ced person, or take any other measure to ensure that the sentenced person remains in its territory,
pending a decision on the request. Requests for provisional measures shall include the information
mentioned in paragraph 3 of Article 4 of the Convention. The penal position of the sentenced person
shall not be aggravated as a result of any period spent in custody by reason of this paragraph.
3 — The consent of the sentenced person shall not be required to the transfer of the execution
of the sentence.
Article 3
Sentenced persons subject to an expulsion or deportation order
1 — Upon being requested by the sentencing State, the administering State may, subject to the
provisions of this article, agree to the transfer of a sentenced person without the consent of that person,
where the sentence passed on the latter, or an administrative decision consequential to that sentence,
includes an expulsion or deportation order or any other measure as the result of which that person will no
longer be allowed to remain in the territory of the sentencing State once he or she is released from prison.
2 — The administering State shall not give its agreement for the purposes of paragraph 1 before
having taken into consideration the opinion of the sentenced person.
3 — For the purposes of the application of this article, the sentencing State shall furnish the
administering State with:
a) A declaration containing the opinion of the sentenced person as to his or her proposed
transfer; and
b) A copy of the expulsion or deportation order or any other order having the effect that the
sentenced person will no longer be allowed to remain in the territory of the sentencing State once
he or she is released from prison.

4 — Any person transferred under the provisions of this article shall not be proceeded against,
sentenced or detained with a view to the carrying out of a sentence or detention order, for any
offence committed prior to his or her transfer other than that for which the sentence to be enforced
was imposed, nor shall he or she for any other reason be restricted in his or her personal freedom,
except in the following cases:
a) When the sentencing State so authorises: a request for authorisation shall be submitted,
accompanied by all relevant documents and a legal record of any statement made by the convicted
person; authorisation shall be given when the offence for which it is requested would itself be subject
to extradition under the law of the sentencing State or when extradition would be excluded only by
reason of the amount of punishment;
b) When the sentenced person, having had an opportunity to leave the territory of the adminis-
tering State, has not done so within 45 days of his or her final discharge, or if he or she has returned
to that territory after leaving it.
5 — Notwithstanding the provisions of paragraph 4, the administering State may take any
measures necessary under its law, including proceedings in absentia, to prevent any legal effects
of lapse of time.
6 — Any contracting State may, by way of a declaration addressed to the Secretary General
of the Council of Europe, indicate that it will not take over the execution of sentences under the
circumstances described in this article.
Article 4
Signature and entry into force
1 — This Protocol shall be open for signature by the member States of the Council of Europe
and the other States signatory to the Convention. It shall be subject to ratification, acceptance or
approval. A Signatory may not ratify, accept or approve this Protocol unless it has previously or si-
multaneously ratified, accepted or approved the Convention. Instruments of ratification, acceptance
or approval shall be deposited with the Secretary General of the Council of Europe.
2 — This Protocol shall enter into force on the first day of the month following the expiration of a
period of three months after the deposit of the third instrument of ratification, acceptance or approval.
3 — In respect of any signatory State which subsequently deposits its instrument of ratification,
acceptance or approval, the Protocol shall enter into force on the first day of the month following
the expiration of a period of three months after the date of deposit.
Article 5
Accession
1 — Any non-member State which has acceded to the Convention may accede to this Protocol
after it has entered into force.
2 — In respect of any acceding State, the Protocol shall enter into force on the first day of
the month following the expiration of a period of three months after the date of the deposit of the
instrument of accession.
Article 6
Territorial application
1 — Any State may at the time of signature or when depositing its instrument of ratification, ac-
ceptance, approval or accession, specify the territory or territories to which this Protocol shall apply.
2 — Any Contracting State may, at any later date, by declaration addressed to the Secretary
General of the Council of Europe, extend the application of this Protocol to any other territory speci-
fied in the declaration. In respect of such territory the Protocol shall enter into force on the first day

of the month following the expiration of a period of three months after the date of receipt of such
declaration by the Secretary General.
3 — Any declaration made under the two preceding paragraphs may, in respect of any territory
specified in such declaration, be withdrawn by a notification addressed to the Secretary General. The
withdrawal shall become effective on the first day of the month following the expiration of a period
of three months after the date of receipt of such notification by the Secretary General.
Article 7
Temporal application
This Protocol shall be applicable to the enforcement of sentences imposed either before or
after its entry into force.
Article 8
Denunciation
1 — Any Contracting State may at any time denounce this Protocol by means of a notification
addressed to the Secretary General of the Council of Europe.
2 — Such denunciation shall become effective on the first day of the month following the
expiration of a period of three months after the date of receipt of the notification by the Secretary
General.
3 — This Protocol shall, however, continue to apply to the enforcement of sentences of persons
who have been transferred in conformity with the provisions of both the Convention and this Protocol
before the date on which such denunciation takes effect.
4 — Denunciation of the Convention automatically entails denunciation of this Protocol.
Article 9
Notifications
The Secretary General of the Council of Europe shall notify the member States of the Council
of Europe, any Signatory, any Party and any other State which has been invited to accede to the
Convention of:
a) Any signature;
b) The deposit of any instrument of ratification, acceptance, approval or accession;
c) Any date of entry into force of this Protocol in accordance with articles 4 or 5;
d) Any other act, declaration, notification or communication relating to this Protocol.
In witness whereof the undersigned, being duly authorised thereto, have signed this Protocol.
Done at Strasbourg, this eighteenth day of December 1997, in English and in French, both
texts being equally authentic, in a single copy which shall be deposited in the archives of the Council
of Europe. The Secretary General of the Council of Europe shall transmit certified copies to each
member State of the Council of Europe, to the other States signatory to the Convention and to any
State invited to accede to the Convention.

PROTOCOLO ADICIONAL À CONVENÇÃO SOBRE A TRANSFERÊNCIA DE PESSOAS CONDENADAS
Estrasburgo, 18.12.1997
Preâmbulo
Os Estados-Membros do Conselho da Europa e os outros Estados signatários do presente
Protocolo:
Desejando facilitar a aplicação da Convenção sobre a Transferência das Pessoas Conde-
nadas, aberta à assinatura a 21 de março de 1983, em Estrasburgo (doravante denominada «a
Convenção»), e, em particular, prosseguindo os seus objetivos reconhecidos de promover os fins
da justiça e a reinserção social das pessoas condenadas;
Conscientes de que muitos Estados não podem extraditar os seus próprios nacionais;
Considerando desejável suplementar a Convenção em certos aspetos;
acordaram no seguinte:
Artigo 1.º
Disposições gerais
1 — As palavras e expressões usadas neste Protocolo devem ser interpretadas de acordo
com o significado da Convenção.
2 — As disposições da Convenção aplicar-se-ão na medida em que sejam compatíveis com
as disposições do presente Protocolo.
Artigo 2.º
Pessoas que fugiram do Estado de condenação
1 — Quando um nacional de uma Parte, que é sujeito a uma pena imposta no território de
outra Parte, como parte de uma decisão final, procura evitar a execução ou posterior execução
da sentença no Estado da condenação, fugindo para o território de outra Parte, antes de ter

cumprido a pena, o Estado da condenação poderá solicitar à outra Parte que assuma a execu-
ção da sentença.
2 — A pedido do Estado da condenação, o Estado da execução poderá, antes da che-
gada dos documentos de apoio ao pedido, ou antes da decisão sobre esse pedido, deter a
pessoa condenada ou tomar qualquer outra medida para assegurar que a pessoa condenada
permanece no seu território, enquanto aguarda uma decisão sobre o pedido. Os pedidos de
medidas provisórias devem incluir as informações mencionadas no parágrafo 3 do artigo 4.º da
Convenção. A detenção da pessoa condenada em razão deste parágrafo não poderá agravar
a sua situação penal.
3 — A transferência da execução da sentença não necessita do consentimento da pessoa
condenada.
Artigo 3.º
Pessoas condenadas sujeitas a uma ordem de expulsão ou de deportação
1 — A pedido do Estado da condenação, o Estado da execução poderá, sujeito às disposições
deste artigo, concordar com a transferência de uma pessoa condenada sem o consentimento dessa
pessoa, quando a sentença proferida contra si, ou uma decisão administrativa consequente a essa
sentença, inclui uma ordem de expulsão ou de deportação ou qualquer outra medida em resultado
da qual essa pessoa deixará de poder permanecer no território do Estado da condenação logo
que seja libertada.
2 — O Estado da execução não dará o seu consentimento para os fins do parágrafo 1 antes
de ter tido em consideração a opinião da pessoa condenada.
3 — Para os fins da aplicação deste artigo, o Estado da condenação deverá fornecer ao Es-
tado da execução:
a) Uma declaração contendo a opinião da pessoa condenada quanto à sua proposta de
transferência; e
b) Uma cópia da ordem de expulsão ou de deportação ou qualquer outra ordem que tenha
como efeito que a pessoa condenada não poderá mais permanecer no território do Estado da
condenação logo que seja libertada.
4 — Qualquer pessoa transferida de acordo com as disposições deste artigo não poderá ser
julgada, condenada ou detida tendo em vista a execução de uma sentença ou ordem de prisão,
por qualquer infração cometida antes de sua transferência, a não ser aquela pela qual a sentença
de execução foi imposta, nem por qualquer outra razão ser restringida na sua liberdade pessoal,
exceto nos seguintes casos:
a) Quando o Estado da condenação assim o autorizar: deverá ser apresentado um pedido
de autorização, acompanhado de todos os documentos relevantes e um registo legal de qualquer
declaração feita pela pessoa condenada; a autorização será concedida quando a infração para a
qual é solicitada estiver sujeita a extradição ao abrigo da lei do Estado da condenação ou quando
a extradição só seja excluída em razão do montante da pena;
b) Quando a pessoa condenada, tendo tido a oportunidade de deixar o território do Estado da
execução, não o fez no prazo de 45 dias após a sua libertação definitiva, ou se regressou a esse
território depois de o ter deixado.
5 — Não obstante as disposições do parágrafo 4, o Estado da execução poderá tomar as
medidas necessárias, de acordo com a sua legislação, inclusive os procedimentos in absentia,
para impedir quaisquer efeitos legais decorrentes do prazo da prescrição.
6 — Qualquer Estado contratante poderá, por meio de uma declaração dirigida ao Secretário-
-Geral do Conselho da Europa, indicar que não assumirá a execução das sentenças nas circuns-
tâncias descritas neste artigo.

Artigo 4.º
Assinatura e entrada em vigor
1 — O presente Protocolo estará aberto à assinatura dos Estados-Membros do Conselho da Europa
e dos outros Estados signatários da Convenção. Está sujeita a ratificação, aceitação ou aprovação. Um
Signatário não poderá ratificar, aceitar ou aprovar este Protocolo, a menos que tenha previamente ou
simultaneamente ratificado, aceite ou aprovado a Convenção. Os instrumentos de ratificação, aceitação
ou aprovação serão depositados junto do Secretário-Geral do Conselho da Europa.
2 — O presente Protocolo entrará em vigor no primeiro dia do mês seguinte ao termo de um
período de três meses após o depósito do terceiro instrumento de ratificação, aceitação ou aprovação.
3 — Em relação a qualquer Estado signatário que subsequentemente deposite o seu instru-
mento de ratificação, aceitação ou aprovação, o Protocolo entrará em vigor no primeiro dia do mês
seguinte ao termo de um período de três meses após a data do depósito.
Artigo 5.º
Adesão
1 — Qualquer Estado não membro que tenha aderido à Convenção pode aderir ao presente
Protocolo após a sua entrada em vigor.
2 — Em relação a qualquer Estado aderente, o Protocolo entrará em vigor no 1.º dia do mês
seguinte ao termo de um período de três meses após a data do depósito do instrumento de adesão.
Artigo 6.º
Aplicação territorial
1 — Qualquer Estado poderá, no momento da assinatura ou do depósito do seu instrumento
de ratificação, aceitação, aprovação ou adesão, especificar o território ou territórios aos quais o
presente Protocolo se aplicará.
2 — Qualquer Estado Contratante poderá, em qualquer data posterior, mediante declaração
dirigida ao Secretário-Geral do Conselho da Europa, prorrogar a aplicação deste Protocolo a qual-
quer outro território especificado na declaração. Em relação a esse território, o Protocolo entrará
em vigor no primeiro dia do mês seguinte ao termo de um período de três meses após a data de
receção da declaração pelo Secretário-Geral.
3 — Qualquer declaração feita de acordo com os dois parágrafos anteriores poderá, em
relação a qualquer território especificado nessa declaração, ser retirada através de uma no-
tificação dirigida ao Secretário-Geral. A retirada entrará em vigor no 1.º dia do mês seguinte
ao termo de um período de três meses após a data de receção da notificação pelo Secretário-
-Geral.
Artigo 7.º
Aplicação temporal
O presente protocolo é aplicável à execução de sentenças impostas antes ou depois da sua
entrada em vigor.
Artigo 8.º
Denúncia
1 — Qualquer Estado Contratante pode, a qualquer momento, denunciar o presente Protocolo
através de notificação dirigida ao Secretário-Geral do Conselho da Europa.
2 — Essa denúncia entrará em vigor no primeiro dia do mês seguinte ao termo de um período
de três meses após a data de receção da notificação pelo Secretário-Geral.

3 — O presente Protocolo continuará, contudo, a ser aplicado à execução de sentenças de
pessoas que tenham sido transferidas em conformidade com as disposições tanto da Convenção
como do presente Protocolo antes da data em que tal denúncia produza efeito.
4 — A denúncia da Convenção implica automaticamente a denúncia deste Protocolo.
Artigo 9.º
Notificações
O Secretário-Geral do Conselho da Europa notificará os Estados-Membros do Conselho da
Europa, qualquer Signatário, qualquer Parte e qualquer outro Estado que tenha sido convidado a
aderir à Convenção:
a) De qualquer assinatura;
b) Do depósito de qualquer instrumento de ratificação, aceitação, aprovação ou adesão;
c) De qualquer data de entrada em vigor do presente Protocolo, em conformidade com os
artigos 4.º ou 5.º;
d) De qualquer outro ato, declaração, notificação ou comunicação relativa ao presente protocolo.
Em fé de que os abaixo assinados, devidamente autorizados para o efeito, assinaram o pre-
sente Protocolo.
Feito em Estrasburgo, a 18 de dezembro de 1997, em inglês e francês, ambos os textos fazendo
igualmente fé, num único exemplar, que será depositado nos arquivos do Conselho da Europa.
O Secretário-Geral do Conselho da Europa enviará cópias autenticadas a cada um dos Estados-
-Membros do Conselho da Europa, aos outros Estados signatários da Convenção e a qualquer
Estado convidado a aderir à Convenção.
