Sumário: Aprova o Ato de Genebra e o Regulamento Comum do Acordo de Lisboa Relativo às
Denominações de Origem e às Indicações Geográficas.
O Ato de Genebra do Acordo de Lisboa Relativo às Denominações de Origem e às Indicações
Geográficas, adotado em 20 de maio de 2015, em Genebra, e o Regulamento Comum do Acordo
de Lisboa Relativo à Proteção das Denominações de Origem e ao Seu Registo Internacional e
do Ato de Genebra do Acordo de Lisboa Relativo às Denominações de Origem e às Indicações
Geográficas, adotado em 16 de junho de 2022, em Genebra, traduzem a mais recente revisão do
Acordo de Lisboa Relativo às Denominações de Origem.
O Ato de Genebra veio modernizar e aperfeiçoar o sistema do registo internacional consagrado
no Acordo de Lisboa. Juntos, o Ato e o Acordo, formam o Sistema de Lisboa, que estende a sua
proteção também às indicações geográficas, assegurando uma proteção internacional mais completa
e eficaz aos nomes dos produtos com qualidade de origem e que beneficia tanto os produtores que
desejem ver a sua proteção jurídica reforçada, como os consumidores, que pretendam garantias
sobre a qualidade, autenticidade, origem e percurso produtivo dos produtos que consomem.
Portugal, no exercício contínuo da tradição histórica que o caracteriza, tem sempre participado
de forma ativa na defesa das denominações de origem e das indicações geográficas.
Assim:
Nos termos da alínea c) do n.º 1 do artigo 197.º da Constituição, o Governo aprova o Ato de
Genebra do Acordo de Lisboa Relativo às Denominações de Origem e às Indicações Geográficas,
adotado em 20 de maio de 2015, em Genebra, e o Regulamento Comum do Acordo de Lisboa Rela-
tivo à Proteção das Denominações de Origem e ao Seu Registo Internacional e do Ato de Genebra
do Acordo de Lisboa Relativo às Denominações de Origem e às Indicações Geográficas, adotado
em 16 de junho de 2022, em Genebra, cujas versões autênticas em língua inglesa e respetivas
traduções para língua portuguesa se publicam em anexo.

CHAPTER I
Introductory and General Provisions
Article 1
Abbreviated Expressions
For the purposes of this Act, unless expressly stated otherwise:
(i) ‘Lisbon Agreement’ means the Lisbon Agreement for the Protection of Appellations of Origin
and their International Registration of October 31, 1958;
(ii) ‘1967 Act’ means the Lisbon Agreement as revised at Stockholm on July 14, 1967, and
amended on September 28, 1979;
(iii) ‘This Act’ means the Lisbon Agreement on Appellations of Origin and Geographical Indica-
tions, as established by the present Act;
(iv) ‘Regulations’ means the Regulations as referred to in article 25;
(v) ‘Paris Convention’ means the Paris Convention for the Protection of Industrial Property of
March 20, 1883, as revised and amended;

(vi) ‘Appellation of origin’ means a denomination as referred to in article 2(1)(i);
(vii) ‘Geographical indication’ means an indication as referred to in article 2(1)(ii);
(viii) ‘International Register’ means the International Register maintained by the International
Bureau in accordance with article 4 as the official collection of data concerning international regis-
trations of appellations of origin and geographical indications, regardless of the medium in which
such data are maintained;
(ix) ‘International registration’ means an international registration recorded in the International
Register;
(x) ‘Application’ means an application for international registration;
(xi) ‘Registered’ means entered in the International Register in accordance with this Act;
(xii) ‘Geographical area of origin’ means a geographical area as referred to in article 2(2);
(xiii) ‘Trans-border geographical area’ means a geographical area situated in, or covering,
adjacent Contracting Parties;
(xiv) ‘Contracting Party’ means any State or intergovernmental organization party to this Act;
(xv) ‘Contracting Party of Origin’ means the Contracting Party where the geographical area of
origin is situated or the Contracting Parties where the trans-border geographical area of origin is
situated;
(xvi) ‘Competent Authority’ means an entity designated in accordance with article 3;
(xvii) ‘Beneficiaries’ means the natural persons or legal entities entitled under the law of the
Contracting Party of Origin to use an appellation of origin or a geographical indication;
(xviii) ‘Intergovernmental organization’ means an intergovernmental organization eligible to
become party to this Act in accordance with article 28(1)(iii);
(xix) ‘Organization’ means the World Intellectual Property Organization;
(xx) ‘Director General’ means the Director General of the Organization;
(xxi) ‘International Bureau’ means the International Bureau of the Organization.
Article 2
Subject-Matter
(1) [Appellations of Origin and Geographical Indications] This Act applies in respect of:
(i) Any denomination protected in the Contracting Party of Origin consisting of or containing the
name of a geographical area, or another denomination known as referring to such area, which serves
to designate a good as originating in that geographical area, where the quality or characteristics of
the good are due exclusively or essentially to the geographical environment, including natural and
human factors, and which has given the good its reputation; as well as
(ii) Any indication protected in the Contracting Party of Origin consisting of or containing the
name of a geographical area, or another indication known as referring to such area, which identifies
a good as originating in that geographical area, where a given quality, reputation or other charac-
teristic of the good is essentially attributable to its geographical origin.
(2) [Possible Geographical Areas of Origin] A geographical area of origin as described in para-
graph (1) may consist of the entire territory of the Contracting Party of Origin or a region, locality or
place in the Contracting Party of Origin. This does not exclude the application of this Act in respect
of a geographical area of origin, as described in paragraph (1), consisting of a trans-border geo-
graphical area, or a part thereof.
Article 3
Competent Authority
Each Contracting Party shall designate an entity which shall be responsible for the administration
of this Act in its territory and for communications with the International Bureau under this Act and
the Regulations. The Contracting Party shall notify the name and contact details of such Competent
Authority to the International Bureau, as specified in the Regulations.

Article 4
International Register
The International Bureau shall maintain an International Register recording international regis-
trations effected under this Act, under the Lisbon Agreement and the 1967 Act, or under both, and
data relating to such international registrations.
CHAPTER II
Application and International Registration
Article 5
Application
(1) [Place of Filing] Applications shall be filed with the International Bureau.
(2) [Application Filed by Competent Authority] Subject to paragraph (3), the application for the
international registration of an appellation of origin or a geographical indication shall be filed by the
Competent Authority in the name of:
(i) The beneficiaries; or
(ii) A natural person or legal entity having legal standing under the law of the Contracting Party
of Origin to assert the rights of the beneficiaries or other rights in the appellation of origin or geo-
graphical indication.
(3) [Application Filed Directly] (a) Without prejudice to paragraph (4), if the legislation of the
Contracting Party of Origin so permits, the application may be filed by the beneficiaries or by a
natural person or legal entity referred to in paragraph (2)(ii).
(b) Subparagraph (a) applies subject to a declaration from the Contracting Party that its legis-
lation so permits. Such declaration may be made by the Contracting Party at the time of deposit of
its instrument of ratification or accession or at any later time. Where the declaration is made at the
time of the deposit of its instrument of ratification or accession, it shall take effect upon the entry into
force of this Act with respect to that Contracting Party. Where the declaration is made after the entry
into force of this Act with respect to the Contracting Party, it shall take effect three months after the
date on which the Director General has received the declaration.
(4) [Possible Joint Application in the Case of a Trans-border Geographical Area] In case of a
geographical area of origin consisting of a trans-border geographical area, the adjacent Contract-
ing Parties may, in accordance with their agreement, file an application jointly through a commonly
designated Competent Authority.
(5) [Mandatory Contents] The Regulations shall specify the mandatory particulars that must be
included in the application, in addition to those specified in article 6(3).
(6) [Optional Contents] The Regulations may specify the optional particulars that may be
included in the application.
Article 6
International Registration
(1) [Formal Examination by the International Bureau] Upon receipt of an application for the
international registration of an appellation of origin or a geographical indication in due form, as
specified in the Regulations, the International Bureau shall register the appellation of origin, or the
geographical indication, in the International Register.
(2) [Date of International Registration] Subject to paragraph (3), the date of the international
registration shall be the date on which the application was received by the International Bureau.

(3) [Date of International Registration Where Particulars Missing] Where the application does
not contain all the following particulars:
(i) The identification of the Competent Authority or, in the case of article 5(3), the applicant or
applicants;
(ii) The details identifying the beneficiaries and, where applicable, the natural person or legal
entity referred to in article 5(2)(ii);
(iii) The appellation of origin, or the geographical indication, for which international registration
is sought;
(iv) The good or goods to which the appellation of origin, or the geographical indication,
applies;
the date of the international registration shall be the date on which the last of the missing particulars
is received by the International Bureau.
(4) [Publication and Notification of International Registrations] The International Bureau shall,
without delay, publish each international registration and notify the Competent Authority of each
Contracting Party of the international registration.
(5) [Date of Effect of International Registration] (a) Subject to subparagraph (b), a registered
appellation of origin or geographical indication shall, in each Contracting Party that has not refused
protection in accordance with article 15, or that has sent to the International Bureau a notification
of grant of protection in accordance with article 18, be protected from the date of the international
registration.
(b) A Contracting Party may, in a declaration, notify the Director General that, in accordance
with its national or regional legislation, a registered appellation of origin or geographical indication
is protected from a date that is mentioned in the declaration, which date shall however not be later
than the date of expiry of the time limit for refusal specified in the Regulations in accordance with
article 15(1)(a).
Article 7
Fees
(1) [International Registration Fee] International registration of each appellation of origin,
and each geographical indication, shall be subject to payment of the fee specified in the Regu-
lations.
(2) [Fees for Other Entries in the International Register] The Regulations shall specify the fees
to be paid in respect of other entries in the International Register and for the supply of extracts,
attestations, or other information concerning the contents of the international registration.
(3) [Fee Reductions] Reduced fees shall be established by the Assembly in respect of certain
international registrations of appellations of origin, and in respect of certain international registrations
of geographical indications, in particular those in respect of which the Contracting Party of Origin is
a developing country or a least-developed country.
(4) [Individual Fee] (a) Any Contracting Party may, in a declaration, notify the Director General
that the protection resulting from international registration shall extend to it only if a fee is paid to
cover its cost of substantive examination of the international registration. The amount of such indi-
vidual fee shall be indicated in the declaration and can be changed in further declarations. The said
amount may not be higher than the equivalent of the amount required under the national or regional
legislation of the Contracting Party diminished by the savings resulting from the international pro-
cedure. Additionally, the Contracting Party may, in a declaration, notify the Director General that it
requires an administrative fee relating to the use by the beneficiaries of the appellation of origin or
the geographical indication in that Contracting Party.
(b) Non-payment of an individual fee shall, in accordance with the Regulations, have the effect
that protection is renounced in respect of the Contracting Party requiring the fee.

Article 8
Period of Validity of International Registrations
(1) [Dependency] International registrations shall be valid indefinitely, on the understanding
that the protection of a registered appellation of origin or geographical indication shall no longer be
required if the denomination constituting the appellation of origin, or the indication constituting the
geographical indication, is no longer protected in the Contracting Party of Origin.
(2) [Cancellation] (a) The Competent Authority of the Contracting Party of Origin, or, in the case
of article 5(3), the beneficiaries or the natural person or legal entity referred to in article 5(2)(ii) or
the Competent Authority of the Contracting Party of Origin, may at any time request the International
Bureau to cancel the international registration concerned.
(b) In case the denomination constituting a registered appellation of origin, or the indication
constituting a registered geographical indication, is no longer protected in the Contracting Party of
Origin, the Competent Authority of the Contracting Party of Origin shall request cancellation of the
international registration.
CHAPTER III
Protection
Article 9
Commitment to Protect
Each Contracting Party shall protect registered appellations of origin and geographical indica-
tions on its territory, within its own legal system and practice but in accordance with the terms of this
Act, subject to any refusal, renunciation, invalidation or cancellation that may become effective with
respect to its territory, and on the understanding that Contracting Parties that do not distinguish in
their national or regional legislation as between appellations of origin and geographical indications
shall not be required to introduce such a distinction into their national or regional legislation.
Article 10
Protection Under Laws of Contracting Parties or Other Instruments
(1) [Form of Legal Protection] Each Contracting Party shall be free to choose the type of legis-
lation under which it establishes the protection stipulated in this Act, provided that such legislation
meets the substantive requirements of this Act.
(2) [Protection Under Other Instruments] The provisions of this Act shall not in any way affect
any other protection a Contracting Party may accord in respect of registered appellations of origin
or registered geographical indications under its national or regional legislation, or under other inter-
national instruments.
(3) [Relation to Other Instruments] Nothing in this Act shall derogate from any obligations that
Contracting Parties have to each other under any other international instruments, nor shall it preju-
dice any rights that a Contracting Party has under any other international instruments.
Article 11
Protection in Respect of Registered Appellations of Origin and Geographical Indications
(1) [Content of Protection] Subject to the provisions of this Act, in respect of a registered
appellation of origin or a registered geographical indication, each Contracting Party shall provide
the legal means to prevent:
(a) Use of the appellation of origin or the geographical indication:
(i) In respect of goods of the same kind as those to which the appellation of origin or the geogra-
phical indication applies, not originating in the geographical area of origin or not complying with any
other applicable requirements for using the appellation of origin or the geographical indication;

(ii) In respect of goods that are not of the same kind as those to which the appellation of origin
or geographical indication applies or services, if such use would indicate or suggest a connection
between those goods or services and the beneficiaries of the appellation of origin or the geographi-
cal indication, and would be likely to damage their interests, or, where applicable, because of the
reputation of the appellation of origin or geographical indication in the Contracting Party concerned,
such use would be likely to impair or dilute in an unfair manner, or take unfair advantage of, that
reputation;
(b) Any other practice liable to mislead consumers as to the true origin, provenance or nature
of the goods.
(2) [Content of Protection in Respect of Certain Uses] Paragraph (1)(a) shall also apply to use
of the appellation of origin or geographical indication amounting to its imitation, even if the true ori-
gin of the goods is indicated, or if the appellation of origin or the geographical indication is used in
translated form or is accompanied by terms such as ‘style’, ‘kind’, ‘type’, ‘make’, ‘imitation’, ‘method’,
‘as produced in’, ‘like’, ‘similar’ or the like (1).
(3) [Use in a Trademark] Without prejudice to article 13(1), a Contracting Party shall, ex officio
if its legislation so permits or at the request of an interested party, refuse or invalidate the registra-
tion of a later trademark if use of the trademark would result in one of the situations covered by
paragraph (1).
Article 12
Protection Against Becoming Generic
Subject to the provisions of this Act, registered appellations of origin and registered geographical
indications cannot be considered to have become generic (2) in a Contracting Party.
Article 13
Safeguards in Respect of Other Rights
(1) [Prior Trademark Rights] The provisions of this Act shall not prejudice a prior trademark
applied for or registered in good faith, or acquired through use in good faith, in a Contracting Party.
Where the law of a Contracting Party provides a limited exception to the rights conferred by a tra-
demark to the effect that such a prior trademark in certain circumstances may not entitle its owner
to prevent a registered appellation of origin or geographical indication from being granted protection
or used in that Contracting Party, protection of the registered appellation of origin or geographical
indication shall not limit the rights conferred by that trademark in any other way.
(2) [Personal Name Used in Business] The provisions of this Act shall not prejudice the right of
any person to use, in the course of trade, that person’s name or the name of that person’s predeces-
sor in business, except where such name is used in such a manner as to mislead the public.
(3) [Rights Based on a Plant Variety or Animal Breed Denomination] The provisions of this Act
shall not prejudice the right of any person to use a plant variety or animal breed denomination in
the course of trade, except where such plant variety or animal breed denomination is used in such
a manner as to mislead the public.
(4) [Safeguards in the Case of Notification of Withdrawal of Refusal or a Grant of Protection]
Where a Contracting Party that has refused the effects of an international registration under article
15 on the ground of use under a prior trademark or other right, as referred to in this article, notifies
the withdrawal of that refusal under article 16 or a grant of protection under article 18, the result-
ing protection of the appellation of origin or geographical indication shall not prejudice that right or
its use, unless the protection was granted following the cancellation, non-renewal, revocation or
invalidation of the right.

Article 14
Enforcement Procedures and Remedies
Each Contracting Party shall make available effective legal remedies for the protection of
registered appellations of origin and registered geographical indications and provide that legal
proceedings for ensuring their protection may be brought by a public authority or by any interested
party, whether a natural person or a legal entity and whether public or private, depending on its
legal system and practice.
CHAPTER IV
Refusal and Other Actions in Respect of International Registrations
Article 15
Refusal
(1) [Refusal of Effects of International Registration] (a) Within the time limit specified in the
Regulations, the Competent Authority of a Contracting Party may notify the International Bureau
of the refusal of the effects of an international registration in its territory. The notification of refusal
may be made by the Competent Authority ex officio, if its legislation so permits, or at the request of
an interested party.
(b) The notification of refusal shall set out the grounds on which the refusal is based.
(2) [Protection Under Other Instruments] The notification of a refusal shall not be detrimental
to any other protection that may be available, in accordance with article 10(2), to the denomination
or indication concerned in the Contracting Party to which the refusal relates.
(3) [Obligation to Provide Opportunity for Interested Parties] Each Contracting Party shall
provide a reasonable opportunity, for anyone whose interests would be affected by an international
registration, to request the Competent Authority to notify a refusal in respect of the international
registration.
(4) [Registration, Publication and Communication of Refusals] The International Bureau shall
record the refusal and the grounds for the refusal in the International Register. It shall publish the
refusal and the grounds for the refusal and shall communicate the notification of refusal to the Com-
petent Authority of the Contracting Party of Origin or, where the application has been filed directly
in accordance with article 5(3), the beneficiaries or the natural person or legal entity referred to in
article 5(2)(ii) as well as the Competent Authority of the Contracting Party of Origin.
(5) [National Treatment] Each Contracting Party shall make available to interested parties affected
by a refusal the same judicial and administrative remedies that are available to its own nationals in
respect of the refusal of protection for an appellation of origin or a geographical indication.
Article 16
Withdrawal of Refusal
A refusal may be withdrawn in accordance with the procedures specified in the Regulations.
A withdrawal shall be recorded in the International Register.
Article 17
Transitional Period
(1) [Option to Grant Transitional Period] Without prejudice to article 13, where a Contracting
Party has not refused the effects of an international registration on the ground of prior use by a third
party or has withdrawn such refusal or has notified a grant of protection, it may, if its legislation so
permits, grant a defined period as specified in the Regulations, for terminating such use.

(2) [Notification of a Transitional Period] The Contracting Party shall notify the International
Bureau of any such period, in accordance with the procedures specified in the Regulations.
Article 18
Notification of Grant of Protection
The Competent Authority of a Contracting Party may notify the International Bureau of the grant
of protection to a registered appellation of origin or geographical indication. The International Bureau
shall record any such notification in the International Register and publish it.
Article 19
Invalidation
(1) [Opportunity to Defend Rights] Invalidation of the effects, in part or in whole, of an interna-
tional registration in the territory of a Contracting Party may be pronounced only after having given
the beneficiaries an opportunity to defend their rights. Such opportunity shall also be given to the
natural person or legal entity referred to in article 5(2)(ii).
(2) [Notification, Recordal and Publication] The Contracting Party shall notify the invalidation of
the effects of an international registration to the International Bureau, which shall record the invalida-
tion in the International Register and publish it.
(3) [Protection Under Other Instruments] Invalidation shall not be detrimental to any other
protection that may be available, in accordance with article 10(2), to the denomination or indication
concerned in the Contracting Party that invalidated the effects of the international registration.
Article 20
Modifications and Other Entries in the International Register
Procedures for the modification of international registrations and other entries in the International
Register shall be specified in the Regulations.
CHAPTER V
Administrative Provisions
Article 21
Membership of the Lisbon Union
The Contracting Parties shall be members of the same Special Union as the States party to
the Lisbon Agreement or the 1967 Act, whether or not they are party to the Lisbon Agreement or
the 1967 Act.
Article 22
Assembly of the Special Union
(1) [Composition] (a) The Contracting Parties shall be members of the same Assembly as the
States party to the 1967 Act.
(b) Each Contracting Party shall be represented by one delegate, who may be assisted by
alternate delegates, advisors and experts.
(c) Each delegation shall bear its own expenses.

(2) [Tasks] (a) The Assembly shall:
(i) Deal with all matters concerning the maintenance and development of the Special Union
and the implementation of this Act;
(ii) Give directions to the Director General concerning the preparation of revision conferences
referred to in article 26(1), due account being taken of any comments made by those members of
the Special Union which have not ratified or acceded to this Act;
(iii) Amend the Regulations;
(iv) Review and approve the reports and activities of the Director General concerning the Special
Union, and give him or her all necessary instructions concerning matters within the competence of
the Special Union;
(v) Determine the program and adopt the biennial budget of the Special Union, and approve
its final accounts;
(vi) Adopt the financial Regulations of the Special Union;
(vii) Establish such committees and working groups as it deems appropriate to achieve the
objectives of the Special Union;
(viii) Determine which States, intergovernmental and non-governmental organizations shall be
admitted to its meetings as observers;
(ix) Adopt amendments to articles 22 to 24 and 27;
(x) Take any other appropriate action to further the objectives of the Special Union and perform
any other functions as are appropriate under this Act.
(b) With respect to matters which are of interest also to other Unions administered by the Orga-
nization, the Assembly shall make its decisions after having heard the advice of the Coordination
Committee of the Organization.
(3) [Quorum] (a) One-half of the members of the Assembly which have the right to vote on a
given matter shall constitute a quorum for the purposes of the vote on that matter.
(b) Notwithstanding the provisions of subparagraph (a), if, in any session, the number of
the members of the Assembly which are States, have the right to vote on a given matter and
are represented is less than one-half but equal to or more than one-third of the members of the
Assembly which are States and have the right to vote on that matter, the Assembly may make
decisions but, with the exception of decisions concerning its own procedure, all such decisions
shall take effect only if the conditions set forth hereinafter are fulfilled. The International Bureau
shall communicate the said decisions to the members of the Assembly which are States, have
the right to vote on the said matter and were not represented and shall invite them to express in
writing their vote or abstention within a period of three months from the date of the communica-
tion. If, at the expiration of this period, the number of such members having thus expressed their
vote or abstention attains the number of the members which was lacking for attaining the quorum
in the session itself, such decisions shall take effect provided that at the same time the required
majority still obtains.
(4) [Taking Decisions in the Assembly] (a) The Assembly shall endeavor to take its decisions
by consensus.
(b) Where a decision cannot be arrived at by consensus, the matter at issue shall be decided
by voting. In such a case:
(i) Each Contracting Party that is a State shall have one vote and shall vote only in its own
name; and
(ii) Any Contracting Party that is an intergovernmental organization may vote, in place of its
member States, with a number of votes equal to the number of its member States which are party
to this Act. No such intergovernmental organization shall participate in the vote if any one of its
member States exercises its right to vote, and vice versa.

(c) On matters concerning only States that are bound by the 1967 Act, Contracting Parties that
are not bound by the 1967 Act shall not have the right to vote, whereas, on matters concerning only
Contracting Parties, only the latter shall have the right to vote.
(5) [Majorities] (a) Subject to articles 25(2) and 27(2), the decisions of the Assembly shall require
two-thirds of the votes cast.
(b) Abstentions shall not be considered as votes.
(6) [Sessions] (a) The Assembly shall meet upon convocation by the Director General and, in
the absence of exceptional circumstances, during the same period and at the same place as the
General Assembly of the Organization.
(b) The Assembly shall meet in extraordinary session upon convocation by the Director General,
either at the request of one-fourth of the members of the Assembly or on the Director General’s
own initiative.
(c) The agenda of each session shall be prepared by the Director General.
(7) [Rules of Procedure] The Assembly shall adopt its own rules of procedure.
Article 23
International Bureau
(1) [Administrative Tasks] (a) International registration and related duties, as well as all other admi-
nistrative tasks concerning the Special Union, shall be performed by the International Bureau.
(b) In particular, the International Bureau shall prepare the meetings and provide the Secre-
tariat of the Assembly and of such committees and working groups as may have been established
by the Assembly.
(c) The Director General shall be the Chief Executive of the Special Union and shall represent
the Special Union.
(2) [Role of the International Bureau in the Assembly and Other Meetings] The Director
General and any staff member designated by him shall participate, without the right to vote, in
all meetings of the Assembly, the committees and working groups established by the Assembly.
The Director General, or a staff member designated by him, shall be ex officio Secretary of
such a body.
(3) [Conferences] (a) The International Bureau shall, in accordance with the directions of the
Assembly, make the preparations for any revision conferences.
(b) The International Bureau may consult with intergovernmental and international and national
non-governmental organizations concerning the said preparations.
(c) The Director General and persons designated by him shall take part, without the right to
vote, in the discussions at revision conferences.
(4) [Other Tasks] The International Bureau shall carry out any other tasks assigned to it in
relation to this Act.
Article 24
Finances
(1) [Budget] The income and expenses of the Special Union shall be reflected in the budget of
the Organization in a fair and transparent manner.
(2) [Sources of Financing of the Budget] The income of the Special Union shall be derived from
the following sources:
(i) Fees collected under article 7(1) and (2);
(ii) Proceeds from the sale of, or royalties on, the publications of the International Bureau;
(iii) Gifts, bequests, and subventions;
(iv) Rent, investment revenue, and other, including miscellaneous, income;

(v) Special contributions of the Contracting Parties or any alternative source derived from the
Contracting Parties or beneficiaries, or both, if and to the extent to which receipts from the sources
indicated in items (i) to (iv) do not suffice to cover the expenses, as decided by the Assembly.
(3) [Fixing of Fees; Level of the Budget] (a) The amounts of the fees referred to in paragraph (2)
shall be fixed by the Assembly on the proposal of the Director General and shall be so fixed that,
together with the income derived from other sources under paragraph (2), the revenue of the Special
Union should, under normal circumstances, be sufficient to cover the expenses of the International
Bureau for maintaining the international registration service.
(b) If the Program and Budget of the Organization is not adopted before the beginning of a new
financial period, the authorization to the Director General to incur obligations and make payments
shall be at the same level as it was in the previous financial period.
(4) [Establishing the Special Contributions Referred to in Paragraph (2)(v)] For the purpose of
establishing its contribution, each Contracting Party shall belong to the same class as it belongs to
in the context of the Paris Convention or, if it is not a Contracting Party of the Paris Convention, as
it would belong to if it were a Contracting Party of the Paris Convention. Intergovernmental organi-
zations shall be considered to belong to contribution class I (one), unless otherwise unanimously
decided by the Assembly. The contribution shall be partially weighted according to the number of
registrations originating in the Contracting Party, as decided by the Assembly.
(5) [Working Capital Fund] The Special Union shall have a working capital fund, which
shall be constituted by payments made by way of advance by each member of the Special
Union when the Special Union so decides. If the fund becomes insufficient, the Assembly may
decide to increase it. The proportion and the terms of payment shall be fixed by the Assembly
on the proposal of the Director General. Should the Special Union record a surplus of income
over expenditure in any financial period, the Working Capital Fund advances may be repaid
to each member proportionate to their initial payments upon proposal by the Director General
and decision by the Assembly.
(6) [Advances by Host State] (a) In the headquarters agreement concluded with the State on
the territory of which the Organization has its headquarters, it shall be provided that, whenever the
working capital fund is insufficient, such State shall grant advances. The amount of those advances
and the conditions on which they are granted shall be the subject of separate agreements, in each
case, between such State and the Organization.
(b) The State referred to in subparagraph (a) and the Organization shall each have the right
to denounce the obligation to grant advances, by written notification. Denunciation shall take effect
three years after the end of the year in which it has been notified.
(7) [Auditing of Accounts] The auditing of the accounts shall be effected by one or more of the
States members of the Special Union or by external auditors, as provided in the Financial Regula-
tions of the Organization. They shall be designated, with their agreement, by the Assembly.
Article 25
Regulations
(1) [Subject-Matter] The details for carrying out this Act shall be established in the Regulations.
(2) [Amendment of Certain Provisions of the Regulations] (a) The Assembly may decide that
certain provisions of the Regulations may be amended only by unanimity or only by a three-fourths
majority.
(b) In order for the requirement of unanimity or a three-fourths majority no longer to apply in the
future to the amendment of a provision of the Regulations, unanimity shall be required.
(c) In order for the requirement of unanimity or a three-fourths majority to apply in the future to
the amendment of a provision of the Regulations, a three-fourths majority shall be required.
(3) [Conflict Between This Act and the Regulations] In the case of conflict between the provi-
sions of this Act and those of the Regulations, the former shall prevail.

CHAPTER VI
Revision and Amendment
Article 26
Revision
(1) [Revision Conferences] This Act may be revised by Diplomatic Conferences of the Contrac-
ting Parties. The convocation of any Diplomatic Conference shall be decided by the Assembly.
(2) [Revision or Amendment of Certain articles] articles 22 to 24 and 27 may be amended either
by a revision conference or by the Assembly according to the provisions of article 27.
Article 27
Amendment of Certain articles by the Assembly
(1) [Proposals for Amendment] (a) Proposals for the amendment of articles 22 to 24, and the
present article, may be initiated by any Contracting Party or by the Director General.
(b) Such proposals shall be communicated by the Director General to the Contracting Parties
at least six months in advance of their consideration by the Assembly.
(2) [Majorities] Adoption of any amendment to the articles referred to in paragraph (1) shall
require a three-fourths majority, except that adoption of any amendment to article 22, and to the
present paragraph, shall require a four-fifths majority.
(3) [Entry into Force] (a) Except where subparagraph (b) applies, any amendment to the articles
referred to in paragraph (1) shall enter into force one month after written notifications of acceptance,
effected in accordance with their respective constitutional processes, have been received by the
Director General from three-fourths of those Contracting Parties which, at the time the amendment
was adopted, were members of the Assembly and had the right to vote on that amendment.
(b) Any amendment to article 22(3) or (4) or to this subparagraph shall not enter into force if,
within six months of its adoption by the Assembly, any Contracting Party notifies the Director General
that it does not accept such amendment.
(c) Any amendment which enters into force in accordance with the provisions of this paragraph
shall bind all the States and intergovernmental organizations which are Contracting Parties at the time
the amendment enters into force, or which become Contracting Parties at a subsequent date.
CHAPTER VII
Final Provisions
Article 28
Becoming Party to This Act
(1) [Eligibility] Subject to article 29 and paragraphs (2) and (3) of the present article:
(i) Any State which is party to the Paris Convention may sign and become party to this Act;
(ii) Any other State member of the Organization may sign and become party to this Act if it
declares that its legislation complies with the provisions of the Paris Convention concerning appel-
lations of origin, geographical indications and trademarks;
(iii) Any intergovernmental organization may sign and become party to this Act, provided that
at least one member State of that intergovernmental organization is party to the Paris Convention
and provided that the intergovernmental organization declares that it has been duly authorized, in
accordance with its internal procedures, to become party to this Act and that, under the constitut-
ing treaty of the intergovernmental organization, legislation applies under which regional titles of
protection can be obtained in respect of geographical indications.

(2) [Ratification or Accession] Any State or intergovernmental organization referred to in para-
graph (1) may deposit:
(i) An instrument of ratification, if it has signed this Act; or
(ii) An instrument of accession, if it has not signed this Act.
(3) [Effective Date of Deposit] (a) Subject to subparagraph (b), the effective date of the deposit
of an instrument of ratification or accession shall be the date on which that instrument is deposited.
(b) The effective date of the deposit of the instrument of ratification or accession of any State
that is a member State of an intergovernmental organization and in respect of which the protection
of appellations of origin or geographical indications can only be obtained on the basis of legislation
applying between the member States of the intergovernmental organization shall be the date on which
the instrument of ratification or accession of that intergovernmental organization is deposited, if that
date is later than the date on which the instrument of the said State has been deposited. However,
this subparagraph does not apply with regard to States that are party to the Lisbon Agreement or the
1967 Act and shall be without prejudice to the application of article 31 with regard to such States.
Article 29
Effective Date of Ratifications and Accessions
(1) [Instruments to Be Taken into Consideration] For the purposes of this article, only instru-
ments of ratification or accession that are deposited by States or intergovernmental organizations
referred to in article 28(1) and that have an effective date according to article 28(3) shall be taken
into consideration.
(2) [Entry into Force of This Act] This Act shall enter into force three months after five eligible
parties referred to in article 28 have deposited their instruments of ratification or accession.
(3) [Entry into Force of Ratifications and Accessions] (a) Any State or intergovernmental orga-
nization that has deposited its instrument of ratification or accession three months or more before
the date of entry into force of this Act shall become bound by this Act on the date of the entry into
force of this Act.
(b) Any other State or intergovernmental organization shall become bound by this Act three
months after the date on which it has deposited its instrument of ratification or accession or at any
later date indicated in that instrument.
(4) [International Registrations Effected Prior to Accession] In the territory of the acceding State
and, where the Contracting Party is an intergovernmental organization, the territory in which the
constituting treaty of that intergovernmental organization applies, the provisions of this Act shall apply
in respect of appellations of origin and geographical indications already registered under this Act at
the time the accession becomes effective, subject to article 7(4) as well as the provisions of Chapter
IV, which shall apply mutatis mutandis. The acceding State or intergovernmental organization may
also specify, in a declaration attached to its instrument of ratification or accession, an extension of
the time limit referred to in article 15(1), and the periods referred to in article 17, in accordance with
the procedures specified in the Regulations in that respect.
Article 30
Prohibition of Reservations
No reservations to this Act are permitted.
Article 31
Application of the Lisbon Agreement and the 1967 Act
(1) [Relations Between States Party to Both This Act and the Lisbon Agreement or the 1967
Act] This Act alone shall be applicable as regards the mutual relations of States party to both this

Act and the Lisbon Agreement or the 1967 Act. However, with regard to international registrations of
appellations of origin effective under the Lisbon Agreement or the 1967 Act, the States shall accord
no lower protection than is required by the Lisbon Agreement or the 1967 Act.
(2) [Relations Between States Party to Both This Act and the Lisbon Agreement or the 1967
Act and States Party to the Lisbon Agreement or the 1967 Act Without Being Party to This Act] Any
State party to both this Act and the Lisbon Agreement or the 1967 Act shall continue to apply the
Lisbon Agreement or the 1967 Act, as the case may be, in its relations with States party to the Lisbon
Agreement or the 1967 Act that are not party to this Act.
Article 32
Denunciation
(1) [Notification] Any Contracting Party may denounce this Act by notification addressed to the
Director General.
(2) [Effective Date] Denunciation shall take effect one year after the date on which the Direc-
tor General has received the notification or at any later date indicated in the notification. It shall
not affect the application of this Act to any application pending and any international registration
in force in respect of the denouncing Contracting Party at the time of the coming into effect of the
denunciation.
Article 33
Languages of this Act; Signature
(1) [Original Texts; Official Texts] (a) This Act shall be signed in a single original in the English,
Arabic, Chinese, French, Russian and Spanish languages, all texts being equally authentic.
(b) Official texts shall be established by the Director General, after consultation with the inter-
ested Governments, in such other languages as the Assembly may designate.
(2) [Time Limit for Signature] This Act shall remain open for signature at the headquarters of
the Organization for one year after its adoption.
Article 34
Depositary
The Director General shall be the depositary of this Act.
(1) Agreed Statement concerning article 11(2): For the purposes of this Act, it is understood that where certain elements
of the denomination or indication constituting the appellation of origin or geographical indication have a generic character in
the Contracting Party of Origin, their protection under this paragraph shall not be required in the other Contracting Parties.
For greater certainty, a refusal or invalidation of a trademark, or a finding of infringement, in the Contracting Parties under
the terms of article 11 cannot be based on the component that has a generic character.
(2) Agreed Statement concerning article 12: For the purposes of this Act, it is understood that article 12 is without
prejudice to the application of the provisions of this Act concerning prior use, as, prior to international registration, the
denomination or indication constituting the appellation of origin or geographical indication may already, in whole or in part,
be generic in a Contracting Party other than the Contracting Party of Origin, for example, because the denomination or
indication, or part of it, is identical with a term customary in common language as the common name of a good or service
in such Contracting Party, or is identical with the customary name of a grape variety in such Contracting Party.

CHAPTER I
Introductory and General Provisions
Rule 1
Definitions
(1) [Abbreviated Expressions] For the purposes of these Regulations, unless expressly stated
otherwise:
(i) “Geneva Act” means the Geneva Act of the Lisbon Agreement on Appellations of Origin and
Geographical Indications of May 20, 2015;
(ii) Abbreviated expressions which are used in these Regulations and are defined in articles 1
and 2(1) of the Geneva Act shall have the same meaning as in that Act;
(iii) Whenever the Lisbon Agreement for the Protection of Appellations of Origin and their Inter-
national Registration of October 31, 1958, is applicable rather than the 1967 Act, any reference to
the 1967 Act shall be understood to refer to the Lisbon Agreement of October 31, 1958;
(iv) “Rule” refers to a rule of these Regulations;
(v) “Administrative Instructions” means the Administrative Instructions referred to in Rule 24;
(vi) “Official Form” means a form drawn up by the International Bureau;
(vii) “Communication” means any application or any request, declaration, notification, invita-
tion or information relating to or accompanying an application or an international registration that

is addressed to a Competent Authority, the International Bureau, or, in the case of article 5(3) of
the Geneva Act, the beneficiaries or the natural person or legal entity referred to in article 5(2)(ii)
of that Act;
(viii) “Application governed by the 1967 Act” means an application that is filed under the 1967
Act where the mutual relations of the Contracting Parties involved are governed by the 1967 Act;
(ix) “Application governed by the Geneva Act” means an application that is filed under the
Geneva Act where the mutual relations of the Contracting Parties involved are governed by the
Geneva Act;
(x) “Refusal” means the declaration referred to in article 5(3) of the 1967 Act or in article 15 of
the Geneva Act.
(2) (1) [Correspondence Between Some Expressions Used in the 1967 Act and the Geneva
Act] For the purposes of these Regulations,
(i) Reference to “Contracting Party” shall be deemed, where appropriate, to include a reference
to “country” as referred to in the 1967 Act;
(ii) Reference to “Contracting Party of Origin” shall be deemed, where appropriate, to include
a reference to “country of origin” as referred to in the 1967 Act;
(iii) Reference to “publication” in Rule 19 shall be deemed, where appropriate, to include a
reference to a publication in the periodical referred to in article 5(2) of the 1967 Act, whatever the
medium used for its publication.
Rule 2
Calculation of Time Limits
(1) [Periods Expressed in Years] A period expressed in years shall expire in the subsequent
year on the same day and month as the day and month of the event from which the period starts
to run, except that, where the event occurred on February 29, the period shall expire on February
28 of the subsequent year.
(2) [Periods Expressed in Months] A period expressed in months shall expire in the relevant
subsequent month on the same day as the day of the event from which the period starts to run,
except that, where the relevant subsequent month has no day with the same number, the period
shall expire on the last day of that month.
(3) [Expiry on a Day Which Is Not a Working Day for the International Bureau or a Competent
Authority] If the period of a time limit applying to the International Bureau or a Competent Authority
expires on a day which is not a working day for the International Bureau or a Competent Authority,
the period shall, notwithstanding paragraphs (1) and (2), expire for the International Bureau or the
Competent Authority, as the case may be, on the first subsequent working day.
Rule 2bis
Excuse of Delay in Meeting Time Limits
(1) [Excuse in Delay in Meeting Time Limits due to Force Majeure Reasons] Failure by a Com-
petent Authority or, in the case of article 5(3) of the Geneva Act, beneficiaries or a natural person or
legal entity referred to in article 5(2)(ii) of that Act to meet a time limit specified in the Regulations to
perform an action before the International Bureau shall be excused if the Competent Authority or,
in the case of article 5(3) of the Geneva Act, the beneficiaries or the natural person or legal entity
referred to in article 5(2)(ii) of that Act submit evidence showing, to the satisfaction of the International
Bureau, that such failure was due to war, revolution, civil disorder, strike, natural calamity, irregularities
in postal, delivery or electronic communication services owing to circumstances beyond the control
of a Competent Authority or, in the case of article 5(3) of the Geneva Act, beneficiaries or a natural
person or legal entity referred to in article 5(2)(ii) of that Act or other force majeure reason.
(2) [Limitation on Excuse] Failure to meet a time limit shall be excused under this Rule only
if the evidence and action referred to in paragraph (1) are received by and performed before the

International Bureau as soon as reasonably possible and not later than six months after the expiry
of the time limit concerned.
Rule 3
Working Languages
(1) [Application] The application shall be in English, French or Spanish.
(2) [Communications Subsequent to the Application] Any communication concerning an appli-
cation or an international registration shall be in English, French or Spanish, at the choice of the
Competent Authority concerned or, in the case of article 5(3) of the Geneva Act, at the choice of the
beneficiaries or the natural person or legal entity referred to in article 5(2)(ii) of that Act. Any transla-
tion needed for the purposes of these procedures shall be made by the International Bureau.
(3) [Entries in the International Register and Publication] Entries in the International Register
and publication of such entries by the International Bureau shall be in English, French and Spanish.
The translations needed for those purposes shall be made by the International Bureau. However,
the International Bureau shall not translate the appellation of origin or the geographical indication.
(4) [Transliteration of the Appellation of Origin or Geographical Indication] Where the application
contains a transliteration of the appellation of origin or the geographical indication in accordance
with Rule 5(2)(b), the International Bureau shall not check whether the transliteration is correct.
(5) [Translations of the Appellation of Origin for Applications Governed by the 1967 Act] Where
an application governed by the 1967 Act contains one or more translations of the appellation of origin,
in accordance with Rule 5(6)(v), the International Bureau shall not check whether the translations
are correct.
Rule 4
Competent Authority
(1) [Notification to the International Bureau] Each Contracting Party shall notify the International
Bureau of the name and contact details of its Competent Authority, i.e. the authority it has desig-
nated to present applications and other communications to, and receive communications from, the
International Bureau.
(2) [One Authority or Different Authorities] The notification referred to in paragraph (1) shall,
preferably, indicate a single Competent Authority. When a Contracting Party notifies different Com-
petent Authorities, this notification shall clearly indicate their respective competence in respect of
the presentation of applications and other communications to, and the receipt of communications
from, the International Bureau.
(3) [Information on Applicable Procedures] The Competent Authority shall make available infor-
mation on the applicable procedures in its territory to challenge and enforce rights in appellations
of origin and geographical indications.
(4) [Modifications] Contracting Parties shall notify the International Bureau of any change in the
particulars referred to in paragraphs (1) and (3). However, the International Bureau may ex officio
take cognizance of a change in the absence of a notification where it has clear indications that such
a change has taken place.
CHAPTER II
Application and International Registration
Rule 5
Requirements Concerning the Application
(1) [Filing] The application shall be filed with the International Bureau on the Official Form
provided to that end and shall be signed by the Competent Authority presenting it or, in the case of

article 5(3) of the Geneva Act, the beneficiaries or the natural person or legal entity referred to in
article 5(2)(ii) of that Act.
(2) [Application — Mandatory Contents] (a) The application shall indicate:
(i) The Contracting Party of Origin;
(ii) The Competent Authority presenting the application or, in the case of article 5(3) of the
Geneva Act, contact details of the beneficiaries or of the natural person or legal entity referred to
in article 5(2)(ii) of that Act;
(iii) The beneficiaries, designated collectively or, where collective designation is not possible,
by name, or in the case of an application governed by the Geneva Act the natural person or legal
entity having legal standing under the law of the Contracting Party of Origin to assert the rights of
the beneficiaries or other rights in the appellation of origin or the geographical indication;
(iv) The appellation of origin or the geographical indication for which registration is sought, in
the official language of the Contracting Party of Origin or, where the Contracting Party of Origin
has more than one official language, in the official language or languages in which the appellation
of origin or the geographical indication is contained in the registration, act or decision, by virtue of
which protection is granted in the Contracting Party of Origin (2);
(v) The good or goods to which the appellation of origin, or the geographical indication, applies,
as precisely as possible;
(vi) The geographical area of production or the geographical area of origin of the good or
goods;
(vii) The identifying details of the registration, including its date and number if applicable, of
the legislative or administrative act, or of the judicial or administrative decision, by virtue of which
protection is granted to the appellation of origin, or to the geographical indication, in the Contracting
Party of Origin.
(b) If they are not in Latin characters, the application shall include a transliteration of the names
of the beneficiaries or the natural person or legal entity referred to in article 5(2)(ii) of the Geneva
Act, of the geographical area of production or the geographical area of origin, and of the appellation
of origin or the geographical indication for which registration is sought. The transliteration shall use
the phonetics of the language of the application (2).
(c) The application shall be accompanied by the registration fee and any other fees, as speci-
fied in Rule 8.
(3) [Application Governed by the Geneva Act — Particulars Concerning the Quality, Reputa-
tion or Characteristic(s)] (a) To the extent that a Contracting Party of the Geneva Act requires that,
for the protection of a registered appellation of origin or geographical indication in its territory, the
application governed by the Geneva Act further indicate particulars concerning, in the case of an
appellation of origin, the quality or characteristics of the good and its connection with the geographical
environment of the geographical area of production, and, in the case of a geographical indication,
the quality, reputation or other characteristic of the good and its connection with the geographical
area of origin, it shall notify that requirement to the Director General.
(b) In order to meet such a requirement, particulars as referred to in subparagraph (a) shall be
provided in a working language, but they shall not be translated by the International Bureau.
(c) An application that is not in accordance with a requirement as notified by a Contracting
Party under subparagraph (a) shall, subject to Rule 6, have the effect that protection is renounced
in respect of that Contracting Party.
(4) [Application Governed by the Geneva Act — Signature and/or Intention to Use] (a) To the
extent that a Contracting Party of the Geneva Act requires that for protection of a registered appel-
lation of origin or geographical indication the application governed by the Geneva Act be signed by
a person having legal standing to assert the rights conferred by such protection, it shall notify that
requirement to the Director General.
(b) To the extent that a Contracting Party requires that for protection of a registered appellation
of origin or geographical indication the application governed by the Geneva Act be accompanied
by a declaration of intention to use the registered appellation of origin or geographical indication in

its territory or a declaration of intention to exercise control over the use by others of the registered
appellation of origin or geographical indication in its territory, it shall notify that requirement to the
Director General.
(c) An application governed by the Geneva Act that is not signed in accordance with subpara-
graph (a), or that is not accompanied by a declaration indicated in subparagraph (b), shall, subject
to Rule 6, have the effect that protection is renounced in respect of the Contracting Party requiring
such signature or declaration, as notified under subparagraphs (a) and (b).
(5) [Application Governed by the Geneva Act — Protection Not Claimed for Certain Elements
of the Appellation of Origin or the Geographical Indication] The application governed by the Geneva
Act shall indicate whether or not, to the best knowledge of the applicant, the registration, the leg-
islative or administrative act, or the judicial or administrative decision, by virtue of which protection
is granted to the appellation of origin, or to the geographical indication, in the Contracting Party of
Origin, specifies that protection is not granted for certain elements of the appellation of origin or
the geographical indication. Any such elements shall be indicated in the application in a working
language and in the official language or languages of the Contracting Party of Origin referred to in
paragraph (2)(a)(iv), together with any transliteration referred to in paragraph (2)(b).
(6) [Application — Optional Contents] (a) The application may indicate or contain:
(i) The addresses of the beneficiaries or, in the case of an application governed by the Geneva
Act, and without prejudice to paragraph (2)(a)(ii), the natural person or legal entity referred to in
article 5(2)(ii) of that Act;
(ii) A declaration that protection is renounced in one or more Contracting Parties;
(iii) A copy in the original language of the registration, the legislative or administrative act, or
the judicial or administrative decision, by virtue of which protection is granted to the appellation of
origin or the geographical indication in the Contracting Party of Origin;
(iv) A statement to the effect that protection is not claimed for certain elements of the appel-
lation of origin for applications governed by the 1967 Act, or for certain elements, other than those
referred to in paragraph (5), of the appellation of origin or the geographical indication for applications
governed by the Geneva Act;
(v) One or more translations of the appellation of origin, in as many languages as the Competent
Authority of the country of origin wishes for applications governed by the 1967 Act;
(vi) Any further information the Competent Authority of the Contracting Party of Origin that
is party to the 1967 Act wishes to provide concerning the protection granted to the appellation of
origin in that country, such as additional particulars of the area of production of the product and a
description of the connection between the quality or characteristics of the good and its geographi-
cal environment.
(b) Notwithstanding Rule 3(3), particulars as referred to in subparagraph (a)(i) and (vi) shall
not be translated by the International Bureau.
Rule 6
Irregular Applications
(1) [Examination of the Application and Correction of Irregularities] (a) Subject to paragraph (2),
if the International Bureau finds that an application does not satisfy the conditions set out in Rule 3(1)
or Rule 5, it shall defer registration and invite the Competent Authority or, in the case of article 5(3)
of the Geneva Act, the beneficiaries or the natural person or legal entity referred to in article 5(2)(ii)
of that Act, to remedy the irregularity found within a period of three months from the date on which
the invitation was sent.
(b) If the irregularity found is not corrected within two months of the date of the invitation referred
to in subparagraph (a), the International Bureau shall send a reminder of its invitation. The sending
of such a reminder shall have no effect on the three-month period referred to in subparagraph (a).
(c) If the correction of the irregularity is not received by the International Bureau within the three-
-month period referred to in subparagraph (a), the application shall, subject to subparagraph (d),

be rejected by the International Bureau, which shall inform the Competent Authority or, in the case
of article 5(3) of the Geneva Act, the beneficiaries or the natural person or legal entity referred to in
article 5(2)(ii) of that Act as well as the Competent Authority, accordingly.
(d) In the case of an irregularity with respect to a requirement based on a notification made under
Rule 5(3) or (4), or on a declaration made under article 7(4) of the Geneva Act, if the correction of
the irregularity is not received by the International Bureau within the three-month period referred to
in subparagraph (a), the protection resulting from the international registration shall be considered
to be renounced in the Contracting Party that has made the notification or the declaration.
(e) Where, in accordance with subparagraph (c), the application is rejected, the International
Bureau shall refund the fees paid in respect of the application, after deduction of an amount cor-
responding to half the registration fee referred to in Rule 8.
(2) [Application Not Considered as Such] If the application is not filed by the Competent Authority
of the Contracting Party of Origin or, in the case of article 5(3) of the Geneva Act, the beneficiaries
or the natural person or legal entity referred to in article 5(2)(ii) of that Act, it shall not be considered
as such by the International Bureau and shall be returned to the sender.
Rule 7
Entry in the International Register
(1) [Registration] (a) Where the International Bureau finds that the application satisfies the
conditions set out in Rules 3(1) and 5, it shall enter the appellation of origin or the geographical
indication in the International Register.
(b) The International Bureau shall indicate per Contracting Party whether the international
registration is governed by the Geneva Act or by the Lisbon Agreement of October 31, 1958, or the
1967 Act.
(2) [Contents of the Registration] The international registration shall contain or indicate:
(i) All the particulars given in the application;
(ii) The language in which the International Bureau received the application;
(iii) The number of the international registration;
(iv) The date of the international registration.
(3) [Certificate and Notification] The International Bureau shall:
(i) Send a certificate of international registration to the Competent Authority of the Contracting
Party of Origin or, in the case of article 5(3) of the Geneva Act, to the beneficiaries or the natural
person or legal entity referred to in article 5(2)(ii) of that Act that requested the registration; and
(ii) Notify the international registration to the Competent Authority of each Contracting Party.
(4) [Implementation of articles 29(4) and 31(1) of the Geneva Act] (a) In case of the ratification
of, or accession to, the Geneva Act by a State that is party to the 1967 Act, Rules 5(2) to (4) shall
apply mutatis mutandis with regard to international registrations or appellations of origin effective
under the 1967 Act in respect of that State. The International Bureau shall verify with the Competent
Authority concerned any modifications to be made, in view of the requirements of Rules 3(1) and
5(2) to (4), for the purpose of their registration under the Geneva Act and shall notify international
registrations thus effected to all other Contracting Parties that are party to the Geneva Act. Modifi-
cations relating to Rule 5(2) shall be subject to payment of the fee specified in Rule 8(1)(ii).
(b) Any refusal or invalidation issued by a Contracting Party of the Geneva Act and of the 1967
Act shall remain effective under the Geneva Act in respect of an international registration referred
to in subparagraph (a), unless the Contracting Party notifies a withdrawal of refusal under article 16
of the Geneva Act or a statement of grant of protection under article 18 of the Geneva Act.
(c) Where subparagraph (b) does not apply, any Contracting Party of the Geneva Act and of
the 1967 Act shall, upon receipt of a notification under subparagraph (a), continue to protect the
appellation of origin concerned thenceforth also under the Geneva Act, unless the Contracting Party

indicates otherwise within the time period specified in article 5(3) of the 1967 Act and, for its remain-
der, in article 15(1) of the Geneva Act. Any period granted under article 5(6) of the 1967 Act and still
effective at the time the notification under subparagraph (a) is received shall, for its remainder, be
subject to the provisions of article 17 of the Geneva Act.
(d) The Competent Authority of a Contracting Party of the Geneva Act but not of the 1967
Act which receives a notification under subparagraph (a) may, in accordance with article 15 of the
Geneva Act, notify the International Bureau of the refusal of the effects of any of those international
registrations in its territory. The refusal shall be addressed to the International Bureau by such
Competent Authority within the period specified in Rule 9(1)(b) and (c). Rules 6(1)(d) and 9 to 12
shall apply mutatis mutandis.
Rule 7bis
Date of International Registration Effected Under the 1967 Act and Date of Its Effects
(1) [Date of International Registration] (a) Subject to subparagraph (b), the date of the internatio-
nal registration for an application filed under the 1967 Act shall be the date on which the application
was received by the International Bureau.
(b) Where the application does not contain all the following particulars:
(i) The Contracting Party of Origin;
(ii) The Competent Authority presenting the application;
(iii) The details identifying the beneficiaries;
(iv) The appellation of origin for which international registration is sought;
(v) The good or goods to which the appellation of origin applies;
the date of the international registration shall be the date on which the last of the missing particulars
is received by the International Bureau.
(2) [Date of Effects of International Registration] (a) Subject to subparagraph (b) and to para-
graph (3), an appellation of origin that is the subject of an international registration effected under
the 1967 Act shall, in each Contracting Party of the 1967 Act that has not refused in accordance
with article 5(3) of the 1967 Act the protection of the appellation of origin, or that has sent to the
International Bureau a statement of grant of protection in accordance with Rule 12, be protected
from the date of the international registration.
(b) A Contracting Party of the 1967 Act may, in a declaration, notify the Director General that,
in accordance with its legislation, a registered appellation of origin referred to in subparagraph (a)
is protected from a date that is mentioned in the declaration, which date shall however not be later
than the date of expiry of the period of one year referred to in article 5(3) of the 1967 Act.
(3) [Date of Effects of International Registration Following Adhesion to the Geneva Act] Follow-
ing the ratification of, or accession to, the Geneva Act by a Contracting Party of Origin that is party
to the 1967 Act, an appellation of origin that is the subject of an international registration effected
under the 1967 Act shall, in each Contracting Party that is party to the Geneva Act but not to the
1967 Act and that has not refused protection in accordance with article 15 of the Geneva Act, or that
has sent to the International Bureau a statement of grant of protection in accordance with article 18
of the Geneva Act, and in the absence of any irregularity under Rule 6(1)(d), be protected from the
date on which the ratification of, or accession to, the Geneva Act by the Contracting Party of Origin
becomes effective, subject to article 6(5)(b) of the Geneva Act.
Rule 8
Fees
(1) [Amount of Fees] The International Bureau shall collect the following fees, payable in Swiss francs:
(i) Fee for international registration (3) — 1000
(ii) Fee for one modification of an international registration (3) complementary fee for additional
modification(s) submitted in the same request — 500

(iii) Fee for providing an extract from the International Register — 300
(iv) Fee for providing an attestation or any other written information concerning the contents of
the International Register — 150
(v) Individual fees as referred to in paragraph (2) — 100
(2) [Establishment of the Amount of Individual Fees for Applications Governed by the Geneva
Act] (a) Where a Contracting Party of the Geneva Act makes a declaration as referred to in article 7(4)
of the Geneva Act that it wants to receive an individual fee in relation to an application governed
by the Geneva Act, as referred to in that provision, the amount of such fee shall be indicated in the
currency used by the Competent Authority.
(b) Where the fee is indicated in the declaration referred to in subparagraph (a) in a currency
other than Swiss currency, the Director General shall, after consultation with the Competent Author-
ity of the Contracting Party, establish the amount of the fee in Swiss currency on the basis of the
official exchange rate of the United Nations.
(c) Where, for more than three consecutive months, the official exchange rate of the United
Nations between the Swiss currency and the currency in which the amount of an individual fee has
been indicated by a Contracting Party is higher or lower by at least 5 per cent than the last exchange
rate applied to establish the amount of the fee in Swiss currency, the Competent Authority of that
Contracting Party may ask the Director General to establish a new amount of the fee in Swiss cur-
rency according to the official exchange rate of the United Nations prevailing on the day preceding
the day on which the request is made. The Director General shall proceed accordingly. The new
amount shall be applicable as from a date which shall be fixed by the Director General, provided
that such date is between one and two months after the date of the publication of the said amount
on the website of the Organization.
(d) Where, for more than three consecutive months, the official exchange rate of the United
Nations between the Swiss currency and the currency in which the amount of an individual fee has
been indicated by a Contracting Party is lower by at least 10 per cent than the last exchange rate
applied to establish the amount of the fee in Swiss currency, the Director General shall establish a
new amount of the fee in Swiss currency according to the current official exchange rate of the United
Nations. The new amount shall be applicable as from a date which shall be fixed by the Director
General, provided that such date is between one and two months after the date of the publication
of the said amount on the website of the Organization.
(3) [Crediting of Individual Fees for Applications Governed by the Geneva Act to the Accounts
of the Contracting Parties Concerned That Are Party to the Geneva Act] Any individual fee paid to
the International Bureau in respect of a Contracting Party of the Geneva Act shall be credited to
the account of that Contracting Party with the International Bureau within the month following the
month in the course of which the recording of the international registration for which that fee has
been paid was effected.
(4) [Obligation to Use Swiss Currency] All payments made under these Regulations to the
International Bureau shall be in Swiss currency irrespective of the fact that, where the fees are
paid through the Competent Authority, such Competent Authority may have collected those fees in
another currency.
(5) [Payment] (a) Subject to subparagraph (b), the fees shall be paid directly to the International
Bureau.
(b) The fees payable in connection with an application may be paid through the Competent
Authority if the Competent Authority accepts to collect and forward such fees and the beneficiaries
so wish. Any Competent Authority which accepts to collect and forward such fees shall notify that
fact to the Director General.
(6) [Modes of Payment] Fees shall be paid to the International Bureau in accordance with the
Administrative Instructions.
(7) [Indications Accompanying the Payment] At the time of the payment of any fee to the Interna-
tional Bureau, an indication must be given of the appellation of origin or the geographical indication
concerned and the purpose of the payment.

(8) [Date of Payment] (a) Subject to subparagraph (b), any fee shall be considered to have
been paid to the International Bureau on the day on which the International Bureau receives the
required amount.
(b) Where the required amount is available in an account opened with the International Bureau
and that Bureau has received instructions from the holder of the account to debit it, the fee shall
be considered to have been paid to the International Bureau on the day on which the International
Bureau receives an application or a request for the recording of a modification.
(9) [Change in the Amount of the Fees] Where the amount of any fee is changed, the amount
valid on the date on which the fee was received by the International Bureau shall be applicable.
(10) [Safeguard of the 1967 Act] (a) Notwithstanding paragraph (1)(v), a declaration made
under article 7(4) of the Geneva Act, by a Contracting Party of the Geneva Act and the 1967 Act,
shall have no effect in the relations with another Contracting Party that is party to the Geneva Act
and the 1967 Act.
(b) The Assembly may, by a three-fourths majority, repeal subparagraph (a), or restrict the
scope of subparagraph (a). Only Contracting Parties of the Geneva Act and the 1967 Act shall have
the right to vote.
CHAPTER III
Refusal and Other Actions in Respect of International Registration
Rule 9
Refusal
(1) [Notification to the International Bureau] (a) A refusal shall be notified to the International
Bureau by the Competent Authority of the concerned Contracting Party and shall be signed by that
Competent Authority.
(b) The refusal shall be notified within a period of one year from the receipt of the notification of
the international registration under article 5(2) of the 1967 Act or under article 6(4) of the Geneva Act.
In the case of article 29(4) of the Geneva Act, this time limit may be extended by another year.
(c) Unless demonstrated to the contrary by the Competent Authority referred to in subpara-
graph (a), the notification of an international registration referred to in subparagraph (b) shall be
deemed to have been received by the Competent Authority 20 days after the date indicated in the
notification.
(2) [Contents of the Notification of Refusal] A notification of refusal shall indicate or contain:
(i) The Competent Authority notifying the refusal;
(ii) The number of the relevant international registration, preferably accompanied by further infor-
mation enabling the identity of the international registration to be confirmed, such as the denomination
constituting the appellation of origin or the indication constituting the geographical indication;
(iii) The grounds on which the refusal is based;
(iv) Where the refusal is based on the existence of a prior right, the essential particulars of
that prior right and, in particular, if it is constituted by a national, regional or international trademark
application or registration, the date and number of such application or registration, the priority date
(where appropriate), the name and address of the holder, a reproduction of the trademark, together
with the list of relevant goods and services given in the trademark application or registration, it being
understood that the list may be submitted in the language of the said application or registration;
(v) Where the refusal concerns only certain elements of the appellation of origin, or the geo-
graphical indication, an indication of the elements that it concerns;
(vi) The judicial or administrative remedies available to contest the refusal, together with the
applicable time limits.
(3) [Entry in the International Register and Notifications by the International Bureau] Subject to
Rule 10(1), the International Bureau shall enter in the International Register any refusal, together

with the date on which the notification of refusal was sent to the International Bureau, and shall
communicate a copy of the notification of refusal to the Competent Authority of the Contracting
Party of Origin or, in the case of article 5(3) of the Geneva Act, the beneficiaries or the natural per-
son or legal entity referred to in article 5(2)(ii) of that Act as well as the Competent Authority of the
Contracting Party of Origin.
Rule 10
Irregular Notification of Refusal
(1) [Notification of Refusal Not Considered as Such] (a) A notification of refusal shall not be
considered as such by the International Bureau:
(i) If it does not indicate the number of the international registration concerned, unless other
information given in the notification enables the registration to be identified without ambiguity;
(ii) If it does not indicate any ground for refusal;
(iii) If it is sent to the International Bureau after the expiry of the relevant time limit referred to
in Rule 9(1);
(iv) If it is not notified to the International Bureau by the Competent Authority.
(b) Where subparagraph (a) applies, the International Bureau shall inform the Competent
Authority that submitted the notification of refusal that the refusal is not considered as such by the
International Bureau and has not been entered in the International Register, shall state the reasons
therefore and shall, unless it is unable to identify the international registration concerned, commu-
nicate a copy of the notification of refusal to the Competent Authority of the Contracting Party of
Origin or, in the case of article 5(3) of the Geneva Act, the beneficiaries or the natural person or legal
entity referred to in article 5(2)(ii) of that Act as well as the Competent Authority of the Contracting
Party of Origin.
(2) [Irregular Notification] If the notification of refusal contains an irregularity other than those
referred to in paragraph (1), the International Bureau shall nevertheless enter the refusal in the
International Register and shall communicate a copy of the notification of refusal to the Competent
Authority of the Contracting Party of Origin or, in the case of article 5(3) of the Geneva Act, the ben-
eficiaries or the natural person or legal entity referred to in article 5(2)(ii) of that Act as well as the
Competent Authority of the Contracting party of Origin. At the request of that Competent Authority
or, in the case of article 5(3) of the Geneva Act, the beneficiaries or the natural person or legal entity
referred to in article 5(2)(ii) of that Act, the International Bureau shall invite the Competent Authority
that submitted the notification of refusal to regularize the notification without delay.
Rule 11
Withdrawal of Refusal
(1) [Notification to the International Bureau] A refusal may be withdrawn, in part or in whole, at
any time by the Competent Authority that notified it. The withdrawal of a refusal shall be notified to
the International Bureau by the relevant Competent Authority and shall be signed by such authority.
(2) [Contents of the Notification] The notification of withdrawal of a refusal shall indicate:
(i) The number of the international registration concerned, preferably accompanied by other infor-
mation enabling the identity of the international registration to be confirmed, such as the denomination
constituting the appellation of origin or the indication constituting the geographical indication;
(ii) The reason for the withdrawal and, in case of a partial withdrawal, the particulars referred
to in Rule 9(2)(v);
(iii) The date on which the refusal was withdrawn.
(3) [Entry in the International Register and Notifications by the International Bureau] The Inter-
national Bureau shall enter in the International Register any withdrawal referred to in paragraph

(1) and shall communicate a copy of the notification of withdrawal to the competent Authority of
the Contracting Party of Origin or, in the case of article 5(3) of the Geneva Act, the beneficiaries or
the natural person or legal entity referred to in article 5(2)(ii) of that Act as well as the Competent
Authority of the Contracting Party of Origin.
Rule 12
Grant of Protection
(1) [Optional Statement of Grant of Protection] (a) The Competent Authority of a Contracting
Party which does not refuse the effects of an international registration may, within the time limit
referred to in Rule 9(1), send to the International Bureau a statement confirming that protection is
granted to the appellation of origin, or the geographical indication, that is the subject of an interna-
tional registration.
(b) The statement of grant of protection shall indicate:
(i) The Competent Authority of the Contracting Party making the statement;
(ii) The number of the international registration concerned, preferably accompanied by other
information enabling the identity of the international registration to be confirmed, such as the
denomination constituting the appellation of origin, or the indication constituting the geographical
indication; and
(iii) The date of the statement.
(2) [Optional Statement of Grant of Protection Following a Refusal] (a) Where a Competent
Authority that has previously submitted a notification of refusal wishes to withdraw that refusal, it
may, instead of notifying the withdrawal of refusal in accordance with Rule 11(1), send to the Inter-
national Bureau a statement to the effect that protection is granted to the relevant appellation of
origin or geographical indication.
(b) The statement of grant of protection shall indicate:
(i) The Competent Authority of the Contracting Party making the statement;
(ii) The number of the international registration concerned, preferably accompanied by other
information enabling the identity of the international registration to be confirmed, such as the
denomination constituting the appellation of origin, or the indication constituting the geographical
indication;
(iii) The reason for the withdrawal and, in case of a grant of protection that amounts to a partial
withdrawal of refusal, the particulars referred to in Rule 9(2)(v); and
(iv) The date on which protection was granted.
(3) [Entry in the International Register and Notifications by the International Bureau]
The International Bureau shall enter in the International Register any statement of grant of
protection referred to in paragraphs (1) or (2) and communicate a copy of such statement to the
Competent Authority of the Contracting Party of Origin or, in the case of article 5(3) of the Geneva
Act, the beneficiaries or the natural person or legal entity referred to in article 5(2)(ii) of that Act as
well as the Competent Authority of the Contracting Party of Origin.
Rule 13
Invalidation of the Effects of an International Registration in a Contracting Party
(1) [Notification of Invalidation to the International Bureau] Where the effects of an international
registration are invalidated in a Contracting Party, in whole or in part, and the invalidation is no longer
subject to appeal, the Competent Authority of the concerned Contracting Party shall transmit to the
International Bureau a notification of invalidation. The notification shall indicate or contain:
(i) The number of the international registration concerned, preferably accompanied by other infor-
mation enabling the identity of the international registration to be confirmed, such as the denomination
constituting the appellation of origin, or the indication constituting the geographical indication;

(ii) The authority that pronounced the invalidation;
(iii) The date on which the invalidation was pronounced;
(iv) Where the invalidation is partial, the particulars referred to in Rule 9(2)(v);
(v) The grounds on the basis of which the invalidation was pronounced;
(vi) A copy of the decision that invalidated the effects of the international registration.
(2) [Entry in the International Register and Notifications by the International Bureau] The Inter-
national Bureau shall enter the invalidation in the International Register together with the particulars
referred to in items (i) to (v) of paragraph (1) and shall communicate a copy of the notification to the
Competent Authority of the Contracting Party of Origin or, in the case of article 5(3) of the Geneva
Act, the beneficiaries or the natural person or legal entity referred to in article 5(2)(ii) of that Act as
well as the Competent Authority of the Contracting Party of Origin.
Rule 14
Transitional Period Granted to Third Parties
(1) [Notification to the International Bureau] Where a third party has been granted a defined period
of time in which to terminate the use of a registered appellation of origin, or a registered geographi-
cal indication, in a Contracting Party, in accordance with article 5(6) of the 1967 Act or article 17(1)
of the Geneva Act, the Competent Authority of that Contracting Party shall notify the International
Bureau accordingly. The notification shall be signed by that Authority and shall indicate:
(i) The number of the international registration concerned, preferably accompanied by other infor-
mation enabling the identity of the international registration to be confirmed, such as the denomination
constituting the appellation of origin, or the indication constituting the geographical indication;
(ii) The identity of the third party concerned;
(iii) The period granted to the third party, preferably accompanied by information about the
scope of the use during the transitional period;
(iv) The date from which the defined period begins, it being understood that the date may not be
later than one year and three months from the receipt of the notification of international registration
under article 5(2) of the 1967 Act or article 6(4) of the Geneva Act or, in the case of article 29(4) of
the Geneva Act, no later than two years and three months from such receipt.
(2) [Duration Under article 17 of the Geneva Act] The duration of the period granted to a third
party under article 17 of the Geneva Act shall not be longer than 15 years, it being understood that
the period may depend on the specific situation of each case and that a period longer than ten years
would be exceptional.
(3) [Entry in the International Register and Notifications by the International Bureau] Subject to
the notification referred to in paragraph (1) being sent by the Competent Authority to the International
Bureau before the date referred to in paragraph (1)(iv), the International Bureau shall enter such
notification in the International Register together with the particulars shown therein and shall commu-
nicate a copy of the notification to the Competent Authority of the Contracting Party of Origin or, in the
case of article 5(3) of the Geneva Act, the beneficiaries or the natural person or legal entity referred
to in article 5(2)(ii) of that Act as well as the Competent Authority of the Contracting Party of Origin.
Rule 15
Modifications
(1) [Permissible Modifications] The following modifications may be recorded in the International
Register:
(i) A modification of the beneficiaries consisting in the addition or deletion of a beneficiary or
some beneficiaries, or a modification of the names or addresses of the beneficiaries or of the natural
person or legal entity referred to in article 5(2)(ii) of the Geneva Act;
(ii) [Deleted];

(iii) A modification of the limits of the geographical area of production or the geographical area
of origin of the good or goods to which the appellation of origin, or the geographical indication,
applies;
(iv) A modification relating to the legislative or administrative act, the judicial or administrative
decision, or the registration referred to in Rule 5(2)(a)(vii);
(v) A modification relating to the Contracting Party of Origin that does not affect the geographical
area of production or the geographical area of origin of the good or goods to which the appellation
of origin, or the geographical indication, applies;
(vi) [Deleted]
(2) [Procedure] (a) A request for entry of a modification referred to in paragraph (1) shall be
presented to the International Bureau and shall be signed by the Competent Authority of the Con-
tracting Party of Origin or, in the case of article 5(3) of the Geneva Act, the beneficiaries or the
natural person or legal entity referred to in article 5(2)(ii) of that Act, and shall be accompanied by
the fee specified in Rule 8.
(b) A request for entry of a modification referred to in paragraph (1) shall, where it concerns a
newly established trans-border geographical area of production or geographical area of origin as
referred to in article 1(xiii) of the Geneva Act, be presented to the International Bureau and shall
be signed by the commonly designated Competent Authority as referred to in article 5(4) of the
Geneva Act.
(3) [Entry in the International Register and Notification to the Competent Authorities] The Interna-
tional Bureau shall enter in the International Register any modification requested in accordance with
paragraphs (1) and (2) together with the date of receipt of the request by the International Bureau,
confirm the entry to the Competent Authority that requested the modification, and communicate such
modification to the Competent Authorities of the other Contracting Parties.
(4) [Optional Alternative for International Registration Effected Under the Geneva Act] In the
case of article 5(3) of the Geneva Act, paragraphs (1) to (3) shall apply mutatis mutandis, it being
understood that a request from the beneficiaries or from the natural person or legal entity referred
to in article 5(2)(ii) of the Geneva Act must indicate that the change is requested because of a cor-
responding change to the registration, the legislative or administrative act, or the judicial or admin-
istrative decision, on the basis of which the appellation of origin, or the geographical indication, had
been granted protection in the Contracting Party of Origin that made a declaration in accordance
with article 5(3) of the Geneva Act; and that the entry of the modification in the International Register
shall be confirmed to the concerned beneficiaries or natural person or legal entity by the International
Bureau, which shall also inform the Competent Authority of the Contracting Party of Origin that made
a declaration in accordance with article 5(3) of the Geneva Act.
Rule 16
Renunciation of Protection
(1) [Notification to the International Bureau] The Competent Authority of the Contracting Party
of Origin, or, in the case of article 5(3) of the Geneva Act, the beneficiaries or the natural person or
legal entity referred to in article 5(2)(ii) of that Act or the Competent Authority of the Contracting Party
of Origin, may at any time notify the International Bureau that protection of the appellation of origin,
or the geographical indication, is renounced, in whole or in part, in respect of one or some but not
all of the Contracting Parties. The notification of renunciation of protection shall state the number of
the international registration concerned, preferably accompanied by other information enabling the
identity of the international registration to be confirmed, such as the denomination constituting the
appellation of origin, or the indication constituting the geographical indication and shall be signed
by the Competent Authority or, in the case of article 5(3) of the Geneva Act, the beneficiaries or the
natural person or legal entity referred to in article 5(2)(ii) of that Act.
(2) [Withdrawal of a Renunciation] (a) Any renunciation, including a renunciation under
Rule 6(1)(d), may be withdrawn, in whole or in part, at any time by the Competent Authority of the

Contracting Party of Origin or, in the case of article 5(3) of the Geneva Act, the beneficiaries or the
natural person or legal entity referred to in article 5(2)(ii) of that Act or the Competent Authority of
the Contracting Party of Origin, subject to the correction of the irregularity in the case of a renuncia-
tion under Rule 6(1)(d).
(b) Subject to article 6(5)(b) of the Geneva Act, in each Contracting Party in which a renuncia-
tion has effect, a registered appellation of origin or geographical indication shall be protected from
the date on which:
(i) The withdrawal of renunciation is received by the International Bureau in the case of a
renunciation referred to in paragraph (1); and
(ii) The correction of the irregularity is received by the International Bureau in the case of a
renunciation referred to in Rule 6(1)(d).
(3) [Entry in the International Register and Notification to the Competent Authorities] The Inter-
national Bureau shall enter in the International Register any renunciation of protection referred to
in paragraph (1), or any withdrawal of a renunciation referred to in paragraph (2), confirm the entry
to the Competent Authority of the Contracting Party of Origin and, in the case of article 5(3) of the
Geneva Act, the beneficiaries or the natural person or legal entity, while also informing the Competent
Authority of the Contracting Party of Origin, and shall communicate the entry of such modification
in the International Register to the Competent Authorities of each Contracting Party to which the
renunciation, or the withdrawal of the renunciation, relates.
(4) [Application of Rules 9 to 12] The Competent Authority of a Contracting Party that receives
a notification of the withdrawal of a renunciation may notify the International Bureau of the refusal
of the effects of the international registration in its territory. The declaration shall be addressed to
the International Bureau by such Competent Authority within a period of one year from the date of
receipt of the notification by the International Bureau of the withdrawal of the renunciation. Rules 9
to 12 shall apply mutatis mutandis.
Rule 17
Cancellation of an International Registration
(1) [Request for Cancellation] The Competent Authority of the Contracting Party of Origin,
or, in the case of article 5(3) of the Geneva Act, the beneficiaries or the natural person or legal
entity referred to in article 5(2)(ii) of that Act or the Competent Authority of the Contracting Party of
Origin, may at any time request the International Bureau to cancel their international registration.
The request for cancellation shall state the number of the international registration concerned,
preferably accompanied by other information enabling the identity of the international registration
to be confirmed, such as the denomination constituting the appellation of origin or the indication
constituting the geographical indication and shall be signed by the Competent Authority or, in the
case of article 5(3) of the Geneva Act, the beneficiaries or the natural person or legal entity referred
to in article 5(2)(ii) of that Act.
(2) [Entry in the International Register and Notification to the Competent Authorities] The
International Bureau shall enter in the International Register any cancellation together with the par-
ticulars given in the request, confirm the entry to the Competent Authority of the Contracting Party
of Origin or, in the case of article 5(3) of the Geneva Act, the beneficiaries or the natural person or
legal entity referred to in article 5(2)(ii) of that Act, while also informing the Competent Authority of
the Contracting Party of Origin, and shall communicate the cancellation to the Competent Authori-
ties of the other Contracting Parties.
Rule 18
Corrections Made to the International Register
(1) [Procedure] If the International Bureau, acting ex officio or at the request of the Competent
Authority of the Contracting Party of Origin, finds that the International Register contains an error
with respect to an international registration, it shall correct the Register accordingly.

(2) [Optional Alternative for International Registration Under the Geneva Act] In the case of
article 5(3) of the Geneva Act, a request under paragraph (1) can also be submitted by the beneficia-
ries or by the natural person or legal entity referred to in article 5(2)(ii) of that Act. The beneficiaries
or the natural person or legal entity shall be notified by the International Bureau of any correction
concerning the international registration.
(3) [Notification of Corrections to the Competent Authorities] The International Bureau shall notify
any correction of the International Register to the Competent Authorities of all Contracting Parties
as well as, in the case of article 5(3) of the Geneva Act, the beneficiaries or the natural person or
legal entity referred to in article 5(2)(ii) of that Act.
(4) [Application of Rules 9 to 12] Where the correction of an error concerns the appellation of
origin or the geographical indication, or the good or goods to which the appellation of origin or the
geographical indication applies, the Competent Authority of a Contracting Party has the right to
declare that it cannot ensure the protection of the appellation of origin or geographical indication after
the correction. The declaration shall be addressed to the International Bureau by such Competent
Authority within a period of one year from the date of receipt of the notification by the International
Bureau of the correction. Rules 9 to 12 shall apply mutatis mutandis.
CHAPTER IV
Miscellaneous Provisions
Rule 19
Publication
The International Bureau shall publish all entries made in the International Register.
Rule 20
Extracts from the International Register and Other Information Provided by the International Bureau
(1) [Information on the Contents of the International Register] Extracts from the International
Register or any other information on the contents of the Register shall be provided by the Interna-
tional Bureau to any person so requesting, on payment of the fee specified in Rule 8.
(2) [Communication of Provisions, Decisions or the Registration Under Which an Appellation of
Origin or a Geographical Indication Is Protected] (a) Any person may request from the International
Bureau a copy in the original language of the provisions, the decisions or the registration referred
to in Rule 5(2)(a)(vii), on payment of the fee specified in Rule 8.
(b) Where such documents have already been communicated to the International Bureau, the
latter shall transmit without delay a copy to the person who has made the request.
(c) If such a document has never been communicated to the International Bureau, the latter
shall request a copy of it from the Competent Authority of the Contracting Party of Origin and shall
transmit the document, on receipt, to the person who has made the request.
Rule 21
Signature
Where the signature of a Competent Authority is required under these Regulations, such sig-
nature may be printed or replaced by the affixing of a facsimile or an official seal.
Rule 22
Date of Dispatch of Various Communications
Where the notifications referred to in Rules 9(1), 14(1), 16(4) and 18(4) are communicated
through a postal service, the date of dispatch shall be determined by the postmark. If the postmark

is illegible or missing, the International Bureau shall treat the communication concerned as if it
had been sent 20 days before the date on which it was received. Where such notifications are
sent through a mail delivery service, the date of dispatch shall be determined by the information
provided by such delivery service on the basis of the details of the mailing as recorded by it. Such
notifications may also be communicated by facsimile or by electronic means, as provided for in the
Administrative Instructions.
Rule 23
Modes of Notification by the International Bureau
Any notification by the International Bureau referred to in these Regulations shall be addressed
to the Competent Authorities or, in the case of article 5(3) of the Geneva Act, to the beneficiaries or
the natural person or legal entity referred to in article 5(2)(ii) of that Act by any means enabling the
International Bureau to establish that the notification has been received.
Rule 24
Administrative Instructions
(1) [Establishment of Administrative Instructions; Matters Governed by Them] (a) The Director
General shall establish Administrative Instructions and may modify them. Before establishing or
modifying the Administrative Instructions, the Director General shall consult the Competent Authori-
ties of the Contracting Parties which have direct interest in the proposed Administrative Instructions
or their proposed modification.
(b) The Administrative Instructions shall deal with matters in respect of which these Regulations
expressly refer to such Instructions and with details in respect of the application of these Regulations.
(2) [Supervision by the Assembly] The Assembly may invite the Director General to modify
any provision of the Administrative Instructions and the Director General shall act upon any such
invitation.
(3) [Publication and Effective Date] (a) The Administrative Instructions and any modification
thereof shall be published.
(b) Each publication shall specify the date on which the published provisions become effec-
tive. The dates may be different for different provisions, provided that no provision may be declared
effective prior to its publication.
(4) [Conflict with the Act or These Regulations] In the case of conflict between, on the one hand,
any provision of the Administrative Instructions and, on the other hand, any provision of the Act or
these Regulations, the latter shall prevail.
Rule 25
Entry into Force; Transitional Provisions
(1) [Entry into Force] These Regulations shall enter into force on February 26, 2020, and shall,
as from that date, replace the Regulations under the 1967 Act for the Protection of Appellations of
Origin and their International Registration as in force on January 1, 2016 (hereinafter referred as
“the Regulations under the Agreement”).
(2) [Transitional Provisions] Notwithstanding paragraph (1):
(i) An application governed by the 1967 Act which was received by the International Bureau
before the date referred to in paragraph (1) shall, to the extent that it conforms to the requirements
of the Regulations under the 1967 Act, be deemed to conform to the applicable requirements for
the purposes of Rule 7;
(ii) A communication of refusal, withdrawal of refusal, statement of grant of protection, notifica-
tion of invalidation of effects of an international registration in a Contracting Party, transitional period
granted to third parties, modification, renunciation of protection, or cancellation of an international
registration effected under the 1967 Act which was received by the International Bureau before

the date referred to in paragraph (1), shall, to the extent that it conforms to the requirements of
the Regulations under the 1967 Act, be deemed to conform to the applicable requirements for the
purposes of Rules 9(3), 11(3), 12(3), 13(2), 14(3), 15(3), 16(3) and 17(2), respectively.
(1) In the English version, reference to “good” shall be deemed, where appropriate, to include a reference to “product”,
as referred to in the 1967 Act.
(2) The application of Rule 5(2)(a)(iv) and Rule 5(2)(b) is subject to the provisions of Rule 3(3) and (4).
(3) For an international registration referring to a geographical area located in a least developed country (LDC), in
accordance with the lists established by the United Nations, the fee is reduced to 50 per cent of the prescribed amount
(rounded to the nearest full figure). In such case, the fee will amount to 500 Swiss francs for an international registration
referring to a geographical area of origin located in an LDC, to 250 Swiss francs for one modification of an international
registration referring to a geographical area of origin located in an LDC, and to 150 Swiss francs for a complementary fee
for additional modification(s) submitted in the same request. These fee reductions will apply three years after the entry into
force of the Geneva Act.

Introdução e disposições gerais
Artigo 1.º
Expressões abreviadas
Para efeitos do presente ato e salvo indicação expressa em contrário, entende-se por:
i) «Acordo de Lisboa», o Acordo de Lisboa Relativo à Proteção das Denominações de Origem
e ao Seu Registo Internacional, de 31 de outubro de 1958;
ii) «Ato de 1967», o Acordo de Lisboa tal como revisto em Estocolmo, em 14 de julho de 1967,
e alterado em 28 de setembro de 1979;
iii) «Presente ato», o Acordo de Lisboa Relativo às Denominações de Origem e às Indicações
Geográficas, tal como estabelecido pelo presente ato;
iv) «Regulamentos», os regulamentos a que se refere o artigo 25.º;
v) «Convenção de Paris», a Convenção de Paris para a Proteção da Propriedade Industrial,
de 20 de março de 1883, conforme revista e alterada;
vi) «Denominação de origem», uma denominação na aceção do artigo 2.º, n.º 1, alínea i);
vii) «Indicação geográfica», uma indicação na aceção do artigo 2.º, n.º 1, alínea ii);
viii) «Registo internacional», o registo internacional conservado pela Secretaria Internacional,
em conformidade com o artigo 4.º, enquanto compêndio oficial dos dados relativos às inscrições
de denominações de origem e de indicações geográficas, independentemente do suporte de con-
servação dos mesmos;
ix) «Inscrição no registo internacional», a introdução dos dados no registo internacional;
x) «Pedido», um pedido de inscrição no registo internacional;
xi) «Inscrito», anotado no registo internacional em conformidade com o presente ato;
xii) «Zona geográfica de origem», uma zona geográfica na aceção do artigo 2.º, n.º 2;
xiii) «Zona geográfica transfronteiriça», uma zona geográfica situada no território de Partes
Contratantes adjacentes, ou que as abrange;
xiv) «Parte Contratante», qualquer Estado ou organização intergovernamental Parte no pre-
sente ato;
xv) «Parte Contratante de origem», a Parte Contratante em que se situa a zona geográfica de
origem ou as Partes Contratantes em que se situa a zona geográfica transfronteiriça de origem;
xvi) «Autoridade competente», a autoridade designada em conformidade com o artigo 3.º;
xvii) «Beneficiários», as pessoas singulares ou coletivas autorizadas, ao abrigo da legislação da
Parte Contratante de origem, a utilizar uma denominação de origem ou uma indicação geográfica;
xviii) «Organização intergovernamental», uma organização intergovernamental elegível para
se tornar Parte no presente ato, em conformidade com o artigo 28.º, n.º 1, alínea iii);
xix) «Organização», a Organização Mundial da Propriedade Intelectual;
xx) «Diretor-Geral», o Diretor-Geral da Organização;
xxi) «Secretaria Internacional», a Secretaria Internacional da Organização.
Artigo 2.º
Objeto
1) [Denominações de origem e indicações geográficas protegidas] O presente ato é aplicável:
i) A qualquer denominação protegida na Parte Contratante de origem, que consista no nome,
ou contenha o nome, de uma zona geográfica, ou outra denominação conhecida como fazendo

referência a essa zona, que sirva para designar um produto como sendo originário dessa zona geo-
gráfica, cuja qualidade ou características resultem exclusiva ou essencialmente do meio geográfico,
incluindo fatores naturais e humanos, e que tenha conferido ao produto a sua reputação; e
ii) A qualquer indicação protegida na Parte Contratante de origem, que consista no nome, ou
contenha o nome, de uma zona geográfica, ou outra indicação conhecida como fazendo referência
a essa zona, que identifique um produto como sendo originário dessa zona geográfica, sempre
que determinada qualidade, reputação ou outra característica do produto resulte essencialmente
da sua origem geográfica.
2) [Zonas geográficas de origem possíveis] A zona geográfica de origem a que se refere o
n.º 1 pode consistir em todo o território da Parte Contratante de origem ou numa região, localidade
ou lugar da Parte Contratante de origem. Tal não exclui a aplicação do presente ato a uma zona
geográfica de origem, na aceção do n.º 1, que consista numa zona geográfica transfronteiriça, ou
a parte de uma zona geográfica transfronteiriça.
Artigo 3.º
Autoridade competente
Cada Parte Contratante designa uma entidade responsável pela administração do presente
ato no seu território e pela comunicação com a Secretaria Internacional ao abrigo do presente ato
e dos regulamentos. Cada Parte Contratante notifica o nome e os contactos da sua autoridade
competente à Secretaria Internacional, nos termos dos regulamentos.
Artigo 4.º
Registo internacional
A Secretaria Internacional conserva um registo internacional das inscrições efetuadas ao abrigo
do presente ato, do Acordo de Lisboa e do Ato de 1967, ou de ambos, bem como dados relativos
a essas inscrições.
CAPÍTULO II
Pedido e inscrição no registo internacional
Artigo 5.º
Pedido
1) [Local de depósito] O pedido é depositado junto da Secretaria Internacional.
2) [Pedido depositado pela autoridade competente] Sem prejuízo do disposto no n.º 3, o
pedido de inscrição no registo internacional de uma denominação de origem ou de uma indicação
geográfica é depositado pela autoridade competente:
i) Em nome dos beneficiários; ou
ii) Em nome de uma pessoa singular ou coletiva com legitimidade processual ao abrigo da
legislação da Parte Contratante de origem para fazer valer os direitos dos beneficiários ou outros
direitos relativos à denominação de origem ou à indicação geográfica.
3) [Pedido depositado diretamente] a) Sem prejuízo do disposto no n.º 4, se a legislação da
Parte Contratante de origem o permitir, o pedido pode ser depositado pelos beneficiários ou por
uma pessoa singular ou coletiva a que se refere o n.º 2, alínea ii).
b) A alínea a) é aplicável sob reserva de a Parte Contratante apresentar uma declaração de que
a sua legislação assim o permite. Essa declaração pode ser feita pela Parte Contratante aquando
do depósito do seu instrumento de ratificação ou de adesão, ou posteriormente. Se a declaração

efeitos a partir da entrada em vigor do presente ato no que respeita a essa Parte Contratante. Se for
feita após a entrada em vigor do presente ato, no que respeita à Parte Contratante, a declaração
produz efeitos três meses a contar da sua data de receção pelo Diretor-Geral.
4) [Eventual pedido conjunto no caso de zonas geográficas transfronteiriças] Caso uma zona
geográfica de origem consista numa zona geográfica transfronteiriça, as Partes Contratantes adja-
centes podem, em conformidade com o respetivo acordo, depositar um pedido conjunto através de
uma autoridade competente comummente designada.
5) [Teor obrigatório] Os regulamentos especificam os elementos obrigatórios que devem constar
do pedido, além dos especificados no artigo 6.º, n.º 3.
6) [Teor facultativo] Os regulamentos podem especificar os elementos facultativos que devem
constar do pedido.
Artigo 6.º
Inscrição no registo internacional
1) [Exame formal pela Secretaria Internacional] Após receção em boa e devida forma, conforme
previsto nos regulamentos, de um pedido relativo a uma denominação de origem ou a uma indicação
geográfica, a Secretaria Internacional procede à sua inscrição no registo internacional.
2) [Data de inscrição no registo internacional] Sem prejuízo do disposto no n.º 3, a data de
inscrição no registo internacional é a data em que a Secretaria Internacional recebe o pedido.
3) [Data de inscrição no registo internacional quando os dados estão incompletos] Se os
seguintes elementos não constarem do pedido:
i) Identificação da autoridade competente ou, no caso previsto no artigo 5.º, n.º 3, do(s)
requerente(s);
ii) Dados identificativos dos beneficiários e, se for caso disso, da pessoa singular ou coletiva
a que se refere o artigo 5.º, n.º 2, alínea ii);
iii) Denominação de origem ou indicação geográfica para a qual é solicitada a inscrição no
registo internacional;
iv) Produto(s) a que se aplica(m) a denominação de origem ou a indicação geográfica;
a data de inscrição no registo internacional é a data em que a Secretaria Internacional recebe os
últimos elementos em falta.
4) [Publicação e notificação de inscrições no registo internacional] A Secretaria Internacional
publica sem demora a inscrição no registo internacional e notifica a autoridade competente de cada
Parte Contratante em conformidade.
5) [Data de produção de efeitos de uma inscrição no registo internacional] a) Sob reserva do
disposto na alínea b), uma denominação de origem ou indicação geográfica registada beneficia de
proteção a partir da data da inscrição no registo internacional em cada Parte Contratante que não
tenha recusado proteção nos termos do artigo 15.º ou que tenha notificado à Secretaria Internacional
a concessão de proteção nos termos do artigo 18.º
b) Uma Parte Contratante pode, mediante uma declaração, notificar o Diretor-Geral de que, em
conformidade com a sua legislação nacional ou regional, protegerá uma denominação de origem
ou indicação geográfica inscrita no registo internacional a partir da data especificada nessa decla-
ração. Porém, essa data não pode ser posterior ao prazo de notificação de recusa especificado
nos regulamentos, em conformidade com o artigo 15.º, n.º 1, alínea a).
Artigo 7.º
Taxas
1) [Taxa de inscrição no registo internacional] A inscrição no registo internacional de cada
denominação de origem e indicação geográfica está sujeita ao pagamento de uma taxa especifi-
cada nos regulamentos.

2) [Taxas relativas a outras entradas no registo internacional] Os regulamentos especificam as
taxas a pagar respeitantes a outras entradas no registo internacional e ao fornecimento de extratos,
certificados ou outras informações relativas ao teor das inscrições no registo internacional.
3) [Reduções de taxas] A Assembleia fixa as taxas reduzidas aplicáveis a determinadas
inscrições no registo internacional de denominações de origem e de indicações geográficas, em
particular quando a Parte Contratante de origem é um país em desenvolvimento ou um país menos
desenvolvido.
4) [Taxa individual] a) Qualquer Parte Contratante pode, mediante uma declaração, notificar o
Diretor-Geral de que a proteção resultante de uma inscrição no registo internacional só lhe é exten-
sível se for paga uma taxa para cobrir o custo de análise substantiva dessa inscrição. O montante
da taxa individual é indicado na declaração, podendo ser alterado em declarações subsequentes.
O referido montante não pode ser superior ao montante equivalente previsto pela legislação nacional
ou regional da Parte Contratante, deduzidas as economias resultantes do procedimento interna-
cional. Além disso, a Parte Contratante pode, mediante uma declaração, notificar o Diretor-Geral
de que requer uma taxa administrativa relativa à utilização pelos beneficiários da denominação de
origem ou indicação geográfica nessa Parte Contratante.
b) Em conformidade com os regulamentos, o não pagamento de uma taxa individual resulta
na recusa da proteção no que respeita à Parte Contratante em causa.
Artigo 8.º
Validade das inscrições no registo internacional
1) [Causalidade] As inscrições no registo internacional são válidas indefinidamente, entendendo-
-se que a proteção de uma denominação de origem ou indicação geográfica inscrita no registo
deixa de ser necessária se a denominação que constitui uma denominação de origem ou indicação
geográfica já não estiver protegida na Parte Contratante de origem.
2) [Cancelamento] a) A autoridade competente da Parte Contratante de origem ou, no caso
previsto no artigo 5.º, n.º 3, os beneficiários ou a pessoa singular ou coletiva a que se refere o
artigo 5.º, n.º 2, alínea ii), ou a autoridade competente da Parte Contratante de origem, pode, a
qualquer momento, solicitar à Secretaria Internacional o cancelamento da inscrição no registo
internacional em causa.
b) No caso de a denominação que constitui uma denominação de origem registada ou de
a indicação que constitui uma indicação geográfica registada já não estar protegida na Parte
Contratante de origem, a autoridade competente da Parte Contratante de origem deve requerer o
cancelamento da inscrição no registo internacional.
CAPÍTULO III
Proteção
Artigo 9.º
Compromisso de proteção
Cada Parte Contratante protege, no seu território, as denominações de origem e indicações
geográficas inscritas no registo internacional, no quadro do respetivo sistema e prática jurídica,
mas em conformidade com o disposto no presente ato e sujeito a qualquer recusa, renúncia,
anulação ou cancelamento que possa vir a ocorrer no seu território. As Partes Contratantes cuja
legislação nacional ou regional não estabeleça uma distinção entre denominações de origem e
indicações geográficas não estão obrigadas a introduzir tal distinção na sua legislação nacional
ou regional.

Artigo 10.º
Proteção ao abrigo da legislação das Partes Contratantes e de outros instrumentos
1) [Forma de proteção jurídica] Cada Parte Contratante é livre de escolher o tipo de legislação
ao abrigo da qual se estabelece a proteção prevista no presente ato, desde que aquela preencha
os requisitos substantivos deste último.
2) [Proteção ao abrigo de outros instrumentos] As disposições do presente ato em nada afetam
qualquer outra proteção que uma Parte Contratante possa conferir às denominações de origem e
indicações geográficas registadas ao abrigo da sua legislação nacional ou regional, ou de outros
instrumentos internacionais.
3) [Relação com outros instrumentos] Nenhuma disposição do presente ato pode derrogar a
quaisquer obrigações que vinculem as Partes Contratantes entre si, ao abrigo de quaisquer outros
instrumentos internacionais, nem afetar quaisquer direitos de uma Parte Contratante ao abrigo de
outros instrumentos internacionais.
Artigo 11.º
Proteção de denominações de origem e de indicações geográficas inscritas
1) [Teor da proteção] Sob reserva do disposto no presente ato, para cada denominação de
origem ou indicação geográfica registada, cada Parte Contratante estabelece os meios jurídicos
para impedir:
a) A utilização da denominação de origem ou da indicação geográfica:
i) No que respeita a produtos de natureza idêntica à daqueles a que a denominação de origem
ou a indicação geográfica se aplica, que não sejam originários da zona geográfica de origem ou
que não cumpram quaisquer outros requisitos atinentes à utilização da denominação de origem
ou da indicação geográfica;
ii) No que respeita a produtos que não sejam de natureza idêntica à daqueles a que a denomi-
nação de origem ou indicação geográfica se aplica, ou serviços, caso essa utilização possa indicar
ou sugerir uma ligação entre esses produtos ou serviços e os beneficiários da denominação de
origem ou da indicação geográfica, e seja suscetível de lesar os seus interesses ou, quando apli-
cável, devido à sua reputação na Parte Contratante em causa, essa utilização seja suscetível de
prejudicar, reduzir de forma desleal ou retirar benefícios indevidos dessa reputação;
b) Qualquer outra prática suscetível de induzir o consumidor em erro quanto à verdadeira
origem, proveniência ou natureza do produto.
2) [Teor da proteção no que respeita a determinadas utilizações] O n.º 1, alínea a), aplica-se
igualmente à utilização da denominação de origem ou da indicação geográfica equivalente à sua
imitação, mesmo que seja indicada a verdadeira origem do produto ou que a denominação de ori-
gem ou indicação geográfica seja utilizada de forma traduzida ou acompanhada de termos como
«estilo», «género», «tipo», «maneira», «imitação», «método», «como produzido em», «como»,
«semelhante», ou outros termos análogos (1).
3) [Utilização numa marca comercial] Sem prejuízo do disposto no artigo 13.º, n.º 1, uma Parte
Contratante deve, ex officio se a sua legislação o permitir, ou a pedido de uma parte interessada,
recusar ou anular o registo de uma marca comercial posterior se a utilização da mesma resultar
numa das situações a que se refere o n.º 1.
Artigo 12.º
Proteção contra o caráter genérico
Sob reserva do disposto no presente ato, não se pode considerar que as denominações de ori-
gem e indicações geográficas registadas adquiriram um caráter genérico (2) numa Parte Contratante.

Artigo 13.º
Salvaguardas relativas a outros direitos
1) [Direitos prévios das marcas comerciais] O disposto no presente ato não prejudica uma
marca comercial previamente requerida ou registada de boa-fé, ou adquirida pelo uso, de boa-fé,
numa Parte Contratante. Sempre que a legislação de uma Parte Contratante preveja uma exce-
ção limitada aos direitos conferidos por uma marca comercial, de tal forma que a marca existente
previamente possa, em determinadas circunstâncias, não permitir ao seu proprietário impedir que
uma denominação de origem ou uma indicação geográfica registada obtenha proteção ou seja uti-
lizada nessa Parte Contratante, a proteção da denominação de origem ou da indicação geográfica
registada não limitará de nenhuma outra forma os direitos conferidos por essa marca comercial.
2) [Nome pessoal utilizado comercialmente] O disposto no presente ato não prejudica o direito
que assiste a qualquer pessoa de utilizar, no âmbito de operações comerciais, o seu nome ou o nome
do seu antecessor comercial, exceto se esse nome for utilizado de modo a induzir o público em erro.
3) [Direitos baseados numa denominação de variedade vegetal ou de raça animal] O disposto
no presente ato não prejudica o direito que assiste a qualquer pessoa de utilizar uma denomina-
ção de variedade vegetal ou de raça animal no âmbito de operações comerciais, exceto se essa
denominação for utilizada de modo a induzir o público em erro.
4) [Medidas de salvaguarda em caso de notificação de retirada de recusa ou de concessão
de proteção] Sempre que uma Parte Contratante que tenha recusado os efeitos de uma inscrição
no registo internacional ao abrigo do artigo 15.º, alegando uma utilização por uma marca comer-
cial prévia ou outro direito, como referido no presente artigo, notificar a retirada dessa recusa ao
abrigo do artigo 16.º, ou a concessão de proteção, ao abrigo do artigo 18.º, a consequente prote-
ção da denominação de origem ou da indicação geográfica não deve prejudicar esse direito ou a
sua utilização, salvo se a proteção for concedida na sequência do cancelamento, não renovação,
revogação ou anulação do direito.
Artigo 14.º
Procedimentos de execução e vias de recurso
Cada Parte Contratante deve disponibilizar vias legais de recurso eficazes para a proteção
das denominações de origem e indicações geográficas registadas e assegurar que uma autori-
dade pública ou qualquer parte interessada possa intentar processos judiciais para garantir a sua
proteção, quer se trate de uma pessoa singular ou coletiva, e de uma entidade pública ou privada,
dependendo do seu ordenamento jurídico e prática.
CAPÍTULO IV
Recusa e outras ações relativas a inscrições no registo internacional
Artigo 15.º
Recusa
1) [Recusa de produção de efeitos de uma inscrição no registo internacional]
a) Dentro do prazo fixado nos regulamentos, a autoridade competente de uma Parte Contra-
tante pode notificar à Secretaria Internacional a recusa de produção de efeitos, no seu território, de
uma inscrição no registo internacional. A autoridade competente pode notificar a recusa ex officio,
se a sua legislação assim o permitir, ou a pedido de uma parte interessada.
b) A notificação de recusa deve incluir uma fundamentação.
2) [Proteção ao abrigo de outros instrumentos] A notificação de recusa não deve prejudicar
qualquer outra proteção disponível, em conformidade com o artigo 10.º, n.º 2, relativa à denomina-
ção ou indicação em causa, na Parte Contratante a que a recusa diz respeito.

3) [Obrigação de proporcionar oportunidades às partes interessadas] Cada Parte Contratante
proporciona uma oportunidade razoável para que qualquer pessoa cujos interesses possam ser
afetados por uma inscrição no registo internacional possa solicitar à autoridade competente a noti-
ficação de recusa daquela.
4) [Registo, publicação e comunicação de recusas] A Secretaria Internacional regista a recusa
e os motivos da mesma no registo internacional. A Secretaria Internacional publica a recusa e os
motivos da mesma e comunica a notificação de recusa à autoridade competente da Parte Con-
tratante de origem ou, caso o pedido tenha sido depositado diretamente nos termos do artigo 5.º,
n.º 3, aos beneficiários ou à pessoa singular ou coletiva a que se refere o artigo 5.º, n.º 2, alínea ii),
bem como à autoridade competente da Parte Contratante de origem.
5) [Tratamento nacional] Cada Parte Contratante deve disponibilizar às partes interessadas
afetadas por uma recusa as mesmas vias legais e administrativas de recurso disponibilizadas aos
seus próprios nacionais no quadro de uma recusa de proteção de uma denominação de origem
ou de uma indicação geográfica.
Artigo 16.º
Retirada de recusa
Pode retirar-se uma recusa de acordo com os procedimentos especificados nos regulamentos,
sendo a mesma averbada no registo internacional.
Artigo 17.º
Período transitório
1) [Opção de concessão de período transitório] Sem prejuízo do disposto no artigo 13.º, sempre
que uma Parte Contratante não tenha recusado os efeitos de uma inscrição no registo internacional
alegando a utilização prévia por um terceiro, tenha retirado tal recusa ou tenha notificado uma con-
cessão de proteção, pode, se a sua legislação o permitir, conceder um período definido de acordo
com o disposto nos regulamentos, para que seja posto termo a essa utilização.
2) [Notificação de um período transitório] A Parte Contratante deve notificar a Secretaria Inter-
nacional sobre qualquer período transitório, de acordo com os procedimentos especificados nos
regulamentos.
Artigo 18.º
Notificação da concessão de proteção
A autoridade competente de uma Parte Contratante pode notificar à Secretaria Internacional
a concessão de proteção a uma denominação de origem ou a uma indicação geográfica registada.
A Secretaria Internacional regista essa notificação de concessão de proteção no registo interna-
cional e publica-a.
Artigo 19.º
Anulação
1) [Oportunidade de defender direitos] A anulação total ou parcial dos efeitos de uma inscrição
no registo internacional no território de uma Parte Contratante só pode ser pronunciada após ter
sido dada aos beneficiários a oportunidade de defenderem os seus direitos. A mesma oportunidade
deve ser dada à pessoa singular ou coletiva a que se refere o artigo 5.º, n.º 2, alínea ii).
2) [Notificação, inscrição e publicação] A Parte Contratante notifica a anulação dos efeitos de
uma inscrição no registo internacional à Secretaria Internacional, que regista a anulação no registo
internacional e a publica.

3) [Proteção ao abrigo de outros instrumentos] A anulação não deve prejudicar qualquer outra
proteção disponível, em conformidade com o artigo 10.º, n.º 2, relativa à denominação ou indicação
em causa na Parte Contratante que anulou os efeitos da inscrição no registo internacional.
Artigo 20.º
Alterações e outras entradas no registo internacional
Os regulamentos especificam os procedimentos de alteração das inscrições e de outras
entradas no registo internacional.
CAPÍTULO V
Disposições administrativas
Artigo 21.º
Adesão à União de Lisboa
As Partes Contratantes são membros da mesma União Particular que os Estados membros
do Acordo de Lisboa ou do Ato de 1967, independentemente de serem ou não Partes no Acordo
de Lisboa ou no Ato de 1967.
Artigo 22.º
Assembleia da União Particular
1) [Composição] a) As Partes Contratantes são membros da mesma Assembleia que os Esta-
dos membros do Ato de 1967.
b) Cada Parte Contratante é representada por um delegado, que pode ser assistido por dele-
gados suplentes, conselheiros e peritos.
c) Cada delegação suporta as suas próprias despesas.
2) [Funções] a) A Assembleia:
i) Lida com todos os assuntos relativos à manutenção e ao desenvolvimento da União Parti-
cular e à aplicação do presente ato;
ii) Orienta o Diretor-Geral no respeitante à preparação das conferências de revisão a que se
refere o artigo 26.º, n.º 1, tomando em devida consideração quaisquer observações feitas pelos
membros da União Particular que ainda não tenham ratificado ou aderido ao presente ato;
iii) Altera os regulamentos;
iv) Analisa e aprova os relatórios e as atividades do Diretor-Geral referentes à União Particu-
lar, fornecendo-lhe todas as instruções necessárias relativamente aos assuntos que relevam da
competência da União Particular;
v) Determina o programa e adota o orçamento bienal da União Particular, e aprova as suas
contas finais;
vi) Adota os regulamentos financeiros da União Particular;
vii) Institui os comités e grupos de trabalho que considerar oportunos para alcançar os obje-
tivos da União Particular;
viii) Determina quais os Estados e organizações intergovernamentais e não governamentais
a admitir nas suas reuniões na qualidade de observadores;
ix) Adota alterações aos artigos 22.º, 23.º, 24.º e 27.º;
x) Toma quaisquer outras medidas oportunas para promover os objetivos da União Particular
e desempenha quaisquer outras funções pertinentes no âmbito do presente ato.
b) No que toca aos assuntos que são igualmente do interesse de outras Uniões administradas
pela Organização, a Assembleia delibera depois de tomar conhecimento do parecer do Comité
Coordenador da Organização.

3) [Quórum] a) Metade dos membros da Assembleia que têm direito de voto sobre um deter-
minado assunto constituem um quórum para efeitos de votação desse assunto.
b) Não obstante o disposto na alínea a), se, em qualquer sessão, o número de membros da
Assembleia que sejam Estados com direito de voto sobre um determinado assunto e estiverem
representados for inferior a metade mas igual ou superior a um terço dos membros da Assembleia
que sejam Estados com direito de voto sobre esse assunto, a Assembleia pode deliberar mas, à
exceção das decisões sobre o seu próprio regulamento interno, tais decisões só produzem efeitos
se as condições adiante enunciadas se verificarem. A Secretaria Internacional comunica as referi-
das decisões aos membros da Assembleia que sejam Estados com direito de voto sobre o referido
assunto e que não tenham estado representados, convidando-os a manifestar por escrito o seu
voto ou a sua abstenção no prazo de três meses a contar da data da comunicação. Se, findo este
prazo, o número desses membros que assim manifestaram o seu voto ou a sua abstenção for pelo
menos igual ao número de membros que faltava para ser atingido o quórum na sessão, as referidas
decisões produzem efeitos desde que, ao mesmo tempo, continue a existir a maioria necessária.
4) [Deliberações da Assembleia] a) A Assembleia diligenciará no sentido de tomar as suas
decisões por consenso.
b) Quando não for possível chegar a uma decisão por consenso, a decisão sobre o assunto
em análise é sujeita a votação. Nesse caso:
i) Cada Parte Contratante que seja um Estado dispõe de um voto e vota apenas em seu pró-
prio nome; e
ii) Qualquer Parte Contratante que seja uma organização intergovernamental pode votar, em
substituição dos respetivos Estados membros, dispondo para o efeito de um número de votos cor-
respondente ao número dos seus Estados membros que sejam Partes no presente ato. Nenhuma
dessas organizações intergovernamentais participa na votação se um dos respetivos Estados
membros exercer o seu direito de voto, e vice-versa.
c) No que se refere a assuntos que digam respeito unicamente aos Estados abrangidos pelo
Ato de 1967, as Partes Contratantes não abrangidas pelo mesmo não têm direito de voto, ao
passo que, em assuntos respeitantes unicamente às Partes Contratantes, apenas estas últimas
têm direito de voto.
5) [Maiorias] a) Sob reserva do artigo 25, n.º 2, e do artigo 27.º, n.º 2, as decisões da Assem-
bleia requerem dois terços dos votos expressos.
b) As abstenções não são consideradas como votos.
6) [Sessões] a) A Assembleia reúne mediante convocação do Diretor-Geral e, na ausência de
circunstâncias excecionais, durante o mesmo período e no mesmo local da Assembleia-Geral da
Organização.
b) A Assembleia reúne-se em sessão extraordinária mediante convocação do Diretor-Geral, a
pedido de um quarto dos membros da Assembleia ou por iniciativa do próprio Diretor-Geral.
c) A ordem de trabalhos das sessões extraordinárias é estabelecida pelo Diretor-Geral.
7) [Regulamento interno] A Assembleia adota o seu próprio regulamento interno.
Artigo 23.º
Secretaria Internacional
1) [Funções administrativas] a) As inscrições no registo internacional e assuntos conexos, bem
como todas as outras funções administrativas respeitantes à União Particular, são executadas pela
Secretaria Internacional.
b) Em particular, a Secretaria Internacional prepara as reuniões e assegura o secretariado da
Assembleia e dos comités e grupos de trabalho eventualmente instituídos pela Assembleia.
c) O Diretor-Geral é o diretor executivo da União Particular e o seu representante.
2) [Papel da Secretaria Internacional na Assembleia e em outras reuniões] O Diretor-Geral e
qualquer membro do pessoal por ele designado participa, sem direito de voto, em todas as reuniões

da Assembleia, dos comités e dos grupos de trabalho instituídos pela Assembleia. O Diretor-Geral,
ou um membro do pessoal por ele designado, é o secretário ex officio de tal organismo.
3) [Conferências] a) A Secretaria Internacional prepara, de acordo com as orientações da
Assembleia, quaisquer conferências de revisão.
b) A Secretaria Internacional pode consultar organizações intergovernamentais e organizações
não governamentais internacionais e nacionais a respeito dos referidos trabalhos preparatórios.
c) O Diretor-Geral e as pessoas por ele designadas participam, sem direito de voto, nos debates
no âmbito de conferências de revisão.
4) [Outras funções] A Secretaria Internacional desempenha quaisquer outras funções que lhe
sejam atribuídas no âmbito do presente ato.
Artigo 24.º
Finanças
1) [Orçamento] As receitas e despesas da União Particular devem refletir-se no orçamento da
Organização de maneira justa e transparente.
2) [Fontes de financiamento do orçamento] As receitas da União Particular provêm das seguin-
tes fontes:
i) Taxas cobradas ao abrigo do artigo 7.º, n.os 1 e 2;
ii) Receitas provenientes da venda de publicações da Secretaria Internacional ou de direitos
sobre as mesmas;
iii) Donativos, legados e subvenções;
iv) Rendas, receitas de investimentos, receitas diversas;
v) Contribuições especiais das Partes Contratantes ou de quaisquer fontes alternativas prove-
nientes das Partes Contratantes ou de beneficiários, ou de ambos, se as receitas provenientes das
fontes indicadas nas alíneas i) a iv) não forem suficientes para cobrir as despesas, como decidido
pela Assembleia.
3) [Estabelecimento de taxas; Nível do orçamento] a) Sob proposta do Diretor-Geral, a Assem-
bleia fixa os montantes das taxas a que se refere o n.º 2, de modo a que as receitas da União
Particular possam, juntamente com as receitas provenientes de outras fontes previstas no n.º 2 e
em circunstâncias normais, ser suficientes para cobrir as despesas da Secretaria Internacional no
que toca às inscrições no registo internacional.
b) Se o programa e o orçamento da Organização não forem aprovados antes do início de um
novo período financeiro, a autorização do Diretor-Geral para contrair obrigações e efetuar paga-
mentos deve ser de nível equivalente à do período financeiro anterior.
4) [Estabelecimento das contribuições especiais a que se refere o n.º 2, alínea v)] Para efeitos
do estabelecimento da respetiva contribuição, cada Parte Contratante deve pertencer à mesma
categoria a que pertence no âmbito da Convenção de Paris ou, no caso de uma Parte Contra-
tante que não tenha aderido àquela convenção, à mesma categoria a que pertenceria em caso de
adesão. Salvo decisão em contrário da Assembleia, tomada por unanimidade, considera-se que
as organizações intergovernamentais pertencem à categoria I (um). A contribuição é ponderada,
em parte, de acordo com o número de inscrições no registo por iniciativa da Parte Contratante, tal
como decidido pela Assembleia.
5) [Fundo de maneio] A União Particular dispõe de um fundo de maneio constituído pelos adian-
tamentos pagos por cada membro da União Particular quando esta o decidir. Se o fundo se tornar
insuficiente, a Assembleia pode decidir aumentá-lo. Sob proposta do Diretor-Geral, a Assembleia
fixa a proporção e as modalidades de pagamento. Se a União Particular registar um excedente
de receitas em relação às despesas, em qualquer período financeiro, os adiantamentos do fundo
de maneio podem, sob proposta do Diretor-Geral e após decisão da Assembleia, ser devolvidos a
cada um dos membros, de forma proporcional aos seus pagamentos iniciais.
6) [Adiantamentos do Estado de acolhimento] a) O acordo que institui a sede, celebrado com
o Estado em cujo território se encontra localizada a sede da Organização, deve prever que, sempre

que o fundo de maneio seja insuficiente, caberá a este Estado conceder adiantamentos. O montante
e as condições de concessão desses adiantamentos devem ser objeto de acordos separados, para
cada um dos efeitos, entre o Estado em causa e a Organização.
b) O Estado a que se refere a alínea a) e a Organização podem denunciar a obrigação de
conceder adiantamentos, mediante notificação escrita. A denúncia produz efeitos três anos após o
final do ano em que tiver sido notificada.
7) [Verificação das contas] A verificação das contas é efetuada por um ou mais Estados
membros da União Particular ou por auditores externos, em conformidade com os regulamentos
financeiros da Organização. Os verificadores das contas são designados, com o seu consentimento,
pela Assembleia.
Artigo 25.º
Regulamentos
1) [Objeto] Os elementos relativos à aplicação do presente ato são estabelecidos nos regu-
lamentos.
2) [Alteração de determinadas disposições dos regulamentos] a) A Assembleia pode decidir
que determinadas disposições dos regulamentos só podem ser alteradas por unanimidade ou por
uma maioria de três quartos.
b) Para que a unanimidade ou a maioria de três quartos deixem de ser aplicáveis à futura
alteração de disposições dos regulamentos, é exigida a unanimidade.
c) Para que a unanimidade ou a maioria de três quartos se tornem aplicáveis à futura alteração
de disposições dos regulamentos, é exigida uma maioria de três quartos.
3) [Conflito entre o presente ato e os regulamentos] Em caso de conflito entre o disposto no
presente ato e o disposto nos regulamentos, prevalecem as disposições do presente ato.
CAPÍTULO VI
Revisão e alteração
Artigo 26.º
Revisão
1) [Conferências de revisão] O presente ato pode ser revisto por conferências diplomáticas
das Partes Contratantes. Cabe à Assembleia decidir convocar uma conferência diplomática.
2) [Revisão ou alteração de determinados artigos] Os artigos 22.º, 23.º, 24.º e 27.º podem ser
alterados por uma conferência de revisão ou pela Assembleia, em conformidade com o disposto
no artigo 27.º
Artigo 27.º
Alteração de determinados artigos pela Assembleia
1) [Propostas de alteração] a) Qualquer Parte Contratante, bem como o Diretor-Geral, podem
apresentar propostas de alteração dos artigos 22.º, 23.º, 24.º, e do presente artigo.
b) Estas propostas são comunicadas pelo Diretor-Geral às Partes Contratantes pelo menos
seis meses antes de serem submetidas à apreciação da Assembleia.
2) [Maiorias] A aprovação de qualquer alteração dos artigos referidos no n.º 1 requer uma
maioria de três quartos; contudo, a aprovação de alterações do artigo 22.º ou do presente número
requer uma maioria de quatro quintos.
3) [Entrada em vigor] a) Salvo quando se aplica a alínea b), qualquer alteração dos artigos
referidos no n.º 1 entra em vigor um mês após a receção das notificações escritas de aceitação
pelo Diretor-Geral, efetuadas em conformidade com as respetivas regras constitucionais, da parte

de três quartos das Partes Contratantes que, na data de aprovação da alteração, eram membros
da Assembleia com direito de voto para a alteração em causa.
b) Qualquer alteração do artigo 22.º, n.os 3 ou 4, ou do presente número, não entra em vigor
se, no prazo de seis meses após a sua aprovação pela Assembleia, uma das Partes Contratantes
comunicar ao Diretor-Geral que não a aceita.
c) Uma alteração que entre em vigor nos termos do presente número vincula todos os Estados
e organizações intergovernamentais que sejam Partes Contratantes no momento da sua entrada
em vigor ou que se tornem Partes Contratantes em data posterior.
CAPÍTULO VII
Disposições finais
Artigo 28.º
Adesão ao presente ato
1) [Elegibilidade] Sob reserva do artigo 29.º e dos n.os 2 e 3 do presente artigo:
i) Qualquer Estado membro da Convenção de Paris pode assinar e tornar-se Parte no pre-
sente ato;
ii) Qualquer Estado membro da Organização pode assinar e tornar-se Parte no presente ato
se declarar que a sua legislação está em conformidade com as disposições da Convenção de Paris
relativas às denominações de origem, indicações geográficas e marcas comerciais;
iii) Qualquer organização intergovernamental pode assinar e tornar-se Parte no presente ato
desde que pelo menos um dos Estados membros dessa organização seja Parte na Convenção de
Paris, que declare que foi devidamente autorizada, de acordo com os seus procedimentos internos,
a tornar-se Parte no presente ato e que, ao abrigo do seu tratado constitutivo, aplica a legislação
ao abrigo da qual uma indicação geográfica pode obter proteção ao nível regional.
2) [Ratificação ou adesão] Qualquer Estado ou organização intergovernamental a que se
refere o n.º 1 pode depositar:
i) Um instrumento de ratificação, caso tenha assinado o presente ato; ou
ii) Um instrumento de adesão, caso não tenha assinado o presente ato.
3) [Data a partir da qual o depósito produz efeitos] a) Sob reserva do disposto na alínea b), a
data a partir da qual o depósito de um instrumento de ratificação ou de adesão produz efeitos é a
data em que esse instrumento é depositado.
b) A data a partir da qual produz efeitos o depósito do instrumento de ratificação ou de ade-
são de qualquer Estado que seja um Estado membro de uma organização intergovernamental e
relativamente ao qual a proteção de denominações de origem ou de indicações geográficas só
possa ser obtida com base na legislação aplicável entre os Estados membros da organização
intergovernamental é a data em que o instrumento de ratificação ou de adesão dessa organização
intergovernamental é depositado, caso esta data seja posterior à data em que o instrumento do
referido Estado tiver sido depositado. Todavia, a presente alínea não é aplicável aos Estados que
são Partes no Acordo de Lisboa ou no Ato de 1967 e não prejudica a aplicação do artigo 31.º a
esses Estados.
Artigo 29.º
Data efetiva de ratificações e de adesões
1) [Instrumentos a ter em consideração] Para efeitos do presente artigo, apenas são tidos em
consideração os instrumentos de ratificação ou de adesão depositados pelos Estados ou organi-

zações intergovernamentais a que se refere o artigo 28.º, n.º 1, cuja data de produção de efeitos
estiver em conformidade com o artigo 28.º, n.º 3.
2) [Entrada em vigor do presente ato] O presente ato entra em vigor três meses a contar da
data do depósito, por cinco das Partes elegíveis a que se refere o artigo 28.º, dos respetivos ins-
trumentos de ratificação ou de adesão.
3) [Entrada em vigor das ratificações e adesões] a) Qualquer Estado ou organização intergo-
vernamental que tenha depositado os respetivos instrumentos de ratificação ou de adesão pelo
menos três meses antes da data de entrada em vigor do presente ato fica vinculado por este na
data da sua entrada em vigor.
b) Qualquer outro Estado ou organização intergovernamental fica vinculado pelo presente ato
três meses após a data de depósito do respetivo instrumento de ratificação ou de adesão, ou numa
data posterior indicada nesse instrumento.
4) [Inscrições no registo internacional efetuadas antes da adesão] No território do Estado
aderente e, quando a Parte Contratante for uma organização intergovernamental, no território no
qual o tratado constitutivo da mesma for aplicável, as disposições do presente ato aplicam-se às
denominações de origem e indicações geográficas já registadas ao abrigo do presente ato na data
em que a adesão se torna efetiva, sob reserva do artigo 7.º, n.º 4, bem como das disposições do
capítulo එඞ, que são aplicáveis mutatis mutandis. O Estado ou organização intergovernamental ade-
rente pode também especificar, numa declaração a anexar ao seu instrumento de ratificação ou de
adesão, uma prorrogação do prazo a que se refere o artigo 15.º, n.º 1, bem como dos períodos a
que se refere o artigo 17.º, em conformidade com os procedimentos estabelecido nos regulamentos.
Artigo 30.º
Inadmissibilidade de reservas
Não se admitem reservas ao presente ato.
Artigo 31.º
Aplicação do Acordo de Lisboa e do Ato de 1967
1) [Relações entre Estados que são Partes no presente ato e no Acordo de Lisboa ou no Ato
de 1967] Apenas o presente ato é aplicável em matéria de relações mútuas entre os Estados que
sejam Parte no presente ato, bem como no Acordo de Lisboa ou no Ato de 1967. Contudo, no que
se refere à inscrição no registo internacional de denominações de origem efetivas ao abrigo do
Acordo de Lisboa ou do Ato de 1967, os Estados devem conferir-lhes uma proteção não inferior à
proteção prevista pelo Acordo de Lisboa ou pelo Ato de 1967.
2) [Relações entre Estados que são Partes no presente ato e no Acordo de Lisboa ou no Ato
de 1967 e Estados que são Partes no Acordo de Lisboa ou no Ato de 1967, mas não no presente
ato] Qualquer Estado que seja Parte, tanto no presente ato como no Acordo de Lisboa ou no Ato
de 1967, deve continuar a aplicar o Acordo de Lisboa ou o Ato de 1967, consoante o caso, nas
suas relações com os Estados que são Partes no Acordo de Lisboa ou no Ato de 1967, mas não
no presente ato.
Artigo 32.º
Denúncia
1) [Notificação] Qualquer Parte Contratante pode denunciar o presente ato mediante notificação
enviada ao Diretor-Geral.
2) [Data de produção de efeitos] A denúncia produz efeitos um ano após a data em que o
Diretor-Geral tiver recebido a notificação ou em data posterior indicada na notificação. A denúncia
não afeta a aplicação do presente ato aos pedidos pendentes e às inscrições no registo interna-
cional em vigor relativamente à Parte Contratante denunciante na data de produção de efeitos da
denúncia.

Artigo 33.º
Línguas do presente ato; Assinatura
1) [Textos originais; Textos oficiais] a) O presente ato é assinado num único original, em inglês,
árabe, chinês, francês, russo e espanhol, fazendo igualmente fé todos os textos.
b) O Diretor-Geral estabelecerá textos oficiais, depois de consultar os Governos interessados,
noutras línguas que a Assembleia poderá indicar.
2) [Prazo para a assinatura] O presente ato fica aberto à assinatura na sede da Organização
durante um ano após a sua adoção.
Artigo 34.º
Depositário
O Diretor-Geral é o depositário do presente ato.
(1) [Relações entre Estados que são Partes no presente ato e no Acordo de Lisboa ou no Ato de 1967] Apenas o
presente ato é aplicável em matéria de relações mútuas entre os Estados que sejam Parte no presente ato, bem como
no Acordo de Lisboa ou no Ato de 1967. Contudo, no que se refere à inscrição no registo internacional de denominações
de origem efetivas ao abrigo do Acordo de Lisboa ou do Ato de 1967, os Estados devem conferir-lhes uma proteção não
inferior à proteção prevista pelo Acordo de Lisboa ou pelo Ato de 1967.
(2) Declaração acordada relativa ao artigo 12.º: Para efeitos do presente ato, considera-se que o disposto no artigo 12.º
não prejudica a aplicação das disposições do presente ato respeitantes à utilização prévia, na medida em que, antes do
registo internacional, a denominação ou indicação que constitui a denominação de origem ou indicação geográfica pode
já ser genérica, total ou parcialmente, numa Parte Contratante que não a Parte Contratante de origem — por exemplo,
porque a denominação ou indicação, ou Parte dela, é idêntica a um termo correntemente utilizado como designação
comum de um produto ou serviço nessa Parte Contratante, ou é idêntica à designação comum de uma casta de uva na
Parte Contratante em causa.

CAPÍTULO I
Disposições preliminares e gerais
Regra 1
Definições
1) [Expressões abreviadas] Para efeitos do presente Regulamento de Execução e salvo indi-
cação expressa em contrário:
i) Entende-se por «Ato de Genebra», o Ato de Genebra do Acordo de Lisboa relativo às deno-
minações de origem e às indicações geográficas, de 20 de maio de 2015;
ii) As expressões abreviadas utilizadas no presente Regulamento de Execução e definidas nos
artigos 1.º e 2.º, n.º 1 do Ato de Genebra têm o mesmo significado que têm nesse Ato.
iii) Sempre que o Acordo de Lisboa relativo à proteção das denominações de origem e ao seu
registo internacional, de 31 de outubro de 1958, for aplicável em vez do Ato de 1967, entende-se que
qualquer referência ao Ato de 1967 é relativa ao Acordo de Lisboa, de 31 de outubro de 1958;
iv) Entende-se por «Regra», cada uma das Regras do presente Regulamento de Execução;
v) Entende-se por «Instruções Administrativas», as Instruções Administrativas a que se refere
a Regra 24;
vi) Entende-se por «formulário oficial», um formulário elaborado pela Secretaria Internacional;
vii) Entende-se por «comunicação», qualquer pedido de registo ou qualquer solicitação, decla-
ração, notificação, convite ou informação relativa a ou em acompanhamento de um pedido ou de
um registo internacional destinada a uma Autoridade competente, à Secretaria Internacional ou, no
caso a que se refere o artigo 5.º, n.º 3, do Ato de Genebra, aos beneficiários ou à pessoa singular
ou coletiva a que se refere o artigo 5.º, n.º 2, alínea ii), desse Ato;
viii) Entende-se por «pedido regido pelo Ato de 1967», um pedido que foi apresentado ao abrigo
do Ato de 1967, nos termos do qual as relações mútuas entre as Partes Contratantes envolvidas
são regidas pelo Ato de 1967;
ix) Entende-se por «pedido regido pelo Ato de Genebra», um pedido que foi apresentado ao
abrigo do Ato de Genebra, nos termos do qual as relações mútuas entre as Partes Contratantes
envolvidas são regidas pelo Ato de Genebra;
x) Entende-se por «recusa», a declaração a que se refere o artigo 5.º, n.º 3, do Ato de 1967
ou o artigo 15.º do Ato de Genebra.
2) (1) [Correspondência entre algumas expressões utilizadas no Ato de 1967 e no Ato de
Genebra] Para efeitos do presente Regulamento de Execução,
i) A referência à «Parte Contratante», é considerada, quando apropriado, como incluindo uma
referência ao «país contratante», tal como referido no Ato de 1967;
ii) A referência à «Parte Contratante de origem», é considerada, quando apropriado, como
incluindo uma referência ao «país de origem», tal como referido no Ato de 1967;

iii) A referência à «publicação», na Regra 19, é considerada, quando apropriado, como uma
referência a uma publicação no compêndio periódico referido no n.º 2 do artigo 5.º do Ato de 1967,
qualquer que seja o meio utilizado para a sua publicação.
Regra 2
Cálculo dos prazos
1) [Prazos expressos em anos] Um prazo expresso em anos expira no ano posterior, nos
mesmos dia e mês que o dia e o mês do evento a partir do qual o prazo começou a correr, salvo
se o evento tiver ocorrido em 29 de fevereiro, expirando o prazo nesse caso em 28 de fevereiro
do ano seguinte.
2) [Prazos expressos em meses] Um prazo expresso em meses expira no mês posterior cor-
respondente, no mesmo dia do evento a partir do qual o prazo começou a correr, salvo se o mês
posterior correspondente não tiver um dia com o mesmo número, expirando o prazo nesse caso
no último dia do mês.
3) [Prazo com termo num dia que não seja dia útil para a Secretaria Internacional ou para a
Autoridade competente] Se um prazo que se aplique à Secretaria Internacional ou à Autoridade
competente expirar num dia que não seja dia útil para a Secretaria Internacional ou para a Autori-
dade competente, o prazo, não obstante os n.os 1 e 2, expira para a Secretaria Internacional ou a
Autoridade competente, conforme o caso, no primeiro dia útil seguinte.
Regra 2bis
Atraso justificado no cumprimento dos prazos
1) [Justificação para o atraso no cumprimento dos prazos por motivos de força maior] O incum-
primento por parte de uma Autoridade competente ou, no caso do artigo 5.º, n.º 3, do Ato de
Genebra, de beneficiários ou de uma pessoa singular ou coletiva a que se refere o artigo 5.º, n.º 2,
alínea ii), desse Ato, de um prazo determinado no Regulamento de Execução para a prática de
um ato perante a Secretaria Internacional é justificado se a Autoridade competente ou, no caso do
artigo 5.º, n.º 3 do Ato de Genebra, os beneficiários ou a pessoa singular ou coletiva a que se refere
o artigo 5.º, n.º 2, alínea ii), apresentarem provas que demonstrem, para o contento da Secretaria
Internacional, que tal incumprimento ocorreu por motivos de guerra, revolução, desordem civil,
greve, calamidade natural, irregularidades nos serviços postais ou numa empresa de entrega, de
entrega ou de comunicação eletrónica em decorrência de circunstâncias para além do controlo da
Autoridade competente ou, no caso do artigo 5.º, n.º 3 do Ato de Genebra, dos beneficiários ou
de uma pessoa singular ou coletiva a que se refere o artigo 5.º, n.º 2, alínea ii), desse Ato ou por
outro motivo de força maior.
2) [Limitação relativa à justificação] O incumprimento de um prazo é justificado ao abrigo da
presente Regra somente se as provas e a ação a que se refere o n.º 1) forem recebidas pela, ou
executadas perante a Secretaria Internacional assim que razoavelmente possível e não mais tarde
do que seis meses depois do término do prazo em questão.
Regra 3
Línguas de trabalho
1) [Pedido] O pedido deve ser redigido em inglês, francês ou espanhol.
2) [Comunicações posteriores ao pedido] Qualquer comunicação referente a um pedido ou a
um registo internacional deve ser redigido em inglês, francês ou espanhol, à escolha da Autoridade
competente interessada ou, no caso a que se refere o artigo 5.º, n.º 3, do Ato de Genebra, à esco-
lha dos beneficiários ou da pessoa singular ou coletiva a que se refere o artigo 5.º, n.º 2, alínea ii),
desse Ato. Qualquer tradução necessária para os fins desses procedimentos deve ser realizada
pela Secretaria Internacional.

3) [Entradas no Registo Internacional e publicação] As entradas no Registo Internacional e
a publicação de tais entradas por parte da Secretaria Internacional devem ser feitas em inglês,
francês ou espanhol. As traduções necessárias para tais fins devem ser realizadas pela Secreta-
ria Internacional. Contudo, a Secretaria Internacional não traduz a denominação de origem ou a
indicação geográfica.
4) [Transliteração da denominação de origem ou da indicação geográfica] Se o pedido contiver
uma transliteração da denominação de origem ou da indicação geográfica de acordo com a Regra 5,
n.º 2, alínea b), a Secretaria Internacional não verifica se a transliteração está ou não correta.
5) [Traduções da denominação de origem para pedidos regidos pelo Ato de 1967] Se um pedido
regido pelo Ato de 1967 contiver uma ou mais traduções da denominação de origem, de acordo
com a Regra 5, n.º 6, alínea v), a Secretaria Internacional não verifica se as traduções estão ou
não corretas.
Regra 4
Autoridade competente
1) [Notificação à Secretaria Internacional] Cada Parte Contratante notifica à Secretaria Inter-
nacional o nome e os dados de contacto da sua Autoridade competente, isto é, a Autoridade que
a Parte Contratante tiver designado para apresentar pedidos e outras comunicações à Secretaria
Internacional, bem como para receber comunicações da mesma.
2) [Uma Autoridade ou diversas Autoridades] A notificação a que se refere o n.º 1 indica, de
preferência, uma única Autoridade competente. Quando uma Parte Contratante notificar diversas
Autoridades competentes, esta notificação deve indicar claramente as respetivas competências de
cada uma no que respeita à apresentação de pedidos e de outras comunicações para a Secretaria
Internacional, bem como à receção de comunicações da mesma.
3) [Informações sobre os procedimentos aplicáveis] A Autoridade competente disponibiliza
informações sobre os procedimentos aplicáveis no seu território para contestar e fazer valer os
direitos relativos às denominações de origem e indicações geográficas.
4) [Alterações] As Partes Contratantes notificam à Secretaria Internacional qualquer alteração
dos elementos a que se referem os n.os 1) e 3). Contudo, a Secretaria Internacional pode, ex officio,
tomar conhecimento de uma alteração na ausência de notificação, se houver indicações evidentes
de que tal alteração tenha ocorrido.
CAPÍTULO II
Pedido e registo internacional
Regra 5
Requisitos relativos ao pedido
1) [Apresentação] O pedido deve ser apresentado junto da Secretaria Internacional no formulário
oficial fornecido para tal fim e deve ser assinado pela Autoridade competente que o apresentar ou,
no caso referido no artigo 5.º, n.º 3 do Ato de Genebra, pelos beneficiários ou pela pessoa singular
ou coletiva a que se refere o artigo 5.º, n.º 2, alínea ii), desse Ato.
2) [Pedido — teor obrigatório] a) O pedido deve indicar:
i) A Parte Contratante de origem;
ii) A Autoridade competente que está a apresentar o pedido, ou, no caso do referido no artigo 5.º,
n.º 3, do Ato de Genebra, os dados para contacto dos beneficiários ou da pessoa singular ou coletiva
a que se refere o artigo 5.º, n.º 2, alínea ii), desse Ato;
iii) Os beneficiários, designados coletivamente ou, se a designação coletiva não for possível,
por nome ou, no caso de um pedido regido pelo Ato de Genebra, a pessoa singular ou coletiva com
legitimidade processual ao abrigo da legislação da Parte Contratante de origem para fazer valer

os direitos dos beneficiários ou outros direitos relativos à denominação de origem ou à indicação
geográfica;
iv) A denominação de origem ou a indicação geográfica para a qual se solicita o registo, na
língua oficial da Parte Contratante de origem ou, se a Parte Contratante de origem tiver mais de
uma língua oficial, na língua oficial ou nas línguas oficiais em que a denominação de origem ou a
indicação geográfica estiver contida no registo, ato ou decisão, em virtude do qual a proteção é
concedida na Parte Contratante de origem (2);
v) O produto ou os produtos a que se aplica a denominação de origem ou a indicação geográ-
fica, tão precisamente quanto possível;
vi) A área geográfica de produção ou a área geográfica de origem do produto ou dos produtos;
vii) Os dados de identificação do registo, incluindo a sua data e o seu número se aplicável,
do ato legislativo ou administrativo ou da decisão judicial ou administrativa em virtude da qual a
proteção é concedida à denominação de origem ou à indicação geográfica, na Parte Contratante
de origem.
b) Se não forem em carateres latinos os nomes dos beneficiários ou da pessoa singular ou
coletiva a que se refere o artigo 5.º, n.º 2, alínea ii), do Ato de Genebra, o nome da área geográfica
de produção ou da área geográfica de origem, e o nome da denominação de origem ou da indicação
geográfica para a qual se solicita o registo, o pedido deve incluir uma transliteração dos mesmos.
A transliteração deve utilizar a fonética da língua do pedido (2).
c) O pedido deve estar acompanhado da taxa de registo e de quaisquer outras taxas, conforme
especificado na Regra 8.
3) [Pedido regido pelo Ato de Genebra — Elementos relativos à qualidade, à reputação ou à(s)
característica(s)] a) Se uma Parte Contratante do Ato de Genebra exigir, para a proteção no seu
território de uma denominação de origem ou de uma indicação geográfica registada, que o pedido
regido pelo Ato de Genebra indique ainda elementos relativos à qualidade ou às características do
produto e à sua ligação com o ambiente geográfico da área geográfica de produção, no caso de
uma denominação de origem, e à qualidade, à reputação ou a outra característica do produto e à
sua ligação com a área geográfica de origem, no caso de uma indicação geográfica, essa Parte
Contratante deve notificar tal exigência ao Diretor-Geral.
b) A fim de que tal requisito seja satisfeito, os elementos referidos na alínea a) devem ser
fornecidos numa língua de trabalho, mas não são traduzidos pela Secretaria Internacional.
c) Um pedido que não se encontre em conformidade com um requisito devidamente notificado
pela Parte Contratante conforme o disposto na alínea a), tem como efeito, sob reserva da Regra 6,
a renúncia à proteção nessa Parte Contratante.
4) [Pedido regido pelo Ato de Genebra — assinatura e/ou intenção de utilização] a) Se uma
Parte Contratante do Ato de Genebra exigir, para a proteção no seu território de uma denominação
de origem ou de uma indicação geográfica registada, que o pedido regido pelo Ato de Genebra seja
assinado por uma pessoa com legitimidade processual para fazer valer os direitos conferidos por
tal proteção, essa Parte Contratante deve notificar tal exigência ao Diretor-Geral.
b) Se uma Parte Contratante do Ato de Genebra exigir, para a proteção no seu território de uma
denominação de origem ou de uma indicação geográfica registada, que o pedido regido pelo Ato de
Genebra esteja acompanhado de uma declaração da intenção de utilizar a denominação de origem
ou a indicação geográfica registada, ou de uma declaração da intenção de exercer controlo sobre
a utilização por terceiros, no seu território, da denominação de origem ou da indicação geográfica
registada, essa Parte Contratante deve notificar tal exigência ao Diretor-Geral.
c) Um pedido regido pelo Ato de Genebra que não estiver assinado em conformidade com
a alínea a), ou que não estiver acompanhado de uma declaração indicada na alínea b), tem, sob
reserva da Regra 6, o efeito de renúncia à proteção na Parte Contratante que exigir tal assinatura
ou declaração, conforme notificado nos termos das alíneas a) e b).
5) [Pedido regido pelo Ato de Genebra — Proteção não reivindicada para certos elementos da
denominação de origem ou da indicação geográfica] O pedido regido pelo Ato de Genebra deve
indicar se, ou não, tanto quanto for do conhecimento do requerente, o registo, o ato legislativo ou
regulamentar ou a decisão judicial ou administrativa em virtude de que a proteção foi concedida à

denominação de origem ou à indicação geográfica na Parte Contratante de origem especifica que
a proteção não foi concedida para certos elementos da denominação de origem ou da indicação
geográfica. Quaisquer desses elementos devem ser indicados no pedido numa língua de trabalho e
na língua oficial ou nas línguas oficiais da Parte Contratante de origem, conforme disposto no n.º 2,
alínea a), iv), juntamente com qualquer transliteração conforme disposto no n.º 2, alínea b).
6) [Pedido — Teor facultativo] a) O pedido pode indicar ou conter:
i) O endereço dos beneficiários ou, no caso de um pedido regido pelo Ato de Genebra e sem
prejuízo do disposto no n.º 2, alínea a), ii), da pessoa singular ou coletiva a que se refere o artigo 5.º,
n.º 2, alínea ii), desse Ato;
ii) Uma declaração de que se renuncia à proteção em uma ou mais Partes Contratantes;
iii) Uma cópia na língua original do registo, do ato legislativo ou regulamentar ou da decisão
judicial ou administrativa em virtude da qual a proteção é concedida à denominação de origem ou
à indicação geográfica na Parte Contratante de origem;
iv) A declaração de que não se reivindica a proteção para certos elementos da denominação
de origem, no caso de pedidos regidos pelo Ato de 1967, ou para certos elementos, que não sejam
aqueles a que se refere o n.º 5, da denominação de origem ou da indicação geográfica, no caso
de pedidos regidos pelo Ato de Genebra;
v) Uma ou mais traduções da denominação de origem, em tantas línguas quanto desejar a
Autoridade competente do país de origem, no caso de pedidos regidos pelo Ato de 1967;
vi) Quaisquer outras informações que a Autoridade competente da Parte Contratante de ori-
gem que é Parte no Ato de 1967 deseje fornecer referentes à proteção concedida à denominação
de origem nesse país, tais como elementos suplementares sobre a área de produção do produto
e a descrição da ligação entre a qualidade e as características do produto e o seu ambiente geo-
gráfico.
b) Não obstante a Regra 3, n.º 3, os elementos a que se refere as alíneas a), i) e vi), não são
traduzidos pela Secretaria Internacional.
Regra 6
Pedidos irregulares
1) [Exame do pedido e correção das irregularidades] a) Sob reserva do n.º 2), se a Secretaria
Internacional determinar que um pedido não satisfaz as condições estipuladas na Regra 3, n.º 1,
ou na Regra 5, deve adiar o registo e solicitar que a Autoridade competente ou, no caso previsto
no artigo 5.º, n.º 3 do Ato de Genebra, os beneficiários ou a pessoa singular ou coletiva a que se
refere o artigo 5.º, n.º 2, alínea ii), desse Ato, corrija ou corrijam a irregularidade encontrada num
prazo de três meses a partir da data do envio da solicitação.
b) Se a irregularidade encontrada não for corrigida dentro do prazo de dois meses a partir da
data da solicitação a que se refere a alínea a), a Secretaria Internacional deve enviar um lembrete
da sua solicitação. O envio de tal lembrete não tem qualquer efeito sobre o prazo de três meses a
que se refere a alínea a).
c) Se a correção da irregularidade não for recebida pela Secretaria Internacional dentro do
prazo de três meses a que se refere a alínea a), o pedido é, sob reserva da alínea d), rejeitado pela
Secretaria Internacional, que informa a Autoridade competente ou, no caso previsto no artigo 5.º,
n.º 3, do Ato de Genebra, os beneficiários ou a pessoa singular ou coletiva a que se refere o artigo 5.º,
n.º 2, alínea ii), desse Ato, bem como a Autoridade competente, conforme o caso.
d) No caso de uma irregularidade relativa a um requisito baseado numa notificação feita
ao abrigo da Regra 5, n.º 3 ou n.º 4, ou numa declaração feita ao abrigo do artigo 7.º, n.º 4, do
Ato de Genebra, se a correção da irregularidade não for recebida pela Secretaria Internacional
dentro do prazo de três meses a que se refere a alínea a), é considerado que houve renúncia
à proteção resultante do registo internacional na Parte Contratante que fez a notificação ou a
declaração.

e) Se, de acordo com a alínea c), o pedido for rejeitado, a Secretaria Internacional restitui as
taxas pagas em relação ao pedido, após a dedução de um montante equivalente a metade da taxa
de registo referida na Regra 8.
2) [Pedido não considerado como tal] Se um pedido não for apresentado pela Autoridade
competente da Parte Contratante de origem ou, no caso previsto no artigo 5.º, n.º 3, do Ato de
Genebra, pelos beneficiários ou pela pessoa singular ou coletiva a que se refere o artigo 5.º, n.º 2,
alínea ii), desse Ato, o mesmo não é considerado como tal pela Secretaria Internacional e é reen-
viado ao remetente.
Regra 7
Inscrição no Registo Internacional
1) [Registo] a) Se a Secretaria Internacional determinar que o pedido satisfaz as condições
estipuladas na Regra 3, n.º 1, e na Regra 5, a mesma procede à inscrição da denominação de
origem ou da indicação geográfica no Registo Internacional.
b) A Secretaria Internacional indica para cada Parte Contratante se o registo internacional é
regido pelo Ato de Genebra ou pelo Acordo de Lisboa, de 31 de outubro de 1958, ou pelo Ato de
1967.
2) [Teor do registo] O registo internacional deve conter ou indicar:
i) Todos os elementos fornecidos no pedido;
ii) A língua na qual a Secretaria Internacional recebeu o pedido;
iii) O número do registo internacional;
iv) A data do registo internacional.
3) [Certificado e notificação] A Secretaria Internacional:
i) Envia um certificado do registo internacional à Autoridade competente da Parte Contratante
de origem ou, no caso previsto no artigo 5.º, n.º 3, do Ato de Genebra, aos beneficiários ou à pes-
soa singular ou coletiva a que se refere o artigo 5.º, n.º 2, alínea ii), desse Ato, que solicitou ou
solicitaram o registo; e
ii) Notifica à Autoridade competente de cada Parte Contratante o registo internacional.
4) [Implementação dos artigos 29.º, n.º 4, e 31.º, n.º 1, do Ato de Genebra] a) Em caso de
ratificação do, ou adesão ao Ato de Genebra por um Estado que seja Parte no Ato de 1967, a Regra
5, n.º 2 a n.º 4, aplica-se mutatis mutandis em relação aos registos internacionais ou às denomi-
nações de origem em vigor ao abrigo do Ato de 1967, no que respeita a esse Estado. A Secretaria
Internacional verifica junto da Autoridade competente envolvida quaisquer alterações a fazer, tendo
em conta as exigências das Regras 3, n.º 1, e 5, n.º 2 a n.º 4, para efeitos do seu registo ao abrigo
do Ato de Genebra e notifica os registos internacionais assim efetuados a todas Partes Contratan-
tes que sejam Parte no Ato de Genebra. As alterações relativas à Regra 5, n.º 2, estão sujeitas ao
pagamento da taxa especificada na Regra 8, n.º 1, alínea ii).
b) Qualquer recusa ou anulação emitida por uma Parte Contratante do Ato de Genebra e do Ato
de 1967 permanece em vigor ao abrigo do Ato de Genebra em relação a um registo internacional
conforme referido na alínea a), salvo se a Parte Contratante notificar a retirada da recusa ao abrigo
do artigo 16.º do Ato de Genebra ou notificar uma declaração de concessão de proteção ao abrigo
do artigo 18.º do Ato de Genebra.
c) Se a alínea b) não for aplicável, a Parte Contratante do Ato de Genebra e do Ato de 1967,
ao receber uma notificação nos termos da alínea a), continua a proteger a denominação de origem
em questão, a partir desse momento, também ao abrigo do Ato de Genebra, salvo indicação em
contrário da Parte Contratante dentro do prazo especificado no artigo 5.º, n.º 3, do Ato de 1967
e, para o tempo restante, no artigo 15.º, n.º 1, do Ato de Genebra. Qualquer prazo concedido ao
abrigo do artigo 5.º, n.º 6, do Ato de 1967 e ainda em vigor aquando da receção da notificação nos

termos da alínea a) está, durante o tempo restante, sujeito às disposições do artigo 17.º do Ato de
Genebra.
d) A Autoridade competente de uma Parte Contratante do Ato de Genebra, mas não do Ato
de 1967 que receber uma notificação nos termos da alínea a) pode, de acordo com o artigo 15.º
do Ato de Genebra, notificar à Secretaria Internacional a recusa dos efeitos de quaisquer desses
registos internacionais no seu território. A recusa é encaminhada à Secretaria Internacional pela
Autoridade competente dentro do prazo especificado na Regra 9, n.º 1, alíneas b) e c). As Regras 6,
n.º 1, alínea d), e 9 a 12 são aplicáveis mutatis mutandis.
Regra 7bis
Data do registo internacional efetuado ao abrigo do Ato de 1967 e data dos seus efeitos
1) [Data do registo internacional] a) Sujeito à alínea b), a data do registo internacional de um
pedido depositado ao abrigo do Ato de 1967 é a data em que o pedido tiver sido recebido pela
Secretaria Internacional.
b) Se o pedido não contiver todos os seguintes elementos:
i) A indicação da Parte Contratante de origem;
ii) A indicação da Autoridade competente que apresenta o pedido;
iii) Os dados de identificação dos beneficiários;
iv) A denominação de origem para a qual se solicita o registo internacional;
v) A indicação do produto ou dos produtos a que se aplica a denominação de origem;
a data do registo internacional é a data em que o último dos elementos em falta for recebido pela
Secretaria Internacional.
2) [Data de produção de efeitos de um registo internacional] a) Sujeito à alínea b) e ao n.º 3,
uma denominação de origem que seja objeto de um registo internacional efetuado ao abrigo do
Ato de 1967 está protegida a partir da data do registo internacional em cada Parte Contratante do
Ato de 1967 que não tenha recusado, de acordo com o artigo 5.º, n.º 3, do Ato de 1967, a proteção
da denominação de origem ou que tenha enviado à Secretaria Internacional uma declaração de
concessão da proteção, de acordo com a Regra 12.
b) Uma Parte Contratante do Ato de 1967 pode, numa declaração, notificar o Diretor-Geral de
que, de acordo com a sua legislação, a denominação de origem registada a que se refere a alínea a)
está protegida a partir da data mencionada na declaração, a qual, no entanto, não deve ser posterior
à data de expiração do prazo de um ano a que se refere o artigo 5.º, n.º 3, do Ato de 1967.
3) [Data de produção de efeitos de um registo internacional na sequência de uma adesão ao
Ato de Genebra] Na sequência de uma ratificação do, ou de uma adesão ao Ato de Genebra por
uma Parte Contratante de origem que seja Parte no Ato de 1967, uma denominação de origem
que seja objeto de um registo internacional efetuado ao abrigo do Ato de 1967 está, em cada Parte
Contratante que seja Parte no Ato de Genebra mas não no Ato de 1967 e que não tenha recusado
proteção de acordo com o artigo 15.º do Ato de Genebra ou que tenha enviado à Secretaria Interna-
cional uma declaração de concessão de proteção de acordo com o artigo 18.º do Ato de Genebra,
e na ausência de qualquer irregularidade nos termos da Regra 6, n.º 1, alínea d), protegida a partir
da data em que a ratificação do, ou a adesão ao Ato de Genebra pela Parte Contratante de origem
entrar em vigor, sob reserva do artigo 6.º, n.º 5, alínea b), do Ato de Genebra.
Regra 8
Taxas
1) [Montante das taxas] A Secretaria Internacional cobra as seguintes taxas, que devem ser
pagas em francos suíços:
i) Taxa para o registo internacional (3) — 1000
ii) Taxa para uma alteração de um registo internacional (3) — 500

Taxa complementar para uma ou várias alterações suplementares apresentadas no mesmo
pedido — 300
iii) Taxa para a provisão de uma certidão extraída do Registo Internacional — 150
iv) Taxa para a provisão de uma declaração ou de quaisquer outras informações por escrito
relativas ao teor do Registo Internacional — 100
v) Taxas individuais conforme referidas no n.º 2)
2) [Fixação do montante de taxas individuais para pedidos regidos pelo Ato de Genebra]
a) Se uma Parte Contratante do Ato de Genebra fizer uma declaração conforme referido no
artigo 7.º, n.º 4 do Ato de Genebra, segundo a qual deseja receber uma taxa individual em relação
ao pedido regido pelo Ato de Genebra, como referido nessa disposição, o montante de tal taxa é
indicado na moeda utilizada pela Autoridade competente.
b) Se a taxa for indicada na declaração a que se refere a alínea a) numa moeda que não a
moeda suíça, o Diretor-Geral, após consulta com a Autoridade competente da Parte Contratante,
fixa o montante da taxa na moeda suíça, com base na taxa de câmbio oficial das Nações Unidas.
c) Se, por mais de três meses consecutivos, a taxa de câmbio oficial das Nações Unidas entre
a moeda suíça e a moeda na qual o montante de uma taxa individual tiver sido indicado por uma
Parte Contratante for superior ou inferior em pelo menos 5 % à última taxa de câmbio aplicada para
estabelecer o montante da taxa em moeda suíça, a Autoridade competente da Parte Contratante
pode solicitar que o Diretor-Geral fixe um novo montante para a taxa na moeda Suíça, de acordo
com a taxa de câmbio oficial das Nações Unidas registada no dia anterior ao dia em que a solici-
tação for feita. O Diretor-Geral adota as medidas pertinentes. O novo montante é aplicável a partir
de uma data que é fixada pelo Diretor-Geral, desde que seja entre um e dois meses depois da data
de publicação do referido montante no site Internet da Organização.
d) Se, por mais de três meses consecutivos, a taxa de câmbio oficial das Nações Unidas entre
a moeda suíça e a moeda em que o montante de uma taxa individual tiver sido indicado por uma
Parte Contratante for superior ou inferior em pelo menos 10 % à última taxa de câmbio aplicada
para estabelecer o montante da taxa em moeda suíça, o Diretor-Geral fixa um novo montante
para a taxa na moeda suíça, de acordo com a taxa de câmbio oficial das Nações Unidas. O novo
montante é aplicável a partir de uma data que é fixada pelo Diretor-Geral, desde que seja entre um
e dois meses depois da data de publicação do referido montante no site Internet da Organização.
3) [Creditação de taxas individuais relativas a pedidos regidos pelo Ato de Genebra nas contas
das Partes Contratantes interessadas que são Partes no Ato de Genebra] Qualquer taxa individual
paga à Secretaria Internacional com referência a uma Parte Contratante do Ato de Genebra é cre-
ditada na conta dessa Parte Contratante junto da Secretaria Internacional, no mês seguinte ao mês
durante o qual tiver sido efetuada a inscrição do registo internacional para o qual a taxa foi paga.
4) [Obrigação de utilizar a moeda suíça]. Todos os pagamentos à Secretaria Internacional, con-
forme o presente Regulamento de Execução, são efetuados em moeda suíça, independentemente
do facto de que, se as taxas forem pagas através de uma Autoridade competente, essa Autoridade
possa ter recebido o pagamento de tais taxas em outra moeda.
5) [Pagamento] a) Sob reserva da alínea b), as taxas são pagas diretamente à Secretaria
Internacional.
b) As taxas a pagar no âmbito de um pedido podem ser pagas através da Autoridade compe-
tente se a Autoridade competente aceitar receber e transferir tais taxas e se os beneficiários assim
o desejarem. Qualquer Autoridade competente que aceite receber e transferir tais taxas notifica a
sua aceitação ao Diretor-Geral.
6) [Modos de pagamento] As taxas são pagas à Secretaria Internacional de acordo com as
Instruções Administrativas.
7) [Indicações que devem acompanhar o pagamento] Aquando do pagamento de qualquer
taxa à Secretaria Internacional, deve indicar a denominação de origem ou a indicação geográfica
a que tal pagamento se refere e a finalidade do pagamento.
8) [Data do pagamento] a) Sob reserva da alínea b), qualquer taxa é considerada como tendo
sido paga à Secretaria Internacional no dia em que a Secretaria Internacional receber o montante
exigido.

b) Se o montante exigido estiver disponível numa conta aberta na Secretaria Internacional
e a Secretaria Internacional tiver recebido instruções por parte do titular da conta para debitar o
montante, a taxa é considerada como tendo sido paga à Secretaria Internacional no dia em que
a Secretaria Internacional receber um pedido ou uma solicitação para o registo de uma alteração.
9) [Alteração do montante das taxas] Se o montante de qualquer taxa for alterado, é aplicável
o montante válido na data em que a taxa tiver sido recebida pela Secretaria Internacional.
10) [Salvaguarda relativa ao Ato de 1967] a) Não obstante o n.º 1), alínea v), uma declaração
feita ao abrigo do artigo 7.º, n.º 4, do Ato de Genebra por uma Parte Contratante do Ato de Genebra
e do Ato de 1967, não tem qualquer efeito nas relações com outra Parte Contratante que seja Parte
no Ato de Genebra e no Ato de 1967.
b) A Assembleia pode, por uma maioria de três quartos, revogar a alínea a) ou restringir o
âmbito da alínea a). Somente as Partes Contratantes do Ato de Genebra e do Ato de 1967 têm o
direito de votar.
CAPÍTULO III
Recusa e outras ações relativas ao registo internacional
Regra 9
Recusa
1) [Notificação à Secretaria Internacional] a) Em caso de recusa, esta é notificada à Secreta-
ria Internacional pela Autoridade competente da Parte Contratante interessada e é assinada pela
Autoridade competente.
b) A recusa é notificada dentro do prazo de um ano a partir da receção da notificação do registo
internacional nos termos do artigo 5.º, n.º 2, do Ato de 1967 ou nos termos do artigo 6.º, n.º 4, do
Ato de Genebra. No caso previsto no artigo 29.º, n.º 4, do Ato de Genebra, este prazo pode ser
prolongado por mais um ano.
c) Salvo prova em contrário pela Autoridade competente a que se refere a alínea a), é consi-
derado que a notificação de um registo internacional a que se refere a alínea b) foi recebida pela
Autoridade competente 20 dias depois da data indicada na notificação.
2) [Teor da notificação de recusa] Uma notificação de recusa deve indicar ou conter:
i) A Autoridade competente que está a notificar a recusa;
ii) O número do registo internacional relevante, de preferência acompanhado de outra infor-
mação que permita confirmar a identidade do registo internacional, tal como a denominação que
constitui a denominação de origem ou a indicação que constitui a indicação geográfica;
iii) Os motivos nos quais se baseia a recusa;
iv) Se a recusa tiver como base a existência de um direito anterior, os elementos essenciais
desse direito anterior e, especialmente, se for constituído por um pedido ou registo de marca nacional,
regional ou internacional, juntamente com a lista dos produtos e serviços pertinentes apresentada
no pedido ou no registo da marca comercial, estando entendido que essa lista pode ser enviada
na língua do pedido ou do registo;
v) Se a recusa afetar somente certos elementos da denominação de origem ou da indicação
geográfica, uma indicação dos elementos a que a recusa diz respeito;
vi) As vias de recurso judiciais e administrativas disponíveis para se contestar a recusa, jun-
tamente com os prazos aplicáveis.
3) [Entrada no Registo Internacional e notificações por parte da Secretaria Internacional] Sob
reserva da Regra 10, n.º 1, a Secretaria Internacional procede à entrada no Registo Nacional de
qualquer recusa, juntamente com a data na qual a notificação de recusa foi enviada à Secretaria
Internacional, e transmite uma cópia da notificação de recusa à Autoridade competente da Parte
Contratante de origem ou, no caso previsto no artigo 5.º, n.º 3, do Ato de Genebra, aos beneficiários

ou à pessoa singular ou coletiva a que se refere o artigo 5.º, n.º 2, alínea ii), do Ato, bem como à
Autoridade competente da Parte Contratante de origem.
Regra 10
Notificação de recusa irregular
1) [Notificação de recusa não considerada como tal] a) Uma notificação de recusa não é con-
siderada como tal pela Secretaria Internacional:
i) Se não indicar o número do registo internacional em causa, salvo se outra informação indi-
cada na notificação permita a identificação sem ambiguidade do registo;
ii) Se não indicar nenhum motivo para a recusa;
iii) Se for enviada à Secretaria Internacional depois de expirado o prazo pertinente referido
na Regra 9, n.º 1;
iv) Se não for notificada à Secretaria Internacional pela Autoridade competente.
b) Quando se aplicar a alínea a), a Secretaria Internacional informa a Autoridade competente
que apresentou a notificação de recusa que a recusa não foi considerada como tal pela Secretaria
Internacional e não foi inscrita no Registo Internacional, especifica as razões para isso e, salvo se
não puder identificar o registo internacional em causa, transmite uma cópia da notificação de recusa
à Autoridade competente da Parte Contratante de origem ou, no caso previsto no artigo 5.º, n.º 3,
do Ato de Genebra, aos beneficiários ou à pessoa singular ou coletiva a que se refere o artigo 5.º,
n.º 2, alínea ii), desse Ato, bem como à Autoridade competente da Parte Contratante de origem.
2) [Notificação irregular] Se a notificação de recusa contiver uma irregularidade que não aque-
las a que se refere o n.º 1), a Secretaria Internacional, ainda assim, procede à entrada da recusa
no Registo Internacional e transmite uma cópia da notificação de recusa à Autoridade competente
da Parte Contratante de origem ou, no caso previsto no artigo 5.º, n.º 3, do Ato de Genebra, aos
beneficiários ou à pessoa singular ou coletiva a que se refere o artigo 5.º, n.º 2, alínea ii), desse
Ato, bem como à Autoridade competente da Parte Contratante de origem. A pedido da Autoridade
competente ou, no caso previsto no artigo 5.º, n.º 3, do Ato de Genebra, dos beneficiários ou da
pessoa singular ou coletiva a que se refere o artigo 5.º, n.º 2), alínea ii), desse Ato, a Secretaria
Internacional solicita que a Autoridade competente que enviou a notificação de recusa regularize
e notificação sem demora.
Regra 11
Retirada de recusa
1) [Notificação à Secretaria Internacional] Uma recusa pode ser retirada, parcial ou integral-
mente, a qualquer momento pela Autoridade competente que a notificou. A retirada de uma recusa
é notificada à Secretaria Internacional pela Autoridade competente pertinente e é assinada por
essa Autoridade.
2) [Teor da notificação] A notificação de retirada de uma recusa deve indicar:
i) O número do registo internacional em causa, de preferência acompanhado de outra infor-
mação que permita confirmar a identidade do registo internacional, tal como a denominação que
constitui a denominação de origem ou a indicação que constitui a indicação geográfica;
ii) O motivo para a retirada e, no caso de uma retirada parcial, os elementos referidos na Regra
9, n.º 2, alínea v);
iii) A data na qual a recusa foi retirada.
3) [Entrada no Registo Internacional e notificações pela Secretaria Internacional] A Secretaria
Internacional procede à entrada no Registo Internacional de qualquer retirada nos termos do n.º 1)
e transmite uma cópia da notificação de retirada à Autoridade competente da Parte Contratante de
origem ou, no caso previsto no artigo 5.º, n.º 3, do Ato de Genebra, aos beneficiários ou à pessoa

singular ou coletiva a que se refere o artigo 5.º, n.º 2, alínea ii), desse Ato, bem como à Autoridade
competente da Parte Contratante de origem.
Regra 12
Concessão de proteção
1) [Declaração facultativa de concessão de proteção] a) A Autoridade competente de uma
Parte Contratante que não recusar os efeitos de um registo internacional pode, dentro do prazo
indicado na Regra 9, n.º 1, enviar à Secretaria Internacional uma declaração confirmando que essa
proteção é concedida à denominação de origem ou à indicação geográfica que é objeto do registo
internacional.
b) A declaração de concessão de proteção deve indicar:
i) A Autoridade competente da Parte Contratante autora da declaração;
ii) O número do registo internacional em causa, de preferência acompanhado de outra infor-
mação que permita confirmar a identidade do registo internacional, tal como a denominação que
constitui a denominação de origem ou a indicação que constitui a indicação geográfica; e
iii) A data da declaração.
2) [Declaração facultativa de concessão de proteção na sequência de uma recusa] a) Se uma
Autoridade competente que tiver enviado anteriormente uma notificação de recusa desejar retirar
essa recusa, pode, em vez de notificar a retirada da recusa de acordo com a Regra 11, n.º 1, enviar
à Secretaria Internacional uma declaração de que é concedida a proteção à denominação de origem
ou à indicação geográfica pertinente.
b) A declaração de concessão de proteção deve indicar:
i) A Autoridade competente da Parte Contratante autora da declaração;
ii) O número do registo internacional em causa, de preferência acompanhado de outra infor-
mação que permita confirmar a identidade do registo internacional, tal como a denominação que
constitui a denominação de origem ou a indicação que constitui a indicação geográfica;
iii) O motivo da retirada e, no caso de uma concessão de proteção que corresponda à retirada
parcial de uma recusa, os elementos referidos na Regra 9, n.º 2, v); e
iv) A data na qual a proteção foi concedida.
3) [Entrada no Registo Internacional e notificações pela Secretaria Internacional] A Secretaria
Internacional procede ao Registo Internacional de qualquer declaração de concessão de proteção
nos termos dos n.os 1) ou 2) e transmite uma cópia de tal declaração à Autoridade competente da
Parte Contratante de origem ou, no caso do artigo 5.º, n.º 3, do Ato de Genebra, aos beneficiários
ou à pessoa singular ou coletiva a que se refere o artigo 5.º, n.º 2, alínea ii), do Ato, bem como à
Autoridade competente da Parte Contratante de origem.
Regra 13
Anulação dos efeitos de um registo internacional por uma Parte Contratante
1) [Notificação de anulação à Secretaria Internacional] Se os efeitos de um registo internacional
forem invalidados numa Parte Contratante, parcial ou integralmente, e se tiverem esgotados todos
os recursos contra a anulação, a Autoridade competente da Parte Contratante interessada transmite
à Secretaria Internacional uma notificação de anulação. A notificação deve indicar ou conter:
i) O número do registo internacional em causa, de preferência acompanhado de outra infor-
mação que permita confirmar a identidade do registo internacional, tal como a denominação que
constitui a denominação de origem ou a indicação que constitui a indicação geográfica;
ii) A Autoridade que pronunciou a anulação;
iii) A data na qual a anulação foi pronunciada;

iv) Se a anulação for parcial, os elementos referidos na Regra 9, n.º 2, v);
v) Os motivos com base nos quais a anulação foi pronunciada;
vi) Uma cópia da decisão que anulou os efeitos do registo internacional.
2) [Entrada no Registo Internacional e notificações pela Secretaria Internacional] A Secretaria
Internacional inscreve a anulação no Registo Internacional, juntamente com os elementos elenca-
dos nas alíneas i) a v) do n.º 1), e transmite uma cópia da notificação à Autoridade competente da
Parte Contratante de origem ou, no caso do artigo 5.º, n.º 3), do Ato de Genebra, aos beneficiários
ou à pessoa singular ou coletiva a que se refere o artigo 5.º, n.º 2), alínea ii), desse Ato, bem como
à Autoridade competente da Parte Contratante de origem.
Regra 14
Período transitório concedido a terceiros
1) [Notificação à Secretaria Internacional] Se tiver sido concedido, a uma parte terceira, um
prazo definido para pôr fim à utilização de uma denominação de origem ou de uma indicação
geográfica registada, numa Parte Contratante, de acordo com o artigo 5.º, n.º 6, do Ato de 1967
ou de acordo com o artigo 17.º, n.º 1, do Ato de Genebra, a Autoridade competente dessa Parte
Contratante notifica devidamente a Secretaria Internacional. A notificação deve ser assinada pela
referida Autoridade e indica:
i) O número do registo internacional em causa, de preferência acompanhado de outra infor-
mação que permita confirmar a identidade do registo internacional, tal como a denominação que
constitui a denominação de origem ou a indicação que constitui a indicação geográfica;
ii) A identidade da parte terceira interessada;
iii) A duração do período concedido à parte terceira, de preferência acompanhado de informa-
ções sobre o âmbito da utilização durante o período transitório;
iv) A data a partir da qual tem início o prazo definido, entendendo-se que essa data não pode
ser posterior a um ano e três meses da receção da notificação do registo internacional, de acordo
com o artigo 5.º, n.º 2, do Ato de 1967 ou o artigo 6.º, n.º 4, do Ato de Genebra, ou, no caso referido
no artigo 29.º, n.º 4, do Ato de Genebra, não pode ser posterior a dois anos e três a contar a partir
da receção da referida notificação.
2) [Duração nos termos do artigo 17.º do Ato de Genebra] A duração do prazo concedido a uma
parte terceira ao abrigo do artigo 17.º do Ato de Genebra não deve ultrapassar 15 anos, entendendo-
-se que esse prazo pode depender da situação específica de cada caso e que um período superior
a 10 anos seria excecional.
3) [Entrada no Registo Internacional e notificações pela Secretaria Internacional] Sob reserva de
a notificação a que se refere o n.º 1) ser enviada pela Autoridade competente à Secretaria Interna-
cional antes da data a que se refere o n.º 1), iv), a Secretaria Internacional inscreve essa notificação
no Registo Internacional, juntamente com os elementos nela contidos, e transmite uma cópia da
notificação à Autoridade competente da Parte Contratante de origem ou, no caso do artigo 5.º, n.º 3,
do Ato de Genebra, aos beneficiários ou à pessoa singular ou coletiva a que se refere o artigo 5.º,
n.º 2, alínea ii), desse Ato, bem como à Autoridade competente da Parte Contratante de origem.
Regra 15
Alterações
1) [Alterações permissíveis] As seguintes modificações podem ser inscritas no Registo Inter-
nacional:
i) Alteração dos beneficiários que consiste na adição ou na retirada de um ou mais beneficiá-
rios, ou alteração do nome ou do endereço dos beneficiários ou da pessoa singular ou coletiva a
que se refere o artigo 5.º, n.º 2, alínea ii), do Ato de Genebra;

ii) [Suprimido]
iii) Uma alteração dos limites da área geográfica de produção ou da área geográfica de origem
do produto ou dos produtos a que se aplica a denominação de origem ou a indicação geográfica;
iv) Uma alteração relativa ao ato legislativo ou regulamentar, à decisão judicial ou administra-
tiva, ou ao registo a que se refere a Regra 5, n.º 2, alínea a), vii);
v) Uma alteração relativa à Parte Contratante de origem que não afete a área geográfica de
produção ou a área geográfica de origem do produto ou dos produtos a que se aplica a denomina-
ção de origem ou a indicação geográfica;
vi) [Suprimido]
2) [Procedimento] a) Qualquer solicitação de entrada de uma alteração nos termos do pará-
grafo 1) deve ser apresentada à Secretaria Internacional e assinada pela Autoridade competente
da Parte Contratante de origem ou, no caso referido no artigo 5.º, n.º 3, do Ato de Genebra, pelos
beneficiários ou pela pessoa singular ou coletiva a que se refere o artigo 5.º, n.º 2, alínea ii), desse
Ato, e deve estar acompanhada da taxa especificada na Regra 8.
b) Qualquer solicitação de entrada de uma modificação nos termos do parágrafo 1) deverá,
se afetar uma área geográfica de produção ou uma área geográfica de origem transfronteiriça
recém-criada, conforme referido no artigo 1.º, alínea xiii), do Ato de Genebra, ser apresentada à
Secretaria Internacional e assinada pela Autoridade competente designada por acordo comum
conforme referido no artigo 5.º, n.º 4, do Ato de Genebra.
3) [Entrada no Registo Internacional e notificação às Autoridades competentes] A Secretaria
Internacional inscreve no Registo Internacional qualquer alteração solicitada de acordo com os n.os 1)
e 2), indicando da data da receção do pedido pela Secretaria Internacional, confirma a entrada à
Autoridade competente que solicitou a alteração e comunica tal alteração às Autoridades compe-
tentes das demais Partes Contratantes.
4) [Alternativa facultativa para registos internacionais efetuados ao abrigo do Ato de Genebra] No
caso referido no artigo 5.º, n.º 3), do Ato de Genebra, os n.os 1) a 3) são aplicáveis mutatis mutandis,
entendendo-se que um pedido por parte dos beneficiários ou de uma pessoa singular ou coletiva a
que se refere o artigo 5.º, n.º 2), alínea ii), do Ato de Genebra deve indicar que a alteração é solicitada
devido a uma alteração correspondente no registo, no ato legislativo ou regulamentar ou na decisão
judicial ou administrativa, com base na qual se tinha concedido proteção à denominação de origem
ou à indicação geográfica na Parte Contratante de origem autora de uma declaração de acordo
com o artigo 5.º, n.º 3), do Ato de Genebra; e deve indicar que a entrada da referida alteração no
Registo Internacional é confirmada aos beneficiários ou à pessoa singular ou coletiva interessados,
pela Secretaria Internacional, que também informa a Autoridade competente da Parte Contratante
de origem autora da declaração, de acordo com o artigo 5.º, n.º 3), do Ato de Genebra.
Regra 16
Renúncia à proteção
1) [Notificação à Secretaria Internacional] A Autoridade competente da Parte Contratante de
origem ou, no caso referido no artigo 5.º, n.º 3), do Ato de Genebra, os beneficiários ou a pessoa
singular ou coletiva a que se refere o artigo 5.º, n.º 2), alínea ii), desse Ato ou a Autoridade compe-
tente da Parte Contratante de origem pode, a qualquer momento, notificar a Secretaria Internacional,
da renuncia total ou parcial à proteção da denominação de origem ou da indicação geográfica, em
relação a uma Parte Contratante ou a algumas, mas não a todas as Partes Contratantes. A notifica-
ção da renúncia à proteção deve indicar o número do registo internacional em causa, de preferência
acompanhado de outra informação que permita confirmar a identidade do registo internacional, tal
como a denominação que constitui a denominação de origem ou a indicação que constitui a indica-
ção geográfica e deve ser assinada pela Autoridade competente ou, no caso referido no artigo 5.º,
n.º 3), do Ato de Genebra, pelos beneficiários ou pela pessoa singular ou coletiva a que se refere
o artigo 5.º, n.º 2), alínea ii), desse Ato.

2) [Retirada de uma renúncia] a) Qualquer renúncia, incluindo uma renúncia nos termos
da Regra 6, n.º 1, alínea d), pode ser retirada, parcial ou integralmente, a qualquer momento
pela Autoridade competente da Parte Contratante de origem ou, no caso referido no artigo 5.º,
n.º 3, do Ato de Genebra, pelos beneficiários ou pela pessoa singular ou coletiva a que se refere
o artigo 5.º, n.º 2, alínea ii), desse Ato ou pela Autoridade competente da Parte Contratante de
origem, mediante a correção da irregularidade no caso de uma renúncia nos termos da Regra 6,
n.º 1, alínea d).
b) Sob reserva do artigo 6.º, n.º 5, alínea b), do Ato de Genebra, em cada Parte Contratante
em que uma renúncia tenha efeito, uma denominação de origem ou uma indicação geográfica
registada está protegida a partir da data em que:
i) A retirada da renúncia for recebida pela Secretaria Internacional, no caso de uma renúncia
conforme referido no n.º 1); e
ii) A correção da irregularidade for recebida pela Secretaria Internacional, no caso de uma
renúncia conforme referido na Regra 6, n.º 1, alínea d).
3) [Entrada no Registo Internacional e notificação às Autoridades competentes] A Secretaria
Internacional inscreve no Registo Internacional qualquer renúncia à proteção conforme referido
no parágrafo 1) ou qualquer retirada de renúncia conforme referido no parágrafo 2), confirma a
entrada à Autoridade competente da Parte Contratante de origem e, no caso referido no artigo 5.º,
n.º 3, do Ato de Genebra, aos beneficiários ou à pessoa singular ou coletiva, informando também a
Autoridade competente da Parte Contratante de origem, e comunica a entrada de tal alteração no
Registo Internacional às Autoridades competentes de cada Parte Contratante a que essa renúncia,
ou a retirada de tal renúncia, diga respeito.
4) [Aplicação das Regras 9 à 12] A Autoridade competente de uma Parte Contratante que
receber uma notificação de uma retirada de renúncia pode notificar a Secretaria Internacional da
recusa dos efeitos do registo internacional no seu território. Tal declaração deve ser enviada à
Secretaria Internacional pela referida Autoridade competente dentro do prazo de um ano a contar da
data de receção da notificação por parte da Secretaria Internacional relativa à retirada da renúncia.
As Regras 9 a 12 são aplicáveis mutatis mutandis.
Regra 17
Cancelamento de um registo internacional
1) [Pedido de cancelamento] A Autoridade competente da Parte Contratante de origem ou,
no caso referido no artigo 5.º, n.º 3, do Ato de Genebra, os beneficiários ou a pessoa singular ou
coletiva a que se refere o artigo 5.º, n.º 2, alínea ii), desse Ato ou a Autoridade competente da Parte
Contratante de origem pode, a qualquer momento, solicitar o cancelamento do seu registo inter-
nacional à Secretaria Internacional. O pedido de cancelamento deve indicar o número do registo
internacional em causa, de preferência acompanhado de outra informação que permita confirmar
a identidade do registo internacional, tal como a denominação que constitui a denominação de ori-
gem ou a indicação que constitui a indicação geográfica, e é assinada pela Autoridade competente
ou, no caso do artigo 5.º, n.º 3, do Ato de Genebra, pelos beneficiários ou pela pessoa singular ou
coletiva a que se refere o artigo 5.º, n.º 2, alínea ii), desse Ato.
2) [Entrada no Registo Internacional e notificação às Autoridades competentes] A Secretaria
Internacional inscreve no Registo Internacional qualquer cancelamento, juntamente com os ele-
mentos apresentados no pedido, confirma a entrada à Autoridade competente da Parte Contratante
de origem ou, no caso do referido no artigo 5.º, n.º 3, do Ato de Genebra, aos beneficiários ou à
pessoa singular ou coletiva a que se refere o artigo 5.º, n.º 2, alínea ii), desse Ato, também infor-
mando a Autoridade competente da Parte Contratante de origem, e comunica o cancelamento às
Autoridades competentes das demais Partes Contratantes.

Regra 18
Correções feitas ao Registo Internacional
1) [Procedimento] Se a Secretaria Internacional, atuando ex officio ou a pedido da Autoridade
competente da Parte Contratante de origem, determinar que o Registo Internacional contém um
erro relativo à inscrição no Registo Internacional, deve corrigir o Registo em conformidade.
2) [Alternativa facultativa para registo internacional ao abrigo do Ato de Genebra] No caso refe-
rido no artigo 5.º, n.º 3, do Ato de Genebra, um pedido nos termos do n.º 1) pode ser apresentado
pelos beneficiários ou pela pessoa singular ou coletiva a que se refere o artigo 5.º, n.º 2, alínea ii),
desse Ato. Os beneficiários ou a pessoa singular ou coletiva são notificados pela Secretaria Inter-
nacional sobre qualquer correção relativa à inscrição no Registo Internacional.
3) [Notificação de correções às Autoridades competentes] A Secretaria Internacional notifica
qualquer correção do Registo Internacional às Autoridades competentes das Partes Contratantes,
bem como, no caso do referido no artigo 5.º, n.º 3, do Ato de Genebra, aos beneficiários ou à pessoa
singular ou coletiva a que se refere o artigo 5.º, n.º 2, alínea ii), desse Ato.
4) [Aplicação das Regras 9 a 12] Se a correção de um erro se referir à denominação de ori-
gem ou à indicação geográfica, ou ao produto ou aos produtos a que a denominação de origem
ou a indicação geográfica se aplica, a Autoridade competente de uma Parte Contratante tem o
direito de declarar que não pode garantir a proteção da denominação de origem ou da indicação
geográfica depois da correção. Essa declaração deve ser enviada à Secretaria Internacional pela
referida Autoridade competente dentro do prazo de um ano a partir da data de receção da notifi-
cação por parte da Secretaria Internacional relativa à correção. As Regras 9 a 12 são aplicáveis
mutatis mutandis.
CAPÍTULO IV
Disposições diversas
Regra 19
Publicação
A Secretaria Internacional publica todas as entradas efetuadas no Registo Internacional.
Regra 20
Certidões extraídas do Registo Internacional e outras informações fornecidas pela Secretaria Internacional
1) [Informações sobre o teor do Registo Internacional] Certidões extraídas do Registo Interna-
cional ou quaisquer outras informações sobre o teor desse Registo são fornecidas pela Secretaria
Internacional a qualquer pessoa que os solicitar, mediante pagamento da taxa especificada na
Regra 8.
2) [Comunicação de disposições, de decisões ou do registo ao abrigo dos quais uma denomi-
nação de origem ou uma indicação geográfica está protegida] a) Qualquer pessoa pode solicitar
da Secretaria Internacional uma cópia, na língua original, das disposições, das decisões ou do
registo a que se refere a Regra 5, n.º 2, alínea a), vii), mediante pagamento da taxa especificada
na Regra 8.
b) Se tais documentos já tiverem sido transmitidos à Secretaria Internacional, esta última
transmite, sem demora, uma cópia à pessoa que apresenta o pedido.
c) Se tais documentos não tiverem, em nenhum momento, sido transmitidos à Secretaria
Internacional, esta última solicita uma cópia dos mesmos à Autoridade competente da Parte Contra-
tante de origem e, ao recebê-los, transmite sem demora os documentos à pessoa que apresentou
o pedido.

Regra 21
Assinatura
Se for exigida a assinatura de uma Autoridade competente nos termos do presente Regula-
mento de Execução, tal assinatura pode ser manual ou substituída com a aposição de um fac-símile
ou de um selo oficial.
Regra 22
Data de envio das comunicações diversas
Se as notificações a que se referem as Regras 9, n.º 1, 14, n.º 1, 16, n.º 4, e 18, n.º 4, forem
transmitidas por envio postal, a data de expedição é determinada pelo carimbo postal. Se o carimbo
postal estiver ilegível ou ausente, a Secretaria Internacional trata a comunicação em questão como
se tivesse sido enviada 20 dias antes da data em que foi recebida. Se tais notificações forem expe-
didas através de um serviço de entrega de correspondência, a data de expedição é determinada
pelas informações fornecidas por essa empresa, com base nos dados por ela registados relativos
à expedição. Tais notificações ou avisos poderão também ser comunicados por telefac-símile ou
por meios eletrónicos, conforme disposto nas Instruções Administrativas.
Regra 23
Modos de notificação por parte da Secretaria Internacional
Qualquer notificação por parte da Secretaria Internacional referida no presente Regulamento
de Execução é dirigida às Autoridades competentes ou, no caso do referido no artigo 5.º, n.º 3, do
Ato de Genebra, aos beneficiários ou à pessoa singular ou coletiva a que se refere o artigo 5.º,
n.º 2, alínea ii), desse Ato, por qualquer meio que permita à Secretaria Internacional comprovar
que a notificação foi recebida.
Regra 24
Instruções Administrativas
1) [Determinação das Instruções Administrativas; assuntos regidos por elas] a) O Diretor-Geral
determina as Instruções Administrativas e pode alterá-las. Antes de determinar ou de alterar as
Instruções Administrativas, o Diretor-Geral consulta as Autoridades competentes das Partes Con-
tratantes que tiverem um interesse direto nas Instruções Administrativas propostas ou na alteração
proposta às mesmas.
b) As Instruções Administrativas tratam de questões relativamente às quais o presente Regula-
mento faz referência expressa às ditas Instruções e com detalhes relativos à aplicação do presente
Regulamento de Execução.
2) [Supervisão pela Assembleia] A Assembleia pode convidar o Diretor-Geral a alterar qualquer
disposição das Instruções Administrativas e o Diretor-Geral deve agir em conformidade.
3) [Publicação e data de entrada em vigor] a) As Instruções Administrativas e qualquer alteração
às mesmas devem ser publicadas.
b) Cada publicação deve especificar a data em que as disposições publicadas entram em
vigor. As datas podem ser diferentes para diferentes disposições, entendendo-se que nenhuma
disposição pode entrar em vigor antes da sua publicação.
4) [Conflito com o Ato ou com o presente Regulamento de Execução] Em caso de conflito
entre uma disposição das Instruções Administrativas, por um lado, e uma disposição do Ato ou do
presente Regulamento, por outro, prevalecem estes últimos.

Regra 25
Entrada em vigor; disposições transitórias
1) [Entrada em vigor] O presente Regulamento de Execução entra em vigor em 26 de feve-
reiro de 2020 e substituí o Regulamento de Execução ao abrigo do Ato de 1967 relativo à proteção
das denominações de origem e ao seu registo internacional, em vigor desde 1 de janeiro de 2016
(doravante denominado «o Regulamento ao abrigo do Acordo»).
2) [Disposições transitórias] Não obstante o n.º 1),
i) Qualquer pedido regido pelo Ato de 1967 que tiver sido recebido pela Secretaria Internacio-
nal antes da data a que se refere o n.º 1) é, na medida em que esteja conforme com os requisitos
do Regulamento de Execução ao abrigo no Ato de 1967, considerado conforme com os requisitos
aplicáveis para efeitos da Regra 7;
ii) Qualquer comunicação de recusa, retirada de recusa, declaração de concessão de proteção,
notificação de anulação dos efeitos de um registo internacional numa Parte Contratante, período
transitório concedido a terceiros, alteração, renúncia à proteção ou cancelamento de um registo
internacional efetuada ao abrigo do Ato de 1967 que tiver sido recebida pela Secretaria Interna-
cional antes da data a que se refere o parágrafo 1) é, na medida em que estiver conforme com
os requisitos do Regulamento ao abrigo do Ato de 1967, considerada conforme com os requisitos
aplicáveis para efeitos, respetivamente, das Regras 9, n.º 3, 11, n.º 3, 12, n.º 3, 13, n.º 2, 14, n.º 3,
15, n.º 3, 16, n.º 3, e 17, n.º 2.
(1) Na versão inglesa, é considerado que a referência ao termo «good», conforme apropriado, inclui uma referência
a «product», nos termos do Ato de 1967.
(2) A aplicação da Regra 5, n.º 2, alínea a), iv), e da Regra 5, n.º 2, alínea b), é feita sob reserva das disposições
da Regra 3, n.º 3 e n.º 4.
(3) Para um registo internacional relativo a uma área geográfica localizada num país menos desenvolvido (PMD), de
acordo com as listas estabelecidas pelas Nações Unidas, a taxa é reduzida a 50 % do montante especificado (arredondado
para o número inteiro mais próximo). Assim, a taxa é de 500 francos suíços para um registo internacional relativo à área
geográfica de origem localizada no PMD, de 250 francos suíços para uma alteração de um registo internacional relativo
à área geográfica de origem localizada num país da categoria dos PMD e de 150 francos suíços referentes a uma taxa
complementar para uma ou várias alterações suplementares apresentadas no mesmo pedido. Essas reduções de taxa
são aplicáveis três anos após a entrada em vigor do Ato de Genebra.
